TERMS AND CONDITIONS
General
1. Participation in the Love Whitsundays Giveaway (“the Promotion”) is deemed acceptance of these Terms and Conditions.
2. The promoter of this Promotion is Whitsunday Tourism Association Inc. (ABN 23 574 179 504) trading as Tourism Whitsundays (“the Promoter”)
Who can enter?
3. Entry is only available to Australian residents aged 18 years or over at the time of entry.
How to enter?
4. The Promotion commences at 2:00pm on Tuesday 11 June 2019 and ends at 2:00pm on Friday 21 June 2019 (“Promotion Term”).
5. Entrants must, during the Promotion Term
- Post a photograph on Instagram, and
- tag the photograph #lovewhitsundays and #adventureairlie and #whitcoastgiveaway
Note: the entrant must have permission from the copyright owner of any images submitted in the Promotion.
6. It is a condition of entry to the Promotion that photographs submitted may be used by the Promoter in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting, advertising or marketing any product or services, distributed and/or supplied by the Promoter. Consent and full release will be sought prior to this.
Prizes
7. The value of the prize pool is $17,671.00 and consists of ten (10) separate and different prize packages (“the Prize Packages”) including*;
- Prize Package 1. Accommodation, flights, activity and dining valued at $4,722,00.
- Prize Package 2. Accommodation, flights, activity and dining valued at $3,838.00.
- Prize Package 3. Accommodation, activity and dining valued at $2,097.00.
- Prize Package 4. Accommodation, activity and dining valued at $1,985.00.
- Prize Package 5. Accommodation, activity and dining valued at $1,735.00.
- Prize Package 6. Accommodation, activity and dining valued at $675.00.
- Prize Package 7. Accommodation, activity and dining valued at $1,375.00.
- Prize Package 8. Accommodation valued at $300.00.
- Prize Package 9. Accommodation valued at $629.00.
- Prize Package 10. Accommodation valued at $315.00.
8. The Prize Packages, or any unused portion of a Prize Package, are not transferable or exchangeable and cannot be taken as cash. The Prize Packages will not be reinstated, refunded or replaced, even in the event that the reservation is cancelled or changed.
9. The Prize Packages listed are subject to availability and may change at the discretion of the Promoter.
10. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize equal to the value and/or specification, subject to any written directions from a regulatory authority.
11. Each Prize Package is for two (2) people.
12. All flights in the Prize Packages must be economy return from Brisbane, Sydney or Melbourne and must be booked by Saturday 30 November 2019 for travel before Tuesday 30 June 2020. All flights in the Prize Package are inclusive of 20kg luggage per person and must not exceed $1,000 per prize package.
13. All Accommodation bookings of a Prize Package must be booked for stays before Tuesday 30 June 2020 and are subject to availability at the time of booking and at the Accommodation Supplier’s discretion depending on level of occupancy. All applicable booking terms and conditions of the Accommodation Supplier apply.
14. All vouchers and other prizes contained in the Prize Packages must be used before 30 June 2020.
15. The winner of a Prize Package may add services or stay additional nights, however the winner is responsible for any additional costs.
The draw
16. Entries received during the Promotion Term will be combined in the “Entry Pool”.
17. Winners will be decided at 05:30pm on Saturday 22 June 2019.
18. Prize Package one (1) to ten (10) will be decided by majority vote of a panel of judges – Mark Fitz, Lee Carseldine, Bohanna Gerritsen, Sera J. Wright and Donna van't Hoff. Images and captions will be judged on artistic merit, originality, subject and style.
19. The winners will be notified by the Visit Whitsundays Facebook page and the Whitsundays QLD Instagram page by 8:00am on Monday 24 June 2019.
The winners
20. The winning entrant has 48 hours from the time and date of the notification to respond and claim the relevant prize. If the prize is not claimed within this time frame, the prize will be redrawn, and any previous winners will forgo claims to the prize.
21. The Promoter’s decision is final, and no correspondence will be entered into.
The Promoter reserves the right, at any time, to verify the validity of entries, prize claims and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry or prize claim that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
22. It is a condition of accepting a Prize Package, that the winner consents to the Promoter using their name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting, advertising or marketing any products or services, distributed and/or supplied by the Promoter.
Promoter rights and liability
22. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to disqualify any entrant, or subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
23. Except for liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including but not limited to, where arising out of the following;
Any technical difficulties or equipment malfunction (whether or not under the Promoter’s control), or
Any theft, unauthorised access or third-party interference, or
Any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter, or
Any variation in prize value that is stated in these Terms and Conditions, or
Any tax liability or excess costs incurred by a winner or entrant, or
Use of the prize.
Privacy
24. All data and personal information from entries during the Promotion Term is collected by Wavemaker Brisbane** on behalf of the Promoter.
25. Data and personal information collected, will be used by the Promoter in order to contact the Promotion winners and the Promoter may for an indefinite period, unless otherwise advised, use this data for promotional, marketing and advertising purposes without remuneration to the individual.
26. The Promotion is in no way sponsored, endorsed, administered by or associated with Facebook and/or Instagram.
