1. This competition (hereinafter the “Competition”) is run by Spotify Australia Pty Ltd, with its main place of business at Level 17, One Wharf Lane, 171 Sussex Street, Sydney, NSW 2000 ("Spotify").
2. By entering this Competition, you agree to these terms and conditions which will be binding between you and Spotify. Your participation in the Competition is in consideration for Spotify allowing you to enter it and giving you the opportunity to win.
3. No purchase is necessary in order to enter the Competition. There is no fee charged to enter into this Competition other than the cost of you accessing the Internet which you would otherwise have.
4. You must be over the age of 18 and a resident of Australia. Employees of Spotify, immediate families, any business partner associated with the running of this Competition or any of their group companies are not eligible to enter or participate.
5. The Competition commences on Monday, 24 February 2020 at 8AM AEDT and concludes on Sunday, 9 March 2020 at 5PM AEDT (“Competition Period”). Entrants may submit one entry to the Competition during the Competition Period. Any entries submitted outside of the Competition Period will be deemed invalid and ineligible to enter the Competition.
6. In order to enter the Competition, entrants must:
(a) Go to the competition page during the Competition Period and provide their name, email address, date of birth, and postcode;
(b) Follow the Bluesfest 2020 Playlist; and
(c) in 25 words or less, answer the following question: “What is your favourite song to play on a road trip?”
Each entrant warrants to Spotify that each comment and any other contents submitted in their entry is an original creative work of the entrant that does not infringe the rights of any third party. Entries that contain prohibited or inappropriate content, or are otherwise in breach of these Terms and Conditions will not be eligible to win.
7. There will be a total of 1 (one) winner (“Winner”) who will receive the following prize:

8. Any images used to promote the Prizes are for information only. The Winner must also comply with Spotify’s instructions about the Prize, such as how to conduct themselves while participating in the Prize. There is no cash alternative instead of the Prize. All additional expenses including but not limited to meals, gratuities, excess baggage, travel to and from the festival, travel insurance, personal and transport expenses, transfers, all taxes and any incidental expenses in conjunction with the hotel stay are not included in the Prize and are the sole responsibility of the Winner and their guests.
9. The Winner of the prize will be selected by a panel of representatives from Spotify (“Panel”). At the end of the Competition Period, the Panel will select a Winner from the pool of finalists. To make the pool of finalists, an entrant must receive the highest number of points from the Competition. The following points will be allocated to each entrant for each entry into the Competition:
a) Creativity of entrant’s answer to the relevant question set out in clause 6(c) - scored out of 10
b) Follow nominated Spotify playlist - 1 point allocated
If there are multiple entrants with the same number of points in the pool of finalists for any given week, the Winner will be determined based on the creativity of their answer to the question in clause 6(c). The panel’s decision is final and binding and no correspondence will be entered into. The Winners will be contacted via email and their details may also be posted online. Every reasonable effort will be made to contact the Winner(s). If a Winner cannot be contacted within twenty-four (24) hrs of the date from which they were notified, the Prize will revert to Spotify and may be awarded to the next eligible entrant who satisfies the Competition requirements.
10. By participating in the Competition, each entrant consents to Spotify collecting and processing the personal information they submit to Spotify, for the purpose of administering the Competition and in accordance with Spotify’s privacy policy located at
https://www.spotify.com/au/legal/privacy-policy/. Spotify will only share an entrant’s personal information as is necessary and for the sole purpose of administering the Competition.
11. Except as otherwise required by applicable law, neither Spotify nor Byron Bay Bluesfest is responsible for any loss or damage associated with an entrant entering into this Competition, the conduct of the Competition or the provision or otherwise of any aspect of any prize or any act or omission of any other person or party, and all warranties, conditions and representations (of any kind) not expressly set out in these terms and conditions are hereby excluded.
12. Subject to any applicable laws, Spotify may terminate these terms and conditions, the Competition or any prize if an entrant does not comply with any of these terms and conditions or are unlikely to do so, if Spotify decides in its absolute discretion to withdraw the Competition before any winners are notified, or thereafter if any circumstances beyond Spotify’s reasonable control prevent or restrict Spotify or any other person or party from providing the prize or any aspect of the prize.
13. An entrant may not assign or transfer their rights or obligations, or subcontract their obligations, under these terms and conditions, such as giving a prize to anyone else, without Spotify’s prior written consent. Spotify may assign or transfer its rights or obligations, or subcontract its obligations, under these terms and conditions without an entrant’s consent.
14. If any provision of these terms and conditions is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavour to give effect to the parties' intentions as reflected in the provision and the other provisions of the terms and conditions will remain in full force and effect.
15. These terms and conditions and all matters arising from or in connection with them are governed by the laws of New South Wales, and the New South Wales courts will have exclusive jurisdiction in the event of any such dispute.
16. This competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram, and, by entering, entrants agree and understand that Facebook and Instagram, cannot be held responsible or liable in any way for or in connection with this promotion. Entrants understand that they are providing their information to the promoter and not to Facebook or Instagram.
