On entering this competition, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed acceptance of these conditions of entry.
1.2 This is a game of skill and chance plays no outcome in determining the winners.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open only to permanent residents in Australia over 18 years of age.
2.2 Employees and families of the Promoter or the prize suppliers or any of their agencies associated with the Competition or Program are not eligible to enter. This includes a spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption)
3. HOW TO ENTER
3.1 No purchase is necessary.
3.2 Only one (1) entry permitted per person.

3.4 Incomplete or indecipherable entries will be deemed invalid.
3.5 Failure to comply with the above conditions will deem the player’s entry invalid and ineligible to win. No correspondence will be entered into.
3.6 The 25 words or less component of the competition will be judged on merit and creativeness. The judges decision is final and no correspondence will be entered into. The judging will take place at the offices of Brand Collective Pty Ltd (ABN: 34 098 742 628), 332 Lorimer Street, Port Melbourne, VIC 3207. Ph: (03) 9681 9681 on the Tuesday the 11th of February 2020.
4. DATES OF PROMOTION
4.1 The competition starts at 7am on the 21st of January 2020 (AEDST) and ends at 11.59pm 9th of February 2020.(AEDST).
4.2 The winner will be contacted in writing and phone call by the 12th of February 2020 and announced on

THE PRIZE DETAIL AND CONDITIONS OF WINNING
5. THE PRIZE
5.1 The judged entry deemed the winner will receive the following prize:
Two (2) return economy airfares from their major capital city airport.
Transport for two (2) people from Cairns Airport to Paradise Links Resort and return transfer for two (2) people from Paradise Links Resort to Cairns Airport at the end of the designated stay.
Accommodation for two (2) people for five (5) nights at the Paradise Links Resort with check-in on the 11th of May 2020 and check-out on the 16th of May 2020. The prize consists of a one (1) bedroom apartment with a patio or balcony. The apartment includes air-conditioning, a kitchenette and laundry facilities. The prize is for the room only and does not include any meals.
Selected transport pass on the Port Douglas Shuttlebus around Port Douglas central area for the duration of your stay.
A Sailaway Low Isles Package tour with Courtesy Coach transfers to and from your accommodation. The Package Tour runs from 1pm-6pm on a day decided by the Promoter and includes: tea and coffee, club sandwiches and muffins on boarding, snorkelling equipment, optical masks, flotation aids, snorkelling instruction and in-water assistance, a snorkel tour with marine guide and heritage walk, a glass-bottom boat viewing and reef interpretation, afternoon tea or freshly brewed coffee, scones, jam,cream and fresh fruit platter, one (1) complimentary beverage per person, delicious canapes and sunset sailing over the Coral Sea.
A 4-Park Package courtesy of CaPTA Group with a double-pass entry to the, Wildlife Habitat Port Douglas, Cairns ZOOM and Wildlife Dome, Rainforestation Nature Park and Austalian Butterfly Sanctuary. (This element of the prize does not include transport to any attraction in Cairns.)

The total prize package is valued up to $6000.
5.2 Unless expressly stated in these Terms and Conditions, all other expenses are the responsibility of the winner (and their travel companion) including but not limited to meals, beverages, travel expenses, spending money, extension of travel time, drinks, incidentals, mini-bar, laundry, room service, in-room charges,telephone calls, gratuities, service charges, optional activities and all other ancillary costs.
5.3 The Prize and no element or component of the prize is transferable and cannot be redeemed for cash.
6. CONDITIONS OF ACCEPTING THE PRIZE
6.1 Every entrant must be available to travel and redeem the prize between Monday the 11th of May 2020 and Saturday the 16th of May 2020.
6.2 It is a condition of accepting the prize that a winner and their travel companion may be required to sign a legal release as determined by the Promoter in its absolute discretion, prior to receiving a prize. If the winner’s travel companion is under the age of 18, a nominated parent or legal guardian of the travel companion will be required to sign the legal release on the winner or travel companion's behalf.
6.3 Proof of identity is required.
6.4 The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or wilful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowed by law).
6.5 The Major Prize-winner and his/her travel companion must depart from and return to the same departure point and travel together during the redemption of the Prize.
6.6 Frequent flyer points will not form part of the Major Prize. The Major Prize is subject to the standard terms and conditions of individual prize and service providers. The Major Prize winner and/or his/her travel companion may be required to present their credit card at time of accommodation check in.
6.7 The Major Prize-winner may need to arrange connecting domestic flights or travel at their own cost (between any airport that is not a major capital city in Australia).
6.8 The Promoter and third-party suppliers, acting reasonably, hereby expressly reserve the right to eject any winner (and/or his/her companion/s) for any inappropriate behaviour, whilst participating in any element of the Prize.
6.9 Travel insurance is the responsibility of the Prize winner and is highly recommended.
6.10 Travel dates are subject to availability at time of booking. The Promoter will secure airline and hotel reservations for the winner as close as possible to those nominated preferred travel dates, subject always to flight and seat availability. Flight upgrades and changes are an additional expense to the competition winners. In the event that agreement cannot be reached between the Promoter and the winner regarding the exact dates of travel, the Promoter reserves the right to determine the itinerary in its absolute discretion.
6.11 If for any reason the winner does not take the prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.
6.12 Winners of the prize should seek independent financial advice about any tax implications that may arise from the prize winnings.
6.13 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.
6.14 Entrants' personal information will be collected by the Promoter. Personal information will be stored on the Promoter's database. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically. The Promoter is bound by the Australian Privacy Principles in accordance with the Privacy Act 1988 (Cth) and its privacy policy which is located at

The Promoter's privacy policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of the Australian Privacy Principles or any other Australian privacy laws and how such complaints will be dealt with. The Promoter collects personal information about entrants to enable them to participate in this Promotion and may disclose the entrants' personal information to third parties including its contractors and including its contractors and agents, prize suppliers and service providers to assist in conducting this Promotion and to the State and Territory lottery departments as required under the relevant lottery legislation. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion. Personal information collected from entrants will not be disclosed to any entity located outside of Australia.
6.15 In participating in the competition, the winners agree to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed, filmed for broadcast and photographed. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winner (and his/her companion) will not be entitled to any fee for such use.
6.16 The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages to the entrant. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter.
6.17 If a prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. As a condition of accepting the prize, the winner must sign legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity.
6.18 The Promoter’s decision is final and no correspondence will be entered into.
7. NO LIABILITY
7.1 This competition is in no way sponsored, endorsed or administered by, or associated with Instagram or Facebook. Eligible persons understand that they are providing their information to the Promoter and not to Instagram. The information an Eligible Person provides will only be used for the purposes outlined in these Conditions. Any questions, comments or complaints about this Competition must be directed to the Promoter and not to Instagram or Facebook.
7.2 CAUTION: ANY ATTEMPT TO CAUSE DAMAGE TO ANY WEBSITE OR THE INFORMATION ON ANY WEBSITE ASSOCIATED WITH THIS COMPETITION OR TO OTHERWISE UNDERMINE THE FAIR AND LEGITIMATE OPERATION OF THIS COMPETITION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW IN THE EVENT THAT ANY SUCH ATTEMPT IS MADE, WHETHER OR NOT THAT ATTEMPT RESULTS IN ANY SUCH DAMAGE, INTERFERENCE OR UNDERMINING.
7.3 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to government legislation
7.4 The Promoter is not responsible for lost, interrupted communications or unavailable server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic.
7.5 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
7.6 The Promoter reserves the right to verify the validity of entries and to disqualify any entry of any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause.
7.7 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantee, the Promoter (including its respective officers, employees and agents) and Prize Promoter are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity) ; whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by the winner or entrant; or (f) use of the prize.
7.8 Nothing in these Terms and Conditions limits, excludes or modifies or purports tlimit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (‘Non-Excludable Guarantees’). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
