AQUALAND & RABBITOHS COMPETITION
TERMS AND CONDITIONS
Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions
a) Eligible Match is the South Sydney Rabbitohs v St. George Illawarra Dragons match on 26th July 2019 (kick off at 7.55pm) at ANZ Stadium – Edwin Flack Avenue, Sydney Olympic Park, NSW, 2127, Australia.
b) Promoter is South Sydney District Rugby League Football Club Limited (ABN 28 002 487 390) of Level 4, 265 Chalmers Street Redfern, NSW 2016, Ph: (02) 8306 9900.
c) Qualifying Game is the game played by the four (4) Finalists at half time break of the Eligible Match.
d) Finalist means each of the top four (4) entrants determined in accordance with clause 5 below.
e) Promotional Period has the meaning set out in clause 2.
f) Winning Participant means the Finalist who wins the Qualifying Game.
g) Grand Final Game means the game which the Winning Participant will participate in.
h) Aqualand means Aqualand Developments Pty Ltd ACN 616 014 978 or its related bodies corporate (as defined under the Corporations Act 2001 (Cth)).
i) Aqualand Apartment means apartment 1.03 in the development known as “Blue” at 61 Lavender Street, Milsons Point developed by Aqualand North Sydney Lavender Development Pty Ltd ACN 613 625 577.
2. Promotional Period
Promotion commences at 12:00 am AEST on 27th June 2019 and ends at 01:00 pm AEST on 23rd July 2019 (“Promotional Period”).
3. Eligible Entrants
a) Entry is only open to NSW residents aged 18 years or over who are available to attend the Eligible Match (defined above) and who are either Australian citizens or permanent residents.
b) Employees (and their immediate families) of the Promoter or Aqualand and agencies associated with this Promotion or Aqualand are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
4. How to Enter
A) To enter, the entrant must complete the following steps during the Promotional Period:
a) visit https://www.rabbitohs.com.au/aqualandtc
, enter their personal details (first name, last name, email address) online to register into the ‘Aqualand & Rabbitohs ‘It’s Aqualand Time’ Competition; and
b) complete a variety of tasks online (e.g. sharing, liking, etc. via social media) to receive applicable points. The number of points awarded for completion of each task will be listed on the above referenced website.
B) There is a limit of 1 registration permitted per person (and per email address). Multiple registrations from the same person/email address and fraudulent entries will be disqualified.
C) Entrants must be available to attend the Eligible Match to be eligible to be deemed a participant in the Qualifying Game.
5. Top 50 Winners Determination
a) Entrants will be ranked based on the number of valid points obtained in accordance with clause 4 above, during the Promotional Period. The top fifty (50) entrants will win the respective prize outlined below, based on their ranking.
Top 4 - The top 4 entrants are each deemed a “Finalist” and will receive:
o The opportunity to participate in the Qualifying Game on field at the Eligible Match for the chance to win the Aqualand Apartment;
o An Aqualand South Sydney Rabbitohs Home Jersey numbered on the back valued at AUD$120.00; and
o a double pass (General Admission) to the Eligible Match (South Sydney Rabbitohs vs. St George Illawarra - 26th July 2019 – ANZ Stadium – 7.55pm at ANZ Stadium – Edwin Flack Avenue, Sydney Olympic Park, NSW, 2127, Australia) valued at AUD$40 each.
Top 5-20 – An Aqualand South Sydney Rabbitohs Home Jersey numbered on the back valued at
AUD$120.00, and a double pass (General Admission) to the Eligible Match (South Sydney Rabbitohs
vs. St George Illawarra - 26th July 2019 – ANZ Stadium – 7.55pm at ANZ Stadium – Edwin Flack
Avenue, Sydney Olympic Park, NSW, 2127, Australia) valued at AUD$40 each.
Top 21-50 – A double pass (General Admission) to the Eligible Match (South Sydney Rabbitohs vs. St
George Illawarra - 26th July 2019 – ANZ Stadium – 7.55pm at ANZ Stadium – Edwin Flack Avenue,
Sydney Olympic Park, NSW, 2127, Australia) valued at AUD$40 each.
b) Tie Break Mechanic: If there is a tie for any of the top-ranking positions outlined above then a winner will be
determined based on the time that they registered for the Promotion. The tied entrant who has entered the
competition first will be deemed successful.
The top fifty (50) winners will be published at http://www.rabbitohs.com.au
on 28th July 2019.
7. Qualifying Game
a) The Finalists will each have the opportunity to participate in the Qualifying Game.
b) If any of the top four (4) ranked entrants cannot be contacted by 5pm (NSW time) on the closing day of the
Promotion, the Promoter will contact the next highest ranked entrant from the leader board. This process will
continue until 4 Finalists are confirmed to participate in the Qualifying Game. Each entrant will have 2 hours (120
minutes) to call the Promoter back and accept participation in the Qualifying Game from the time of the phone
call to them by the Promoter inviting them to participate in the Qualifying Game. If an entrant fails to do so, they
will forfeit their right to participate in the Qualifying Game and forfeit any right to a prize.
c) Under no circumstances whatsoever will a proxy or replacement Finalist be permitted to take part in the
Qualifying Game if the Finalist is unable to participate for any reason. An ID check will be carried out by the
Promotional Staff prior to the Qualifying Game starting to ensure the person attending is the correct Finalist.
d) During half-time, the four (4) Finalists will participate in an “On-field Building Skills Challenge’’. Details and rules
of the Qualifying Game will be communicated to the Finalists prior to the start of the Qualifying Game. The
Finalist who is deemed to finish the Qualifying Game in the quickest time will be the winner and will then go
through to participate in the Grand Final Game (“Winning Participant”). If there is any dispute as to who is the
winner for the Qualifying Game, the Promoter’s decision will be final. If a Finalist breaches any rules of the
Qualifying Game, the Promoter may disqualify the Finalist at their own discretion.
8. Grand Final Game
a) The Grand Final Game will take place immediately after the Qualifying Game at the Eligible Match. Only the
Winning Participant will take part in the Grand Final Game. For the Grand Final Game,
people/ambassadors/promotional staff will wear South Sydney Rabbitohs Jerseys which are numbered 1-20 on
the back or front of the jersey to differentiate each and to clearly correspond to each numbered security envelope.
Two (2) envelopes will each contain a winning symbol, all other eighteen (18) envelopes will each contain no
b) The Winning Participant will be required to choose two (2) numbered jerseys (which correspond to two (2)
numbered envelopes). If there is any dispute as to the jersey numbers selected by the Winning Participant, the
Promoter’s decision will be final.
c) The numbered jerseys/people/staff chosen will correspond to 2 x numbered envelopes from a batch of 20.
If the two (2) jerseys selected correspond to the 2 x envelopes containing the winning symbol – the
Winning Participant wins the Aqualand Apartment (valued up to AUD$1,050,000, based on the list
price of the apartment, disregarding any rebates, discounts or other promotions on offer by
Alternatively, if the two (2) jerseys selected correspond to 1 x envelope containing the winning
symbol and 1 x envelope containing a non-winning symbol – the Winning Participant wins
Finally, if the two (2) jerseys selected correspond to two (2) envelopes containing non-winning
symbols – the Winning Participant wins AUD$1,000 CASH.
d) Prize is only awarded once results of the Grand Final Game are successfully verified by an independent
scrutineer or a representative of the Promoter. Only one (1) prize referenced in clause 8(c) above will be awarded
to the Winning Participant. If for example the AUD$1,000 cash prize is won by the Winning Participant, then the
Aqualand Apartment (valued up to AUD $1,050,000) and AUD$10,000 cash prizes will NOT be awarded.
e) If the Winning Participant wins the Aqualand Apartment prize:
Aqualand will be responsible for any applicable statutory fees or charges in order to transfer the
Aqualand Apartment to the Winning Participant. Any other costs associated with the apartment, e.g.
land tax, water/council rate, strata fees, insurance, furniture and fit out, electricity costs,
conveyancing costs, legal fees and financing costs etc, will be the responsibility of the Winning
The Winning Participant must consent to and sign any documents necessary in order to effect the
transfer of the Aqualand Apartment to the Winning Participant.
The Winning Participant may not nominate any other third party to acquire the Aqualand Apartment
in its place.
f) Any cash prizes if won, will be provided to the Winning Participant via electronic funds transfer (EFT) to an
Australian bank account in the Winning Participant’s name by the Promotor.
9. Winner Notification
The top fifty (50) winners will be notified via phone and email. The Finalists will be notified within three (3) hours of the
Promotion Period end time.
10. Unclaimed Prizes
If for any reason a winner does not claim a prize by the date/time specified by the Promoter they will forfeit their right
to the prize and the prize will not be re-awarded.
11. The Promoter or Aqualand reserves the right, at any time, to verify the validity of entries and entrants (including an
entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual
who the Promoter or Aqualand has reason to believe has breached any of these Terms and Conditions, tampered with
the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper
conduct of the promotion. Errors and omissions may be accepted at the Promoter's or Aqualand’s discretion. Failure
by the Promoter or Aqualand to enforce any of its rights at any stage does not constitute a waiver of those rights. The
Promoter's or Aqualand’s legal rights to recover damages or other compensation from such an offender are reserved.
12. Incomplete, indecipherable or illegible entries will be deemed invalid.
13. If there is a dispute as to the identity of an entrant, the Promoter or Aqualand reserves the right, in its sole discretion,
to determine the identity of the entrant.
14. The Promoter’s decision is final and no correspondence will be entered into.
15. If for any reason a winner does take or claim a prize (or an element of the prize) at/by the time stipulated by the
Promoter, then the prize (or that element of the prize) will be forfeited.
16. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize
(or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a
17. All tickets awarded are subject to the game venue and ticket terms and conditions, including any applicable age
restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or his/her
companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element
of the prize.
18. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless
19. Entrants consent to the Promoter or Aqualand using their name, likeness, image and/or voice in the event they are a
winner (including photograph, film and/or recording of the same) in any media for an unlimited period without
remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products
manufactured, distributed and/or supplied by the Promoter or Aqualand.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to
any reason beyond the reasonable control of the Promoter or Aqualand, including but not limited to technical difficulties,
unauthorised intervention or fraud, the Promoter or Aqualand reserves the right, in its sole discretion, to the fullest
extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority,
to modify, suspend, terminate or cancel the promotion, as appropriate.
21. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the
Internet service provider used.
22. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to
automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
23. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the
statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other
implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of
Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-
Excludable Guarantees, the Promoter and Aqualand (including its respective officers, employees and agents) excludes
all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of the Promotion.
24. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, Aqualand, the
Promoter and Rabbitohs (including its respective officers, employees and agents) is not responsible for and excludes
all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether
direct, indirect, special or consequential, arising in any way out of:.
i. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
ii. any theft, unauthorised access or third party interference;
iii. any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt
by the Promoter) due to any reason beyond the reasonable control of the Promoter or Aqualand;
