TERMS AND CONDITIONS:
PARTICIPATION
1. Information on how to enter the “Life–Space Chemist Warehouse AirPod” promotion (Promotion) and the prizes form part of these Terms and Conditions. By participating, Entrants (as defined below) agree to be bound by these Terms and Conditions.
2. The promoter is Evolution Health Pty Ltd (ABN 46 120 173 159), Level 6, 476 St Kilda Road, Melbourne VIC 3004 (Promoter).
3. Entry is only open to Australian residents aged 18 years or over (Entrants).
4. Employees (and the immediate families) of the Promoter, participating retailers and agencies associated with this Promotion are ineligible to enter.
5.The Promotion commences at 12.01am AEDST on 30 October 2020 and entries close at 11:59pm AEDST on 12 November 2020 (Promotional Period). All times and dates specified throughout these Terms and Conditions will be AEST or AEDST depending on when applicable in Victoria.
HOW TO ENTER

Entrants must then fully complete the entry form on the Website as requested, including but not limited to, uploading a copy of their receipt, entering the other requested details, and follow the prompts to submit the entry online so that it is received during the Promotional Period.
8. Limit of one (1) entry per person per day. Each Qualifying Purchase can only be entered once.
9. All entries must be received by the Promoter during the Promotional Period. Records of the Promoter are final and conclusive as to time of receipt. Incomplete, illegible or indecipherable entries will be deemed invalid.
10. Entrants can only submit an entry in their own name. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including a Entrant’s identity, age, mobile phone number and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion, or otherwise than in accordance with the spirit of the Promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
11. Entrants must retain the original purchase receipt used to make an entry in the Promotion. The original purchase receipt must clearly show the product was purchased during the Promotional Period but before the time of entry, and the participating outlet where the product was purchased. Failure to produce the original purchase receipt for an entry when requested may, in the absolute discretion of the Promoter, result in invalidation of the Entrant’s entry.
12. There will be one (1) instant prize per day (14 instant prizes in total). The instant prize for each day is one (1) Apple AirPod valued at $249. Provisional winners will be notified online. Once verified, winners will be notified by email within 2 business days. Winners will be published on the Website on 10 December 2020.
13. A draw for any unclaimed prizes will take place at 12pm on 11 March 2021, at Core Marketing Services, 45 Stubbs Street, Kensington Vic 3031, subject to any directions from a lottery authority. Winners will be notified by email within 2 Victorian business days of the draw and published on the Website on 18 March 2021.
General
14. Quality control errors will not invalidate an otherwise valid instant prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all instant win prize claims in excess of the advertised total prize pool will be honoured. There will be up to 14 online instant win messages released in this Promotion.
15. Total prize pool value is $3,486.
16. If an Entrant has a complaint, they must notify the Promoter during the Promotional Period, and the Promoter will respond within 14 working days. In response to any complaint, the Promoter’s decision is final, and no correspondence will be entered into after the Promoter’s reply, unless specified otherwise by the Promoter.
17. Prizes are not transferable or exchangeable and cannot be taken as cash.

If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter (including but not limited to technical difficulties, unauthorised intervention or fraud), the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
19. Any cost associated with entering the Promotion, or accessing the Website, telephone enquiries in relation to the Promotion, emailing the entry are the Entrant’s sole responsibility.

Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.

22. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such personal information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on Entrants providing their personal information. The Promoter will collect, store, use and disclose personal information as set out in its Privacy Policy, which can be viewed at

In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Entrant. The Privacy Policy also contains information about how Entrants may opt out, access, update or correct their personal information, how Entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose an Entrant’s personal information to entities outside of Australia.
