T E R M S & C O N D I T I O N S O F E N T R Y W I N A T R I P T O M E L B O U R N E ! 1. Information on how to enter forms part of the terms of entry. Entry into the competition is deemed acceptance of these terms and conditions. 2. Information on how to enter and prizes forms part of these conditions of entry. The promotion is open to all residents of Australia aged 18 years and over. Offer excludes New Zealand. Employees of the Promoters and their immediate families and agencies associated with this promotion are ineligible to enter. 3. The promotion commences on August 2, 2010 and closes with the last mail received on September 5, 2010. The judging will be judged by a panel of judges appointed by the Promoter. The judging will take place at Network TEN, 1 Saunders St Pyrmont Sydney NSW. The judges’ decision in relation to all aspects of this competition will be final and binding on all who enter. No correspondence will be entered into. 4. This is a game of skill; chance plays no part in determining the winners. Each entry will be individually judged based on its literary and creative merit. Multiple entries accepted but each entry must be submitted separately and must be unique 5. To enter, individuals must log on to ten.com.au/offspring to register during the promotional period, providing their name, address and daytime telephone number. To enter the competition the individual must watch the first episode of Offspring and tell us, in 25 words or less: "What is the relationship between Cherie and Nina?" 6. Incomprehensible and incomplete entries will be deemed invalid. 7. The competition will be advertised in the September issue (out August 2nd) of Cosmopolitan Magazine and on ten.com.au/offspring 8. A limit of 1 entry per member per day applies. 9. The exact details of the Major prize will be provided to the winner in the form of an email or mail posted to the winner by a TEN representative. The winner must give at least 21 days notice of proposed commencement of travel. All travel must be completed no later than 31 March 2011. 10. Not valid on Public Holidays or during Melbourne special event periods. 11. The prize is subject to availability at the time of booking and, if any component of the prize is unavailable on the dates proposed by the winner, lastminute.com.au will consult with the winner to determine alternative dates on which the prize will be booked. 12. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 13. If winner/s are unable to take the prize then they will forfeit the prize and nothing will be awarded in lieu. A re-judging for another winner may be conducted at the discretion of the Promoter 14. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause 15. One major winner will receive: - Return economy flights for two adults to Melbourne from the winner’s nearest Australian capital city. - Two nights’ accommodation in a Corner Room at Crown Metropol, including access to 28, the hotel’s exclusive lounge and sky bar. - Two tickets to the famous HiddenSecrets Tours Lanes and Arcades tour 16. Total prize value is up to = $5,000 (including GST) 17. Prizes cannot be transferred, exchanged or redeemed for cash. 18. Tickets are non-refundable, non-transferable and subject to date availability. Tickets cannot be used as part payment of another airfare, and frequent flyer miles cannot be accrued. 19. The winner and their companion are responsible for all other expenses including spending money, meals, drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. 20. The winner and travelling companions must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure (Sydney, Melbourne, Brisbane, Adelaide or Perth). 21. The prize will be arranged by lastminute.com.au. Specific flight details, namely airline and/or flight times, are at the discretion of lastminute.com.au 22. The winner will receive two (2) adult return economy airfares from the winner’s nearest capital city to Melbourne. The tickets are valid for travel over the specified routing and in the class of travel stated by the Promoter. The aircraft carrier selected is at the discretion of the Promoter. Charges incurred by changes to flights once decided on by the winner and booked by the Promoter are the responsibility of the winner 23. All passengers must travel together on the same booking in both directions. The winner will receive airport transfers, two (2) nights’ accommodation in a Corner Room at Crown Metropol, including 28 access. The winner will also receive two (2) tickets to the Hidden Secrets Tours Lane and Arcades Tour. 24. Government taxes are an additional cost to the winners and their travelling companions and are required prior to ticketing. 25. Standard conditions for tickets and accommodation apply. The winner may be required to present a credit card at time of check-in at accommodation. Once ticketed, flight number or date changes only will not be permitted. Destination cannot be changed to an alternate destination. 26. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. 27. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize, except for any liability which cannot be excluded by law 28. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize for a prize of equal or greater value, subject to State Regulation. 29. In the event that for any reason whatsoever the winner does not take all elements of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. 30. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion. 31. Once prizes have left the Promoter’s premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit. 32. Prize valued in Australian dollars. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in the value of the prize. Where prize is awarded in the form of a voucher/letter/ticket or pass, the Promoter shall not be liable for any voucher/letter/ticket or pass that has been lost, stolen, forged, damaged or tampered with in any way. Redemption of voucher/letters/tickets and passes is subject to terms and conditions stipulated on voucher/letter/ticket/pass. 33. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize. 34. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account holder). 35. Should an entrant’s contact details change during the promotional period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to Promoter. 36. The promoter’s decision is final and the promoter will not enter into correspondence regarding the Competition result. 37. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. 38. It is a condition of accepting the prize that the winner may be required to sign a legal release in a form determined by the promoter in its absolute discretion. 39. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under State Regulation. . 40. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence) for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these conditions of entry; (e) any tax liability incurred by a winner or entrant; and/or (f) participation in the prize 41. In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right (subject to reference to all relevant state and territory regulations) to cancel, terminate, modify or suspend the promotion. 42. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 43. The promoter and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available. 44. If for any reason this competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to any written direction given under State Regulation. 45. All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion but no further use of this information will be made without prior consent. 46. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
