TERMS & CONDITIONS
1. This Promotion is run by Swisse Wellness Pty Ltd (ACN 004 926 005).
2. Information on how to enter, mechanics of entry and prizes form part of these Conditions of Entry. Entry into the Promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only.
PROMOTIONAL PERIOD
3. The Promotion commences at 00:01am (AEST) for Australian residents (02.01am NZST) for New Zealand residents) on 29/07/2019 and concludes at 11:59pm (AEST) on 30/09/2019 for Australian residents (01.59am (NZST) for New Zealand residents on 01/10/2019) (Promotional Period).
ELIGIBILITY
4. Entry is only open to residents of Australia and New Zealand aged 18 years or older who in the event that their entry is drawn as a winning entry, are able to travel to and remain in the country of their chosen Swisse Expedition for seven (7) nights during the Redemption Period (inclusive) in order to participate in the prize as set out in Condition 22 (Entrants).
5. The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this Promotion are ineligible to enter the Promotion.
HOW TO ENTER
6. To enter the promotion, Entrants must, during the Promotional Period:
a. purchase one (1) Swisse branded product (excluding Swisse Ultiboost Iron) (Eligible Product) in a single transaction from any authorised Australian or New Zealand stockist (Participating Retailer) during the Promotional Period (Eligible Purchase);
b. retain the original purchase receipt (Proof of Purchase); and
c. access
www.swisse.com.au/swisseexpedition for entrants in Australia, and
www.swisse.com/swisseexpedition for entrants in New Zealand (as applicable) (each, the Promotional Website) and follow the prompts to correctly complete and successfully submit the online entry form in the manner required.

7. An Entrant may only submit one (1) Entry per Eligible Purchase. Multiple Entries are permitted (up to a maximum of four (4)), however each Entry must be based on a separate Eligible Purchase, submitted separately and must independently comply with these Conditions of Entry.
8. The purchase of an Eligible Product entitles the Entrant, subject to these Conditions of Entry, to one (1) Entry into the Major Prize Draw and, while there are prizes remaining,
a. for Entrants from Australia, the opportunity to collect an Instant Win Prize; and
b. for Entrants from New Zealand, the opportunity to win a Minor Prize.
9. Upon submitting a valid Entry, Entrants from Australia will immediately be notified onscreen on their computer or mobile device whether or not they are an instant winner. All Entrants will receive confirmation in writing (via email) confirming their Entry into the Major Prize Draw, and the details of the Instant Win Prize for Australian Entrants (if an instant winner), and the details of Minor Prize for New Zealand Entrants (if a Minor Prize winner). This is a game of chance and winners will be determined at random and not by the use of any skill.
10. Selection of Eligible Products is subject to availability at each Participating Retailer and based on reasonably anticipated demand. The Promoter accepts no responsibility for any Eligible Products being unavailable at a Participating Retailer during the Promotional Period.
11. Each Entrant must retain and may be required to present their original Proof of Purchase (valid receipt) of each Eligible Purchase in order to claim a prize. If an Entrant is unable to provide Proof of Purchase for all Entries made within the required timeframes, then all the Entries of that Entrant will be ineligible and deemed invalid.
12. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. Entries must be received during the Promotional Period, otherwise the Entry will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Contact details entered incorrectly by an Entrant will deem their Entry invalid.
13. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all Entries submitted by that Entrant invalid.
MINOR PRIZE DRAW - NEW ZEALAND ONLY
14. For the purpose of determining Minor Prize winners for Entrants from New Zealand, the draw will be conducted at 10.00 am (AEST) on 02/10/2019 at M&C Collective at 23 Norton Street, Leichardt NSW 2040.
15. Following the relevant draws and subject to winner verification, the winners’ details will be published on the Promotional Page on 18/10/2019 and will remain on the Promoter’s website for no less that twenty-eight days. All reasonable steps to notify winners will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
RESERVES
16. The Promoter may draw twenty (20) additional reserve Entries and record them (in order) in case an invalid Entry or ineligible Entrant is drawn or the Entrant is ineligible to accept or declines to participate in the prize. Each Entrant whose Entry is drawn by the Promoter must confirm their eligibility, via email, to be awarded the prize and their ability to accept the prize within forty-eight (48) hours of being successfully notified by the Promoter that their Entry has been drawn, otherwise their Entry will be deemed invalid. In the event of an invalid Entry or an ineligible Entrant, or if the Entrant is ineligible to accept or declines to participate in the prize, the prize will be awarded to the first reserve Entrant drawn. If the prize cannot be awarded to the Entrant drawn, the Promoter will continue this process until the prize is awarded. If after this process a prize has still not been awarded, or if an Entrant drawn cannot be notified, the Promoter will hold unclaimed prize draws in accordance with Condition 33. For the avoidance of doubt, only once an Entrant has confirmed their eligibility to be awarded the prize and ability to participate in the prize and has otherwise complied with the eligibility requirements will the Entrant, subject to these Terms and Conditions, be an eligible Entrant and be deemed a winner.
MAJOR PRIZE DRAW
17. The draw to determine the winners of the Major Prize Draw will take place at 10:00am (AEDT) on 16/10/2019 at M&C Collective at 23 Norton Street, Leichardt NSW 2040 from the Entrant pool made up of both the Australian Entrants and New Zealand Entrants. In order to comply with New South Wales legislation, an independent scrutineer will oversee the conduct of the prize draw and winner announcement as the total value of the prize in the draw is greater than $10,000. Winners will be notified in writing via email within two (2) days of the Major Prize Draw, and their names and locations will be published on the Promotional Website on 01/11/2019 and will remain on the Promotional Website for no less than twenty-eight (28) days. All reasonable attempts to notify the winners of the results of the Major Prize Draw will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
18. The Promoter may draw five (5) additional reserve entries in the Major Prize Draw and record them (in order) in case an invalid Entry or Entrant is drawn or the Entrant is unable to accept or declines to participate in the prize. Entrants whose Entries are drawn by the Promoter must confirm their eligibility as an Entrant within 10 business days of being successfully notified by the Promoter that their Entry has been drawn, otherwise their Entry will be deemed invalid. In the event of an invalid Entry or an ineligible Entrant, or if an Entrant is unable to accept a prize or declines to participate in the prize, the prize will be awarded to the first reserve Entry drawn. The Promoter will continue the process until the prize is awarded. If after this process a prize has still not been awarded or an Entrant drawn cannot be notified, the Promoter will hold an unclaimed prize draw in accordance with Condition 33.
PRIZES
19. Instant Win Prizes: The instant win prizes available to Australian Entrants to be won in this promotion comprise of: 400 x $100 Kathmandu digital gift vouchers, valued at up to AUD$40,000.
20. Minor Prizes: The minor prize draw prizes available to New Zealand Entrants to be won in this promotion comprises of: 100 X $100 Kathmandu digital gift vouchers, valued at up to NZD$10,000.
21. Digital gift vouchers are subject to their prevailing terms and conditions of use, including expiry dates, and are not replaceable if lost, deleted or corrupted.
22. Major Prizes: The first three (3) eligible entries randomly drawn from all entries received during the Promotional Period will each win one (1) International Travel Prize package chosen from those (Swisse Expedition) for seven (7) nights during the period 15/01/2020 until 15/10/2020 (Redemption Period) for the winner and one (1) companion (if the companion is aged under 18 years, they must be accompanied by their parent or legal guardian), each package valued at up to AUD$20,000. 23. The prize, including e-tickets and/or other confirmation details (if any) will be distributed to the winner via email (or other method nominated by the Promoter or its agent(s)) at least three (3) weeks prior to the departure date.
24. The prize must be taken during the Redemption Period, otherwise the prize is forfeited. Winner must finalise the prize booking within twelve (12) weeks of the prize draw. Winner must book at least 60 days prior to intended travel departure and availability cannot be guaranteed during school holiday and special event periods. All components of the prize must be taken together when offered or are forfeited. If the winner selects the USA prize and the winner is under 21 years of age, then they must select a guest who is 21 years of age or older. The winner and their companion (if any) must depart from and return to the same departure point on the same flights and stay at the same property. The winner and their companion (if any) may not accrue frequent flyer points. A prize cannot be used in conjunction with travel discounts or special offers. Travel and accommodation are to be arranged and selected by an agent nominated by the Promoter: 33 Degrees (Prizing Agency). Travel itinerary will be determined by the Promoter in its absolute discretion. No extension or variation of the travel and or/accommodation dates is permitted OR Any extension or variation of the travel and/or accommodation date(s) nominated by the Promoter will be at the cost and responsibility of a winner and their companion (if any). Once bookings are confirmed no changes will be allowed, unless otherwise authorised by the Promoter or its agent(s) and if permitted will incur a change fee of $150 (including GST) plus supplier charges which are the responsibility of the winner.
25. All additional costs not expressly stated, but which may be incurred in acceptance and use of a prize are the responsibility of the winner and their companion (if any). Such additional costs may include, but are not limited to meals and beverages, room service, telephone calls, laundry services, additional spending money, transport to and from airport departure point, other transfers, taxes including arrival and departure taxes (if applicable) but excluding airfare related taxes and charges included in the prizes, insurance, travel insurance, passports and visas (if applicable). The winner may be required to present a credit card at time of accommodation check-in. No compensation or alternative travel plans will be arranged should the winner(s) and/ or their companion miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and their companion. Comprehensive travel insurance is compulsory and included as part of the prize, subject to the considerations listed in Condition 22.
26. A winner and/or their companion(s) (if any) must conduct themselves in a responsible, courteous and friendly manner at all times whilst participating in the prize. Acceptance of a prize and participation in a prize is subject to any prevailing terms and conditions of travel/accommodation/transfers/services suppliers and any other prize suppliers, and in particular, behaviour and safety requirements. A winner and/or their companion (if any) must follow all reasonable directions given by the Promoter and any prize supplier during the course of their participation in the prize, including all directions relation to behaviour and safety. The Promoter and any prize supplier reserve the right, in their absolute discretion, to refuse entry, to disqualify, sanction and/or eject a winner and/or their companion (if any) from the prize related event or venue, or to refuse participation in certain activities, on the grounds of inappropriate behaviour or safety reasons, or for any breach of these Conditions of Entry generally. If a winner and/or their companion (if any) fail to participate in the prize in the manner required, as stated in this condition and in the reasonable opinion of the Promoter, their entry and the balance of the prize will be forfeited with no compensation payable. The winner and guest agree that they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
27. It is the sole responsibility of the winner to ensure their entry and the entry of their companion (if any) into the destination country, at their own expense, including ensuring all necessary passports, visas, travel authorisations, medical advice and recommended vaccinations and immunisations have been obtained prior to travel and, if required, on or by a date nominated by the Promoter. Failure to do so may result in a prize being forfeited. The Promoter makes no representation as to the safety of the destination and it is the responsibility of the winner and their companion (if any) to check the travel advice issued by the Department of Foreign Affairs and Trade at
www.smartraveller.gov.au and assess the safety of the destination country prior to travel.
28. It is a condition of accepting a prize that the winner and their companion (if any) may be required to sign any documentation required by the Promoter in its absolute discretion, within twelve (12) weeks of the prize draw.
29. The Promoter reserves the right to request a winner’s companion to produce appropriate documentation, to the Promoter’s satisfaction, at its sole discretion, in order to confirm the companion’s identity and age before issuing the prize.
30. The total maximum prize pool value awarded in this Promotion is up to AUD$109,432, with a proportion of this being NZD$10,000. New Zealand dollars transferred into Australian dollars for the purpose of this clause are subject to prevailing exchange rates.
31. Prizes are not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). Prizes must be taken as offered and cannot be varied. Prizes cannot be sold, scalped, auctioned, raffled, pledged or promoted as an incentive or reward by any third party as an inducement for any person or other entity to enter into any commercial or other arrangements with that third party. If a prize is obtained through any of these methods, it will not be honoured by the Promoter or prize supplier.
32. The Promoter accepts no responsibility for any tax implications that may arise from prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in prize value. All prize values are the recommended retail price including GST.
GENERAL
33. The Promoter may conduct further draw(s) at the same time (AEDT) and place as the original draw(s) as is necessary on 17/01/2020 in order to distribute any prize(s) unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner(s) in the unclaimed prize draw, the winner(s) will be notified in writing via email within two (2) days of the draw. The name and locality of the winner(s) will be published on the Promotional Website on 28/01/20 and will remain on the Promotional Website for no less than twenty-eight (28) days. All reasonable steps to notify the winner(s) of the results of the unclaimed prize draw (if any) will be taken by the Promoter. The Promoter’s decision is final and no correspondence will be entered into.
34. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid.
35. Prior to issuing the prize, the Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, their status as an eligible Entrant and any other information required by the Promoter. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
36. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the Eligible Purchase process; (b) completing an Eligible Purchase in a manner not in accordance with these Conditions of Entry; or (c) engaging in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. A prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
37. If a prize or element of a prize becomes unavailable for any reason beyond the Promoter’s reasonable control, then a comparable prize or prize element of equal or greater value will be awarded in lieu, subject to any written directions made under applicable Australian State or Territory or New Zealand legislation.
38. If this Promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Promotion and/or, if necessary, to provide an alternative prize or prizes to the same value as an original prize, subject to any written directions made under applicable Australian State or Territory or New Zealand legislation.
39. The Promoter, its associated agencies and companies excludes all liability (including negligence) except for any liability that cannot be excluded by law (including any applicable Consumer Guarantee under the applicable Consumer Law (as defined below at clause 46)), for any direct or indirect injury, loss and/or damage arising in any way out of the Promotion. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to this Promotion and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this Promotion as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorised access or third party interference; (iii) lost or damaged entries, prize claims or prizes; and/or (iv) acceptance and/or use of any prize.
40. All of the Promoter’s decisions in respect of the promotion are final and no correspondence will be entered into.
PRIVACY
41. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988 (The Privacy Amendment (Enhancing Privacy Protection) Act 2012), as well as any other applicable laws.
42. The Promoter collects, uses, discloses and stores the entrant’s personal information for the purpose of conducting the Promotion, without which the Promoter couldn’t conduct the Promotion. The Promoter may disclose the entrant’s information to contractors and agents to assist in conducting this Promotion, which may include disclosure overseas. The Promoter’s Privacy Policy, available at
https://swisse.com.au/privacy, contains more information on how the Promoter manages the entrant’s personal information, including how the entrant can access and correct its information, or make a complaint.
43. Immediately upon submission by an entrant, their entry/entries become the sole property of the Promoter.
44. The Prize winner must, at the Promoter's request, participate in any Promotion activity (such as publicity and photography) relating to the winning and fulfilment of the Prize, free of charge, and they consent to the Promoter using their name and image in any future promotional material.
45. The Promoter will provide to the Entrant, at time of entry into the promotion (or as soon as reasonably practicable thereafter), a collection statement or privacy statement that details the Personal Information being collected, the purpose of its collection, where the Personal Information will be stored and how it will be shared with third parties. The collection statement will comply with the Promoter’s disclosure obligations under the Privacy Act 1988 (Cth) in Australia and the privacy statement will comply with the Promoter’s disclosure obligations under the Privacy Act 1993 in New Zealand.
46. In these Conditions of Entry: “Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth) in Australia and the Consumer Guarantees Act 1993 and Fair Trading Act 1986 No 121 in New Zealand. “Personal Information” means, in Australia, for the purpose of the Privacy Act 1988 (Cth), information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not, and in New Zealand, for the purpose of the Privacy Act 1993, information about an identifiable individual.
