Information on how to enter and prizes forms part of the terms of entry. Entry into the “Million Dollar Travel Competition” (Competition / Promotion) is deemed acceptance of such terms and these terms and conditions (Terms and Conditions). By participating in the Promotion, entrants (an entrant) may win prizes from the Promoter subject at all times to these Terms and Conditions being satisfied.
To the extent of any inconsistency between these Terms and Conditions and any other reference to this Competition, these Terms and Conditions shall prevail.
By entering this Competition, the entrant agrees their personal details as set out in the entry form will be collected by / provided to / used by the Promoter and/or Nationwide News Pty Ltd (ABN 98 008 438 828) (News) and each of them may use such information at all times in accordance with the Privacy Act 1988 (Cth) and in accordance with their respective privacy policies (accessible at https://preferences.news.com.au/privacy and https://www.tripadeal.com.au/privacy-policy, respectively) including in connection with marketing and/or promotional activities.


Who may enter:

Entry is open to all residents of Australia, except residents of Western Australiaand/or officers,
employees or agents of the Promoter and/or News and/or the associated entities or related bodies corporate of either of them and/or any participating outlets and/or any Immediate Family Member of such persons. For the purposes of these Terms and Conditions, “Immediate Family Member” includes any of the following in respect of a person: a spouse, ex-spouse, de-facto spouse, child or step child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
Entrants into this Competition must be 18 years of age or older as at the date of entry.
The Promoter reserves the right to request a winning entrant (winner) to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity or proof of registration or ownership in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be provided.
When to enter

The Competition commences on Saturday 7th September 2019 at 12:00am (AEST) and concludes on Saturday 21st September 2019 at 11:59pm (AEST) (the “Promotional Period”). Entries must be received by the Promoter prior to the Competition close date and time.

The time of entry will in each case be the time the online entry is received by the Promoter’s database, and not at the time of transmission by the entrant.

How to enter:

To enter, individuals must during the Promotional Period purchase (either as a casual purchaser or as a subscriber) at least one (1) Eligible Newspaper (as defined below at clause 10(b)), and must locate the promotional code word found within the Eligible Newspaper. Individuals must, on the same day visit www.milliondollartravel.com.au (Website) and submit the fully completed online entry form and provide all of the requested details, including (but not limited to) their full name, address, state, postcode, telephone number, email address and the promotional code word from that respective day’s Eligible Newspaper.

The cost of accessing the Eligible Newspaper and/or the Website (including to enter the Competition) will be dependent on the entrant’s individual Internet Service Provider. Each individual can enter no more than once each day.

The Promoter reserves the right to disqualify a winner if Promoter becomes aware the winner and/or the winner’s entry is of a type which is not permitted in accordance with these Terms and Conditions, including by operation of clauses 11 or 12.

Any entry is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.

The Promoter reserves the right to disqualify any entrant who:
who tampers with the entry process;
who submits an entry which is not in accordance with these Terms and Conditions; or
who has, in the opinion of Promoter (in its absolute discretion), engaged in conduct in entering the Promotion which is fraudulent, misleading and deceptive, or generally damaging to the goodwill or reputation of the Promoter and/or the Promotion.
This includes, but is not limited, to entrants and households using multiple email addresses, postal addresses, PO Box addresses or SIM cards to register single or multiple purchases or entries.
Number of Entries permitted

Individuals may be able to submit multiple entries throughout the Promotional Period subject to the following conditions:
no more than one (1) entry per person is permitted per day;
individuals can only enter on a day when they have purchased (as a casual purchase or as a subscriber) an Eligible Newspaper; and
each entry must be submitted separately and in accordance with the entry requirements; and
except in relation to residents of South Australia, an entrant can win no more than one prize.
Entrants, other than subscribers at the time of entry, must retain their original Eligible Newspaper(s) printed code word(s) for all entries as proof of purchase. Failure to produce the required code word(s) for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of all of an entrant’s entries and forfeiture of any right to a prize. Print or digital subscribers who are active subscribers at the time of the entry are not required to purchase nor retain an original Eligible Newspaper(s) printed code word(s).
Draw and Notification of winner

The major prize winner will be the first valid entry drawn from entries submitted in accordance with these Terms and Conditions at any time during the Promotional Period. The minor prizes will be drawn after the major prize. There will be a minor prize drawn for each day of the Promotional Period in relation to each Eligible Newspaper title which was published on that respective day. Each minor prize will be won by the first valid entry drawn from those entries submitted on a given day for a particular Eligible Newspaper. Any winner of a draw (other than for South Australian residents) will be excluded from eligibility for subsequent draws. The draws will be conducted by Engage Australia by random computer selection at 9:00 am (AEST) on Thursday, 26th September 2019 at Engage Australia, Level 8, 56 Clarence St, Sydney NSW 2000.
If any particular draw is scheduled on a public holiday, the draw will be conducted on the following business day.
The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the Competition result or any other decisions the Promoter makes in connection with the Promotion.
The winner/s will be notified by telephone within two days of the draw. Winner/s of prizes will be published in The Australian newspaper on Monday 7th October 2019.
Prizes will be awarded to person named in the entry. However, in the event of a dispute, Prizes will be awarded to the account holder of the entry mechanism used to submit the relevant entry (for example, the relevant mobile phone account holder or land line account holder).
Should an entrant’s contact details change during the Promotional Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
Subject to applicable laws, including any State Regulation, an unclaimed prize draw will take place at Engage Australia, Level 8, 56 Clarence St, Sydney NSW 2000 on Monday 13th January 2020 at 9:00am (AEDT). The winner/s of the unclaimed prize draw will be notified by telephone or email within two days of that draw. Winner/s of prizes valued over $250 will be published in The Australian newspaper within 14 days of the draw.
Prize on offer

Individual prize value is up to $1,000,000 (including GST). The total prize pool value is up to $1,147,000 (including GST) as at 12th July 2019. There will be 295 winners in total, comprising of one (1) major winner and 294 minor prize winners.

One (1) major prize winner will win One (1) x TripADeal travel voucher package valued at $1,000,000, subject to the conditions set out in these Terms and Conditions.

294 minor prize winners will each win one (1) x $500 TripADeal travel voucher package subject to these Terms and Conditions.
Conditions which apply to the major prize $1,000,000 voucher package are:
The prize amount may only be used during the validity period commencing on 1st October 2019 and ending on 30th September 2024.
The $1,000,000 prize voucher package will be distributed to the winner using TripADeal travel vouchers. Twenty (20) x $10,000 TripADeal vouchers will be given to the winner on the 1st October of each year of the 5 year validity period. The winner is permitted to use these themselves, including by making bookings on behalf of family and friends, at their discretion.
Each $10,000 voucher will have a 12 month validity period whereby the winner (or their nominee designated for use of the voucher) must use the $10,000 amount by the winner booking a package from www.tripadeal.com.au within 12 months of the date of issue of the voucher. Any unused value of the $10,000 voucher will be void if not used within such 12 month period.
The winner may book to travel on and from 1st October 2019, subject to availability.
All bookings are subject to availability and subject to carrier and third party supplier terms and conditions as well as TripADeal terms and conditions, including as published on its website from time to time and as may be varied from time to time (including as may be accessible at www.tripadeal.com.au/terms)
Prize vouchers expire on 30th September of each respective year, up to and included 30th September 2024. In the event a winner does not use all or any of the prize vouchers by 30th September of each respective year, then the unused value of the vouchers at that date will not be refunded or credited to, and will be forfeited by, the winner, and cash will not be awarded in lieu of the unused prize (or portion thereof).
Vouchers can only be used to purchase travel from the Promoter’s website: www.tripadeal.com.au.
The winner using the voucher(s) is permitted to book for his or her self or for such other persons as may be nominated by them, provided such booking is not for a commercial gain to the person making such booking and provided the travel is for person making the booking, any Immediate Family Member of them and/or friends of any of them.
A voucher is deemed used as soon as a travel booking through the Promoter’s website is made. Please see the Promoter’s website for terms and conditions of bookings.
Payment for winner’s chosen travel booking is required in full, together with the redemption of the voucher.
Vouchers cannot be used in connection with payment to any third party retailers or providers or TripADeal wholesalers.
Prizes/Vouchers are non-refundable, non-redeemable for cash and cannot be used in conjunction with any other promotion, gift certificate, voucher and/or deal other than those published on the Promoter’s website from time to time.
As a term of entry, each winner consents to their name and image(s) and image(s) of partaking in the prize being used, copied and modified by the Promoter for the purpose of promoting and advertising its goods and services, worldwide and by any media, for the term of the validity of the voucher and a further period of 12 months.
Vouchers cannot be used to buy any associated travel services including concierge flight tickets, travel visas, travel insurance, travel upgrades and/or vouchers, whether or not associated with a current or previous travel deal.
Conditions which apply to each of the minor prize vouchers are:
Each voucher is valid for a period of 12 months from the date of issue.

Payment for winner’s chosen travel offer is required in full, together with the redemption of the voucher.
Vouchers cannot be used with any third party retailers or TripADeal wholesalers.
Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.
Prizes cannot be transferred, exchanged or redeemed for cash except that vouchers can be used to book travel for other persons in accordance with clause 23 or 24 (as the case requires).
It is a condition of a winner accepting a prize that such person must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
It is a condition of a winner accepting a prize that such person may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
All entrants agree that if they win the prize, they will not, and their nominees/travel companions will not, sell or otherwise (other than for non-commercial purposes) provide their story and/or photographs to any media, body corporate or organisation other than the Promoter and/or News, including via the internet. Photographs will be allowed only at the discretion of the Promoter, acting reasonably.
Vouchers are subject to the terms and conditions imposed by TripADeal. Once awarded, the Promoter is not liable for any voucher that has been lost, stolen, forged, damaged or tampered with in any way.
Without prejudice to any other provision of these Terms and Conditions, the Promoter shall not be liable to any person, and is not responsible, for any event beyond its reasonable control including:
without limitation, any act of God, actual or threatened war or other threat or challenge to governmental authority, confiscation, nationalisation, requisition or destruction or fo damage to property by or under the order of any Government or public or local authority, strike, lockout, industrial action, fire, flood, drought, tempest, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service; or
the failure of, or damage or destruction to, or any errors caused by the computer systems or records of any third party (including, without limitation, the Website) or any aspect of the foregoing; or
any other action or event that prevents or hinders the acceptance of an entry.
The winner must make his or her own enquiries about local issues and conditions, including at destinations prior to travel.
Each winner (and each person for whom a winner may book travel) is/are responsible for all expenses other than those included in the booked travel including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (excluding departure and any other flight associated taxes included within the prize), energy surcharges, gratuities, service charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. The winner is responsible for ensuring that the travellers they have booked to travel are fit to travel and have received appropriate immunisations and/or health checks prior to departure.
The availability of any particular travel offers from TripADeal is subject to hotel and flight availability. The ability to change any booked travel is subject availability and TripADeal terms and conditions of travel as may be varied from time to time (currently accessible at https://www.tripadeal.com.au/terms).
The winner and the persons for whom they book travel are responsible for complying with any health and any other government requirements that may apply in connection with the prize. All prize travel will be subject to the relevant carrier’s General Conditions of Carriage and any other third party terms and conditions of supply. Without limiting the foregoing, it is each traveller’s personal responsibility to ensure that they have valid travel documentation, including valid passports and visas, which meet the requirements of government authorities at the relevant destinations. Any fines, penalties, payments, costs or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. To the maximum extent permitted by law, the Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Entrants should obtain travel advice from independent sources, such as the web site of the Australian Department of Foreign Affairs and Trade.
Further Terms and Conditions

Subject to complying with all applicable laws (including applicable State and Territory legislation), the Promoter reserves the right to amend, cancel or suspend this Competition if an event beyond the control of the Promoter corrupts or affects the administration security, fairness, integrity or proper conduct of the Competition. The Promoter may disqualify any individual who has tampered with the entry process or any other aspect of this Competition.
Without limiting clause 31, and to the maximum extent permitted by law, the Promoter and each of its related bodies corporate and associated entities shall not be liable or responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and the Promoter reserves the right to take any action that may be available.
If for any reason this Competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion to take any action that may be available, and (without limitation) to not award any or all of the prizes and/or to cancel, terminate, modify or suspend the Promotion/Competition, subject to any direction given under State Regulation. Such decision is in the Promoter’s absolute discretion.
Entrants are responsible for any cost associated with accessing the Website. Access to the Website is dependent upon network availability and access to the internet, including via the entrant’s internet service provider.
Any entrant found to be using any form of software or third party application to enter multiple times (including scripting software) will have all entries invalidated and any claim to any prize will be invalidated. If such an entrant is awarded a prize and then found to have breached this clause 40, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause 40 has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause 40. An entrant must provide any requested documentation to the Promoter upon request.
Without limiting any other provision of these Terms and Conditions (including clauses 10, 11, 12, 36, 37, 38 or 40), the Promoter (in its absolute discretion) reserves the right, at any time, to verify the validity of an entry or to disqualify any entrant:
who submits an entry that is not eligible under these Terms and Conditions;
who tampers with the entry process; and/or
whose entry is tampered or interfered with by any third party.
The decision to verify, validate or disqualify an entry is in the Promoter's absolute discretion.
Without limiting clause 31, the Promoter is not responsible for any problems or technical malfunction of any computer system, software or internet difficulties or other errors to the extent that such problem or malfunction is beyond the reasonable control of the Promoter, including:
any damage to an entrant’s software, hardware or device used to participate in the Promotion;
any damage or technical difficulties with any software, hardware, system or device that is used by the entrant or the Promoter and/or News in connection with the Promotion;
any theft, destruction, unauthorised access, third-party interference, virus, infection, virus, bugs, fraud, technical failures, power failures or hack that compromises the integrity of any software, hardware, system or device that is used in connection with the Promotion; or
any unforeseen cause beyond the reasonable control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion;
Any prizes that are won when any of clauses 43(b), (c) or (d) are applicable are null and void.
An entrant may not use a third party (including online Competition entry site) to enter on their behalf, except where the entrant needs to use those services of that third party to enter due to a disability. If the preceding sentence has been breached, the entrant will have all entries invalidated, any claim to any prize will be invalidated and where such an entrant has already been awarded a prize before being found to have breached this clause, the entrant must immediately return any awarded prize to the Promoter. The Promoter has sole discretion to determine if this clause has been breached by any entrant. The Promoter reserves the right to request whatever documentation it deems necessary to confirm if the entrant has breached this clause. An entrant must provide any requested documentation to the Promoter upon request.
If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to applicable laws (including State and Territory legislation). It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
The Promoter will make reasonable efforts to deliver prizes to the addresses provided by Competition entrants. If a prize is returned to the Promoter because it could not be delivered to the address provided, the Promoter cannot guarantee that it will be able to resend the prize to the prize winner. The Promoter and its associated entities and related bodies corporate will not be liable for any damage to or delay in transit of prizes.
The Promoter reserves the right to redraw the prize if an entrant who claims to be a prize winner is unable to satisfy these Terms and Conditions.
Intellectual property, Statutory guarantees, Waiver and liability

In consideration of the Promoter making the Promotion available and/or awarding the prize to the winner, the winner hereby permits the winner’s submission, image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with the Promoter and/or News Corp Australia publications or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use. The winner expressly waives any moral rights in connection with same.
Entrants must not publish, adapt, distribute to third parties, amend or make any copy of any part of any material which contains Intellectual Property belonging to the Promoter without the Promoter’s prior written consent.
By conducting and entering this Promotion, entrants warrant that they will not do anything that interferes with or breaches the Intellectual Property rights of the Promoter or any third party.
In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these Terms and Conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to any directions given under State Regulation. Without limiting this, The Promoter will not be liable for any failure or delay in the performance of its obligations under these Terms and Conditions to the extent that such failure or delay has been caused by an event beyond its reasonable control, subject to any directions given under State Regulation.
The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (“Australian Consumer Law”) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this Competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. If a winner has been found to have committed a material breach of these Terms and Conditions, the Promoter reserves the right to refuse to honour any prize and the winner must immediately return such prize to the Promoter.
Privacy

All personal information provided in entries is collected by The Promoter and will be shared with News. All entries will be entered into a database by each of those parties and each of them may use the entrant’s names, addresses, email addresses and telephone numbers to contact entrants with marketing offers and those parties may also use the names and images of each winner for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By entering-in this Competition, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used to be sent marketing materials, the entrant should contact The Promoter on their details set out below. News collects and uses that information to provide its goods and services, to promote and improve its goods and services, to provide targeted advertising and content based on a person’s online activities, to send marketing offers, for the purposes described in its Privacy Policy and for any other purposes described at the time of collection. News may disclose collected information to its related companies, including those located outside Australia. Any of them may contact an entrant for those purposes (including by email and SMS) at any time. News may also disclose that information to its service providers, including those located outside Australia. If you do not provide all information, you may not be able to participate in the Promotion and/or the Promoter may not be able to provide access to some or all of its products and/or services. By entering the Promotions, each winner consents to the publishing of his or her name and the suburb of residence on the website and via the social media channels of the Promoter and/or News (including via the Website).
Prize winners may be asked by the Promoter to participate in publicity and other promotional activities associated with the Promotion but will have the right to elect whether or not they want to participate in such publicity or promotional activities.
General

The Promoter may assign its rights under the Terms and Conditions to a third party and the Promoter will give you written notice no later than 30 days after any such assignment occurs. If you consider that the assignment is detrimental to you, you may cease participating in the Promotion without being liable to pay any amount to the Promoter.
Except with the prior written consent of the Promoter (in its absolute discretion) or as otherwise expressly permitted by these Terms and Conditions, an entrant must not assign, transfer, charge, encumber or otherwise deal with any of entrant’s rights or obligations under these Terms and Conditions (including in respect of any prize), or attempt or purport to do so.
To the maximum extent permitted by law, the Promoter may vary any term of these Terms and Conditions as may be required in connection with any change of law.
Any non-enforcement by the Promoter of any of its rights under the Terms and Conditions will not constitute a waiver of those rights. Any waiver by the Promoter of any of the Promoter’s rights under the Terms and Conditions will not constitute a waiver on any subsequent occasion.
There are sections in the Terms and Conditions which cross reference or link to information on the websites. Unless the context otherwise requires, that cross reference or link is not intended to make the cross referenced or linked information a part of the Terms and Conditions.
Where any law requires or permits the Promoter to give information to an entrant, such persons consent to that information being given by an electronic communication.
Where an entrant is required or permitted to give the Promoter a notice under the Terms and Conditions, an entrant may do so by giving the Promoter the notice by:
mail addressed to Notices, TripADeal, 15 Wollongbar Street, Byron Bay NSW 2481;
email to support@tripadeal.com.au;
through the Promoter’s website (where available).
The laws of New South Wales govern these Terms and Conditions and you submit to the jurisdiction of the Courts of New South Wales.
If part or all of any clause of these Terms and Conditions is illegal, invalid or unenforceable:
it will be read down to the extent necessary to ensure that it is not illegal, invalid or unenforceable, but if that is not possible;
it will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
Nothing in these Terms and Conditions affects your rights under the Australian Consumer Law. The Promoter’s services come with guarantees that cannot be excluded under the Australian Consumer Law.
In these Terms and Conditions
headings are for convenience only and do not affect interpretation;
“person” includes an individual, a word importing the singular includes the plural (and vice versa), and a word indicating a gender includes every other gender;
if a word or phrase is given a defined meaning, any other part of speech or grammatical form of that word or phrase has a corresponding meaning;
“includes” in any form is not a word of limitation;
a reference to “$” or “dollar” is to Australian currency;
a reference to any legislation includes any subordinate legislation made under it and any legislation amending, consolidating or replacing it;
a reference to “consent” means prior written consent;
any reference to “notice” means written notice;
“associated entity” and “related body corporate” has the meaning given in the Corporations Act 2001 (Cth);
a reference to the “Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth);
a reference to a “day” is a reference to a calendar day
a reference to the “Promoter” includes its successors and assigns.
