Terms & Conditions

1.Information on how to enter form part of the terms and conditions of entry. By entering the competition you are agreeing to the following terms and conditions:
2. To enter, participants must complete a entry form in full at http://www.peppers.com.au/gourmet_traveller_competition/ to be eligble. Incomplete, misdirected or illegible entries will be ineligible. Only one entry per person is permitted. All entries become the property of the Promoter and cannot be returned. 3. Entry is open to all permanent residents of Australia/New Zealand aged 18 or over. All employees and their immediate families of Mantra Group and their associated agencies and companies associated with the promotion are ineligible to enter. This is a game of skill, and chance plays no part in determining the winners.
4. The judges' decision is final and no correspondence will be entered into. All prizes are non-transferable, non-refundable nor redeemable for cash or other goods or services. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
5. The competition commences on 9 August 2010 at 10.00 EST and concludes 6 September 2010 at 17.00 EST.
6. All entries will be judged by Peppers Retreats, Resorts & Hotels based on creativity and relevance to the question posed. On 8 September, 2010 at 14:00 (EST) at Peppers Retreats, Resorts & Hotels, 50 Cavill Avenue , Surfers Paradise, QLD 4217, one major winner will be selected by the Promoter in its absolute discretion.
7. Peppers reserves the right to request that the winner provide proof of identity and age.
8. Prize winners are advised that Tax implications may arise from their prize winnings and that they should seek independent financial advice prior to acceptance of the prize.
9. Peppers reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if Peppers determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
10. Peppers reserves the right to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition.
11. The winner will be notified by email and phone.
12. Prize values are the recommended retail value as provided by the supplier and are correct at time of printing. All prize values are in Australian dollars and include GST.
13. The Promoter and their associated agencies and companies shall not be liable for any misadventure, accident, injury, loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
14. In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the competition and recommence it from the start on the same conditions, subject to any written directions given under the Lottery and Gaming Regulation 1993 (SA).
15. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission; communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available.
16. All winning entries become the property of the Promoter. All winning entries will be entered into a database and the Promoter may use the entrants' names, addresses, telephone numbers, photographs, and written entries for future promotional, marketing and publicity purposes in any media worldwide without any further reference, payment or other compensation to the winning entrant.
17. One major winner will receive a Gourmet Getaway which includes two nights at Peppers Anchorage with breakfast daily and dinner on one night in Merrett’s restaurant

The following terms and conditions apply to the prize:
a) The voucher is valid until March 2011
b) Prize must be quoted at time of booking
c) Accommodation is subject to availability and voucher is not redeemable on public holiday weekends or during special event periods.
d) The prize must be taken in its entirety at the one time and cannot be split. The voucher cannot be used in conjunction with any other offer.
e) Peppers is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion, that may occur whilst the winner is traveling.
f) Liabilities for charges/fees not included in the prize are the full responsibility of the winners. Unless expressly stated in these terms and conditions all other expenses are the responsibility of the winners (and their companions) including but not limited to spending money, flights, transfers, meals, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, airport taxes (including departure taxes), gratuities, services charges, passports, travel insurance, pre and post accommodation, optional activities or excursions and all other ancillary costs. A credit card imprint or cash deposit will be required from the winner at check-in to the hotel, for all incidental charges.
19. The winners release Peppers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the prize. Without limiting the foregoing, the released parties not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of the trip or any other aspect of the prize.
20. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by Peppers then the entire prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
21. If the prize is unavailable, for whatever reason, Peppers reserves the right to substitute the prize for a prize of equal or greater value.
22. It is a condition of accepting the prize that the finalist/winner may be required to sign a legal release in a form determined by Peppers in its absolute discretion.
23. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize.
