Information on “how to enter” and prizes form part of conditions of entry. Entry into this competition deems acceptance of these terms and conditions by the parent or legal guardian of the entrant. 2. Enter by sending a photo submission to Practical Parenting/Face of Tommee Tippee PO Box 141 Eastern Suburbs MC NSW 2004. Photo submissions must have been taken within 1 month of the date of entry. 3. All entries must be placed inside an envelope and must include no more than four recent photos and the original entry coupon from either the August 2010 issue of Practical Parenting (on sale 21/07/10) or the September 2010 issue of Practical Parenting (on sale 18/08/10) to be eligible to win. Photocopied forms or photos will not be accepted. 4. Entry is open to all residents of Australia except employees and immediate families of the Promoter, associated companies and agencies and participating outlets. Immediate family means any of the following: spouse, ex spouse, defacto spouse, child or step child (whether natural or by adoption), parent, step parent, grandparent, step grandparent, uncle, aunt, niece, nephew, brother, sister, step brother, step sister or 1st cousin. The Promoter is Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015 (ABN 16 097 410 896) and the Sponsor is Jackel Pty Ltd (Tommee Tippee), Unit 9A, 9-15 South St, Rydalmere NSW 2166 (ABN 26 906 440 448) 5. The Competition commences on 21/07/10 at 00:01 and closes last mail received at the Promoter’s premises on 15/09/10 at 23:59 AEST. There are three categories that a parent/entrant can enter. Age restrictions into each category apply. As at 15/09/10 entrants must be aged as follows: Baby category– Entrants must be aged 6-12 months, Toddler category– Entrants must be aged between 13 months - 3 years, Mum category – Entering mothers must be photographed with a newborn baby aged between 0 – 6 months. Photos used to enter the competition must be no older than 1 month. 6. The top 8 finalists for each of the three categories (‘Baby category’, ‘Toddler category’ and the ‘mum & baby category’) as judged having regard to skill, creativity and originality by the promoter will appear in Practical Parenting magazine cover-dated October 2010 (on sale 15/09/10) and in Practical Parenting magazine cover-dated November 2010 (on sale 20/10/10). The shortlist of 24 finalists will be judged between 21/07/10 at 9:00 and 15/09/10 at 17:00 AEST by a panel of judges appointed by the Promoter at Practical Parenting, Tommee Tippee and Brats Models. The 24 finalists maybe required to meet with the Promoter in the finalists nearest capital city. Transfers to and from the finalist’s home to meeting venue are not included and are the responsibility of the finalists and at their expense. 7. The promoter may at any time during the promotional period request parent or guardians of entrants to submit additional current photographs and proof of responsibility for the child to be eligible to win. 8. Total prize value is (up to) $17,679, as at 01/06/10. Prizes will be awarded to the parent or legal guardian of the entrant as listed on the entry. The major winners and runners-up will be judged (by the panel of judges listed in clause 6) from the shortlist of 24 finalists having regard to skill, creativity and originality by 30/09/10. One major winner from each of the three categories will each receive: 1 x Face of ‘Tommee Tippee’ 1 day photo shoot and cash prize in the form of a cheque valued at $5000 1 x 12 month modelling contract with Brats Models valued at $550 Each major prize total value is $ 5550 Major prize pool total is $16,650 21 runners-up will each receive: 1 x 12 month subscription to Practical Parenting magazine valued at $49 each. Total runners-up prize pool is: $1,029 9. Major prize winners must be available for a full day shoot on a day and at a location to be advised by Tommee Tippee. Depending on the location of the shoot and at the discretion of the Promoter and/or Sponsor either; a) costs of travel of winning entrant and parent (1 supervising adult) will be covered, or b) a photographer will be flown to the location of the winner. The photo shoot portion of the major prize must be taken at a time and location stipulated by Tommee Tippee. In the event a winner does not take the prize at the time and location stipulated, then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of the prize. 10. Major prize winners may be required to be available for a further photo shoot, if Tommee Tippee is not satisfied with the photos taken in the initial photo shoot. 11. For any cash prizes, the name on your entry coupon must be that of an eligible bank account to which a cheque can be cashed. The promoter makes all reasonable efforts to send cheques in the names as specified in the original entry. Winning entries with only a family name or reference to a family as the entrant cannot be cashed by banks. 12. Entrants must not be affiliated with any other modelling agency during the promotional period or afterwards until the major winners and runners-up from each category are announced. Entrants affiliated with any other modelling agency will be disqualified from the competition. 13. The major winner of each category will be notified by mail, email or phone within 24 hours of the final judging date, which is the 30/09/10 and announced in the December issue of Practical Parenting and online at www.practicalparenting.com.au by the 17/11/10. 14. Entrants and their parents or guardians agree that should they become winners, they will participate and co-operate as required in all editorial, marketing and advertising activities relating to and arising from the promotion, including but not limited to being interviewed and photographed. Parent(s) and/or legal guardian(s) over the age of 18 will be required to sign a talent release form to give photographers permission to take photographs of the major winners. The winners (and their companions) agree to granting the Promoter and the sponsor a perpetual and exclusive licence to use such footage and photographs in all media in Australia and New Zealand and the winners (and their companions) will not be entitled to any fee for such use. For the ‘Mother and Baby’ category, the mother will be responsible for their baby at the photo shoot and will be required to sign a guardian waiver, under Brats Modelling’s guidance. 15. Images will be for the exclusive use of Jackel Pty Ltd (Tommee Tippee) for their advertising and promotional activity within Australia and New Zealand for a period of 2 years as at the date of Major winners photo shoot. If Tommee Tippee wish to continue to use these photos after 2 years, royalties will need to be paid. 16. Entrants parents or guardians may opt in to receive marketing and general information from the Promoter and the Sponsors of the promotion. Entrant’s parents or guardians are advised that the Promoter and the sponsors will collect entrants’ personal information for the purpose of conducting and promoting this competition (including but not limited to determining and notifying winners and as required, to Australian authorities) and for related purposes which would reasonably be expected without your permission. Entrants’ personal information to other organisations will not be sold however the Promoter and the Sponsor may disclose personal information to essential service providers who provide services in connection with our products and services. You may request access to your personal information in the possession of the Promoter by writing to The Privacy Officer, Legal Compliance Department, Pacific Magazines Pty Ltd, 8 Central Ave, Eveleigh NSW 2015. 17. Photos that are copyrighted should not be submitted unless you have permission from the photographer/owner. Photos cannot be returned. By entering the competition entrants, parents or guardians agree and understand that their written entries and/or photos may be used for promotional purposes without any further reference, payment or other compensation to the entrant and/or owner of the photograph. 18. Where the prize involves driving, travel or an event, winners and any companions under the age of 18 must be accompanied by their legal parent or guardian at all times. The major winner’s companion must be the prize winner’s legal parent or guardian. 19. Unless expressly stated in these terms and conditions all other expenses are the responsibility of the winners (and their companions) including but not limited to meals, spending money, transport to and from departure and arrival points, transfers, fuel surcharges, energy surcharges, gratuities, services charges, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. 20. By entering the competition, and by collecting a prize, the winner and their parents or guardians acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. The Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling. It is the responsibility of the prize-winner’s parent or guardian to enquire about local issues and conditions at destinations prior to travel. The Promoter does not guarantee that the winner will enjoy the travel or be suited to the type of travel involved. 21. All competition entries must be able to be posted to and received at the post office box address supplied for the particular competition. No hand delivered or bulky entries will be accepted upon receiving at the Promoter’s premises for any competition, unless otherwise stated herein. Mail entries that contain any objects that have not been requested by the 1 Promoter (such as backing cards or excess paper) will not be accepted. Any entries that do not follow these requirements will be deemed invalid and will not be received by the Promoter or its agents. The Promoter and its agents take no responsibility whatsoever for such entries that do not follow these prescribed guidelines. The Promoter advises entrants/parents or guardians not to send entries to the Promoter’s street address as these entries may be deemed invalid. 22. The Promoter highly recommends a DL-sized (business) envelope is used in submitting postal entries. Entries sent via registered mail will not be guaranteed entry into the competition due to increased sorting, handling and storage required by Australia Post. Entries sent in smaller unique envelopes are known to have issues when being sorted electronically by Australia Post and should be avoided. The Promoter also encourages competition entrant’s parents or guardians to clearly write on their envelope the full name and address of the competition they are entering for ease of processing by Australia Post and therefore entry into the competition. 23. All entrants must submit ONLY their own original answers, designs and works. Any such answers, designs or works cannot be previously published in any forum worldwide. All entries become the property of the Promoter and cannot be returned. Entries that are found to have been derived from the designs of a third party will be considered invalid and, if awarded a prize, that prize must be returned to the Promoter. The winner may be required to sign a statutory declaration regarding the originality of the entry. Without limiting the generality, the Promoter reserves the right to take legal action against anyone found to have breached this term. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation are reserved. 24. If the Promoter is unable to contact the winner to claim fulfilment of the promotional prize, that winner will forfeit the prize in its entirety and it shall be awarded to the first runner up in the promotion. A new runner up shall then be judged. The Promoter will not be liable for a winner who cannot be contacted and therefore forfeits their prize and no correspondence will be entered into. 25. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated. 26. The Promoter highly recommends a current residential street address be provided when requested for ease of correspondence and potential prize delivery. The Promoter makes all reasonable efforts to deliver prizes to the addresses provided by competition entrant’s parent or guardian. The Promoter cannot guarantee that any prizes returned to the Promoter due to non-delivery at the provided address will be re-sent to the prize winner. 27. The Promoter reserves the right to request winners to sign a winner’s deed of release or any other relevant forms or agreements that the Promoter deems necessary, to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency, age and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 28. The Promoter reserves the right to rejudge in the event of an entrant, parent or guardian, claiming to be a winner, being unable to satisfy these Terms and Conditions. 29. The judges’ decision in relation to any aspect of the competition is final and binding on each person who enters. Chance plays no part in determining any winner. No correspondence will be entered into. No responsibility is accepted for late, lost or misdirected entries. Prizes are subject to availability, not transferable or exchangeable and, with the exception of cash prizes, cannot be taken as cash. Prizes will be sent to the winner’s nominated address as stated in their original entry. The Promoter and their associated agencies, and companies associated with this promotion will take no responsibility for prizes damaged or lost in transit. 30. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of that prize. 31. To the extent permitted by law, the Promoter shall not be liable for any loss or damage whatsoever suffered, including but not limited to direct or consequential loss, or personal injury suffered or sustained during the course of prize winning trips or in connection with the redemption of and/or use of any other prizes.
