OTR DARE Flavoured Milk Trade Promotion 2020: ‘WIN THE ULTIMATE RACING EXPERIENCE’
Summary of Competition: To enter, participants must purchase any two (2) participating DARE Flavoured Milk 500mL Products (see Appendix 1) in one transaction and have their OTR Rewards barcode in the OTR App scanned between 23/09/2020-20/10/2020. Entry will be automatic once an eligible purchase has been made via the OTR App in accordance with the above. Multiple entries are permitted. There are 111 prizes to be won: 1 x Full-day Driver Experience at The Bend Motorsport Park for 2 (incl. experience 8 amazing vehicles, from a V8 race car and Ford Mustang, the seat-of-the-pants Clubmans and Sodi Karts, 4WD action and rally driving, to an Australian Superbike ride and an open-wheel Formula Toyota experience, fully catered breakfast, lunch and afternoon tea, USB with on-board footage (RRP $4,965/incl. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions.
Competition Period
The competition starts at 12.01am (ACST) on Wednesday 23rd September 2020 and ends at 11.59pm (ACST) on Tuesday 20th October 2020 (the Competition Period).
Eligible Entrants
Entry is open to South Australian residents, aged 18 years and over.
Directors, officers, management and employees of:
(a) the Promoter; or
(b) any companies or Commonwealth, State, Territory or local government agencies where the rules or guidelines applicable to such company or agency prohibit receipt of a prize; or
(c) the agencies or companies associated with this competition,
and their immediate family members, cannot enter.
Any person who meets the above criteria is an ‘Eligible Entrant’. Entrance into the Competition is deemed acceptance of these Terms and Conditions.
Locations
The competition will run in the Promoter’s locations within South Australia listed in Appendix 2 to these Terms and Conditions (Stores).
How to Enter
During the Competition Period, Eligible Entrants need to:
(a) download and set up an account with the OTR mobile phone application (OTR App) if they have not already done so; and
(b) purchase any two (2) participating DARE Flavoured Milk 500mL Products listed in Appendix 1 to these Terms and Conditions in one transaction by using the OTR App or in person at any Store and have their Rewards barcode in the OTR App validly scanned at the time of purchase (Qualifying Purchase).
Eligible Entrants will automatically receive one (1) entry for each Qualifying Purchase processed through the OTR App during the Competition Period (Eligible Entry).
The Eligible Entrant is deemed to be the individual whose email address is logged into the OTR App in which the Qualifying Purchase was made.
In order for the Promoter to receive an Eligible Entry, the Promoter must process the sales data in respect of the OTR App. There may be a delay between the time of a Qualifying Purchase and the time the Promoter receives the Eligible Entry. Eligible Entries must be received by the Promoter by 11:59pm ACST Tuesday 20th October 2020.
Maximum Entries
Multiple entries are permitted per person during the Competition Period. Eligible Entrants will receive one (1) Eligible Entry for each transaction/receipt (regardless of the number of Participating Shop Product purchased in the same transaction).
Prize Draw
111 Eligible Entries will be drawn at 10am (ACST) on Friday, 23rd October 2020 (Draw) at Engage Australia’s office located at Level 8, 56 Clarence St, Sydney NSW 2000 (Draw Location).
The first 111 Eligible Entries drawn randomly in the Draw from the entries received during the Competition Period will each be a Winner and will be awarded a Prize from the Prize pool, with the first Winner winning the Major Prize, the next 50 Winners winning Runner-Up Prize, and the last 60 Winners winning the Consolation Prize.
The Promoter will draw 30 additional reserve entries and record them in order, for use in the event that a Winner is deemed invalid, or a Prize is unclaimed (Reserve Winners).
Prize / What Can I Win?
There are 111 prizes available (each a Prize). Each Winner will receive one (1) Prize. The Prize pool is made up of the following:
Major Prize:
The Major Prize is one (1) Full-day Driver Experience at The Bend Motorsport Park for the Major Prize Winner and one (1) companion valued at up to $4,965 (including GST).
The full-day program allows the Major Prize Winner to experience 8 amazing vehicles across The Bend’s multi-discipline facility – from a V8 race car and Ford Mustang, the seat-of-the-pants Clubmans and Sodi Karts, 4WD action and rally driving, to an Australian Superbike ride and an open-wheel Formula Toyota experience. The Major Prize includes:
Professional and specialist instructors will guide the Major Prize Winner and one (1) companion through each vehicle and experience;
Fully catered day with breakfast, a sumptuous lunch, and afternoon tea from the Rydges Pit Lane Hotel located in the pit building;
USB with on-board footage of the Major Prize Winner’s V8 Race car experience to show their friends and re-live the experience again and again; and
Race suit and helmet provided to keep the Major Prize Winner safe and provide the perfect Instagram picture.
The Major Prize must be redeemed by 31 December 2021.
Runner-Up Prizes:
50 x V8 Mustang* Drive Experience – for two (2) People
*Australia’s only Ford factory backed V8 Mustang track experience! Valued at $201.46 each for two (2) (RRP, incl. GST), Runner-Up Prizes valued at total $10,073.
Runner-Up Prizes must be redeemed by 31 December 2021.
Consolation Prizes:
60 x (3 x 10-Minutes) karting sessions for two (2) people, valued at $160 each for two (2) (RRP, incl. GST); Consolation Prizes valued at total $9,600.
Consolation Prizes must be redeemed by 31 December 2021.
The total recommended retail value of the Prizes is $24,638 (incl GST) as provided by the supplier of the Prizes and is correct at the commencement of the Competition Period.
Any alterations to confirmed Prize details will be at the expense of the Winner and will only be permitted with the Promoter’s prior consent which may be given in the Promoter’s absolute discretion.
The Prizes are not exchangeable, not redeemable for cash and not transferrable except as set out in these Terms and Conditions or agreed by the Promoter. Some components of a Prize may be transferrable to the Prize Winner’s companion if a Prize Winner does not meet the weight and height restrictions outlined in the Third Party Terms and in these Terms and Conditions under Prize Conditions.
You agree that the Promoter may provide, in substitution for the Prize, an alternative prize of equal or greater value if, for any reason whatsoever, the Promoter is unable to provide the Prize.
Prize Conditions
For the avoidance of doubt, if any Winner does not reside in South Australia, the Prize will not be awarded. If Prize Winners select participant/s under the age of 18 to accompany them for the Prize, the Prize Winners (or another Prize participant aged 18 years or older) must agree to act as the guardian of such participants for the duration of the Prize event.
All aspects of the Prizes are for two (2) people travelling together at all times. All components of the Prizes must be taken together as a single trip to be booked by the Promoter or the Promoter’s representatives, unless otherwise communicated. The itinerary for the Prizes is to be determined by the Promoter in its absolute discretion, including the date and time each element of a Prize must be taken.
The Prizes do not (except as expressly stated) include: any transport between a traveller’s residence and the departure airport (if applicable); any overnight accommodation while travelling to the departure airport or destination (if applicable); any other travel or accommodation expenses; meals, ground transportation and incidentals; any accommodation and incidental accommodation charges (such as mini-bar charges, telephone calls, in house movies, food and beverages on top of any meal package); any insurance (such as travel or health cover); or any other ancillary costs which may be incurred by the Winners (unless otherwise stated in these Terms and Conditions).
Participation in the Prizes is subject to such other terms and conditions as may be imposed by those involved in providing goods or services included in the Prizes (Third Party Terms).
All Prize participants are responsible for compliance with all applicable Government Health & Safety regulations, Third Party Terms and will bear all risks associated with failure to comply with any of them. Winners must be under 110kg and under 188cm to be able to participate in some components of the Prizes. They will be required to maintain an acceptable standard of behaviour whilst a participant in the Prizes. The Promoter assumes no liability (and will provide no compensation or reimbursement) to the Prize Winners and/or nominated companion(s) who, as a result of any failure to comply with any Third Party Terms or these Terms and Conditions: (a) is unable to participate in the Prize (or any part of it); or (b) suffers any other loss or damage.
The Prizes cannot be (in whole or in part) sold, re-sold, scalped, auctioned, raffled, pledged, offered for re-sale at a premium (including via online auction sites) or used for advertising, charity fundraising, promotion or other commercial purpose including but not limited to competitions and trade promotions or to enhance demand for other goods or services. If any Prize, or any part of any Prize, is sold or used in breach of this condition, the Prizes, or part of the Prizes, may be cancelled by the Promoter.
In the event that, for any reason, any Prize Winners or their nominated companions do not take all or an element of the Prize at the time stipulated by the Promoter then the Prize or that element of the Prize will be forfeited by the Prize Winner and/or nominated companions and no alternative prize or prize component will be offered.
Notification and Claiming the Prize
The Winners will be informed via email to the email address provided when registering to the OTR App by 23:59 (ACST) on. Friday 30th October 2020.
The name of the Winners will be:
published on the Promoter’s website (
www.otr.com.au/dareracingexperience) for a period of 7 days after the Draw.
If the Major Prize Winner or any of the Runner-Up Prize Winners or Consolation Prize Winners do not claim the Prize or the Prize is returned to the Promoter for any reason by 11.00am AEST on, November 6th 2020, a substitute winner will be determined from the Reserve Entries.
The first Eligible Reserve Winner with a valid Eligible Entry drawn in the Prize Draw will win the unclaimed Prize.
Verification
The details of each Eligible Entry will be processed through the OTR App. The Promoter may require you to verify that you are an Eligible Entrant by providing evidence of your name, address, date of birth, email address, payment method used in the OTR App or other personal details. Identification considered suitable for verification is at the discretion of the Promoter.
Reserve Draw
If a Winner fails to claim the Prize by the prize deadlines described in the Notification and Claiming the Prize section above, the Prize will be forfeited by the Winner and the Promoter will choose and notify a new Winner from the Reserve Winners (in the order they were drawn) using the same process set out above.
The Promoter will inform the Reserve Winner by email to the email address provided when registering to the OTR App by 23:59 (ACST) 9th November 2020.
In the event that the Prize is unclaimed by the Reserve Winner by 23:59 (ACST) 16th November 2020, the Prize will be forfeited by the Reserve Winner and may be distributed at the Promoter’s absolute discretion.

General Conditions
1 Introduction
These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about the Prize and how to enter forms part of these Terms and Conditions. By entering, you accept these Terms and Conditions. Installation and use of the OTR App is subject to the terms and conditions of the OTR App, available at
http://www.otr.com.au/ otr_app/terms-use/ and which may change from time to time.
2 Entry
2.1 Your entry must be received during the Competition Period. Your entry is deemed to be received only when received by the Promoter’s database.
2.2 If you seek or obtain a refund in respect of a Qualifying Purchase your entry may be deemed invalid at the Promoter’s discretion. The Promoter is not liable for any problems with communications networks or any technical issue or error that may occur in the course of the administration of the Competition.
2.3 You are responsible for your own costs associated with entering.
2.4 If you enter using multiple aliases you may be disqualified.
3 Prize
3.1 The Prize will be awarded within the time specified in the above table, unless otherwise advised by the Promoter.
3.2 If the Prize cannot be used by the Winner at the times specified by the Promoter (in its sole discretion), the Promoter may award the Prize to a Reserve Winner or conduct another prize draw in its absolute discretion.
3.3 The Promoter is not responsible for any variation in the value of the Prize.
3.4 The Promoter will not be responsible for any additional costs incurred by the Winner in connection with the use of the Prize. The Winner (and if applicable, their guests) are responsible for all costs associated with using the Prize, including without limitation, travel and transfer costs (except to the extent that travel forms part of the Prize or is otherwise stated in the Prize description), food and beverage costs, insurance costs and spending money.
3.5 The Winner (and their companions) must comply with all conditions of use for the Prize (whether of the Promoter or any third party) and must comply with any reasonable directions of the Promoter and any supplier of the Prize as to the use of the Prize and will indemnify the Promoter from and against any and all expense, loss or damage (including without limitation consequential loss or damage) suffered or incurred by the Promoter in connection with any failure of the Winner (or their guests) to comply with these Terms and Conditions.
3.6 If the Prize includes transport, the Prize does not include transfers to and from the Winner’s place of residence to the departure point. The pick-up and drop off times for the relevant transport will be determined by the Promoter in its absolute discretion and the Promoter will have no responsibility to the Winner (or their guests) if the same do not arrive to the relevant pick-up and drop off locations on time.
3.7 If the Prize includes tickets to an event, the Promoter is not responsible for any changes in times or dates, cancellations or rescheduling of events that may prevent the Winner from redeeming the Prize or any part of it.
3.8 The Prize cannot be transferred, exchanged, redeemed or sold for cash.
4 Verification, Breach, Substitution and Cancellation
4.1 If you or your entry are deemed by the Promoter to breach these Terms and Conditions, your entry (or at the Promoter’s discretion, all of your entries) may be discarded or otherwise deemed invalid.
4.2 The Promoter may, at any time, require you to produce documentation to establish to the Promoter’s satisfaction the validity of your entries (including documentation establishing your identity, age, place of residence, place of employment, email address and authority to make payments in the OTR App).
4.3 Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
4.4 You must not:
(a) tamper with the entry process;
(b) engage in any conduct that may jeopardise the fair and proper conduct of the competition;
(c) act in a disruptive, annoying, threatening, abusive or harassing manner;
(d) do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this competition;
(e) breach any law; or
(f) behave in a way that is otherwise inappropriate.
4.5 The Promoter’s decision in connection with all aspects of this competition is final.
4.6 If this competition cannot run as planned for any reason beyond the Promoter’s control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the competition or disqualify affected entries/entrants, subject to necessary approval by the state/territory gaming authorities (if any).
5 Liability and Indemnity
5.1 Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
5.2 Subject to the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death whatsoever suffered or incurred by any person in connection with this competition or the Prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
5.3 Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this competition are not liable for any loss of, damage to or delay in delivery of the Prize.
5.4 The Promoter and the agencies and companies associated with this competition are not liable for entries, Prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
5.5 The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, theft or destruction or unauthorised access to or alteration of entries.
5.6 The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
5.7 The Promoter may communicate or advertise this competition using Facebook, Instagram or other social media platforms. However, the competition is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram or any other relevant social media platform. You provide your information to the Promoter and not to Facebook, Instagram or any other relevant social media platform. You completely release Facebook, Instagram and any other relevant social media platform from any and all liability.
6 Privacy and Publicity
6.1 Upon submission, all entries automatically become the property of the Promoter.
6.2 By entering the Competition and providing your personal information you consent to the use of your personal information (as defined in the Privacy Act 1988) in the manner set out in these Terms and Conditions.
6.3 The Promoter collects personal information about you in order to conduct the competition. If the personal information requested is not provided, you may not be able to participate.
6.4 The Promoter may also:
(a) use your personal information to help improve its goods and services;
(b) share your personal information with the Promoter’s Australian related companies, agents, contractors or promotional partners who may (together with the Promoter) contact you with special offers and marketing via any medium including mail, telephone and commercial electronic messages (including email and SMS).
6.5 Where the Promoter holds personal information about you that it has collected from different sources, the Promoter may combine this personal information into a single record or collection of linked records.
6.6 The Promoter’s Privacy Policy (available at
http://www.otr.com.au/pages/privacy-policy/) states:
(a) how you can seek access to the personal information the Promoter holds and seek the correction of such information; and
(b) how you can complain about a breach of privacy and how the Promoter will deal with such a complaint.
6.7 The Winners agree to participate and cooperate in all publicity, editorial and promotional activities required by the Promoter, including but not limited to being interviewed, recorded and photographed without compensation. The Winners grant the Promoter a perpetual and exclusive licence to use the any such footage, recordings or photographs in all media worldwide and the Winner without notification or remuneration.
