In addition, each entrant indemnifies the Promoter and the Sponsor against all loss, damages and costs incurred by the Promoter and the Sponsor arising from that entrant’s breach of the warranty set out in this condition. 3.7 The Promoter reserves the right in its sole discretion to reject bulk entries which it considers to have been generated using software to generate multiple entries. 3.8 The Promoter reserves the right to verify the validity of entries and entrants (including an entrant’s identity, age and address) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions, who tampers with the entry process or who submits an entry that the Promoter and/or Sponsor, in its sole discretion, deems to be offensive, inappropriate, defamatory or otherwise not in keeping with the spirit of the competition. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights 4. PRIZES 4.1 There will be one prize winner (the “Winner”). 4.2 The prize (the “Prize”) includes: PRIZE DESCRIPTION RRP 1 x Prize • $5,000 worth of interior design elements including but not limited to floor coverings, window dressing, painting, furniture, and plants including delivery, installation and labour and; • $10,000 worth of interior design consultation time including supply of design/decoration ideas specific to the Winner’s home and up to two home visits by an interior decorator including travel time, travel expenses and project management $ AU $15,000 (Max Value) Total Prize value is A MAXIMUM OF $15,000 (including GST). The Promoter accepts no responsibility for any change in Prize value between now and the date the Prize is awarded. 4.3 The Winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation. 4.4 Prizes are not transferable and cannot be redeemed for cash. The Winner should seek independent financial advice about any tax implications that may arise from the prize winnings. 4.5 In participating in the Prizes, the Winner agrees to participate and co-operate as required in all editorial activities relating to the Competition, including but not limited to being interviewed and photographed. The Winner agrees to grant the Promoter and the Sponsor a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide for an unlimited period of time and the Winner will not be entitled to any fee for such use. 4.6 The Sponsor is solely responsible for the fulfilment of the Prize. 4.7 If for any reason whatsoever a prize winner does not redeem a prize or an element of the prize by the time stipulated by the Sponsor, then the prize or that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu. 4.8 If a prize (or part of any prize) is unavailable, the Sponsor, in its discretion, reserves the right to substitute the prize (or that part of the prize) with an alternative prize to the equal value and/or specification, unless to do so would be prohibited by law. 5. HOW TO WIN 5.1 All entries completed and submitted in accordance these Terms and Conditions will be judged at the Promoter’s office at Levels2&3, Pier 8/9, 23 Hickson Road, Millers Point, NSW 2000 on Friday, 1 October 2010 at 11:00am (AEST). One Winner will be selected by a panel of judges appointed by the Sponsor. The Winner will be the entrant whose entry fulfils the entry criteria and whose answer is judged to be the most creative and original from all entries received. This is a game of skill. There is no element of chance in the judging of the Competition or determination of the Winner. 5.2 The Winner will be notified by a phone call at the conclusion of the judging, and the Winner’s details will be published on the Competition page located at www.yahoo7.com.au/aquamist. 5.3 The judges’ decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result. 5.4 It is a condition of accepting the Prize that the Winner may be required to sign a legal release in a form determined by the Promoter and the Sponsor in its absolute discretion. 5.5 It is a condition of accepting the Prize that the Winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements. NO LIABILITY 6.1 Subject to any restrictions in law, the liability of the Promoter and the Sponsor however arising, whether by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the Prize. 6.2 The Promoter, the Sponsor and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail. 6.3 Except for any implied condition or warranty the exclusion of which from these terms and conditions would contravene any statute or cause any part of these terms and conditions to be void (“Non Excludable Condition”), the Promoter and the Sponsor excludes from these terms and conditions all conditions, warranties and terms implied by statute, general law or custom. Except for liability in relation to a Non Excludable Condition, the Promoter and the Sponsor (including its officers, employees and agents) excludes all liability whether arising in tort (including without limitation negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss of profits) whether direct, indirect, special or consequential, arising in any way out of the competition, including, without limitation, the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these terms and conditions; (e) any tax implications; and/or (f) a prize or use of a prize. 6.4 The Promoter and its affiliates assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available. 6.5 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state legislation. 6.6 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions. 7.
