TERMS AND CONDITIONS – WIN FREE RAIL TRAVEL
1.Information on how to enter and prizes form part of these terms and conditions of entry, and entry into the competition is deemed acceptance of them.
2.The promoter is Rail Corporation of New South Wales (“RailCorp”), Level 21, 477 Pitt Street, Sydney, NSW 2000. ACN 325 778 353 Phone (02) 8202 2000.
3.The promotion commences at 9.00 am AEST on 10 August 2010 and continues until 11:59 pm AEST on 21 September 2010 (“Promotion Period”).
4.Entry is open to all residents of New South Wales. Employees of RailCorp and their immediate families are ineligible to enter. Entry into the competition will constitute a representation of eligibility to enter.
5.To enter individuals must visit the website www.trainsmart.com.au and follow the link to complete the “Trainsmart” quiz.
6.Only 1 entry is permitted per person.
7.Entries may only be made in the form approved by RailCorp.
8.All entries and the information contained therein remain the property of RailCorp.
9.RailCorp is not responsible for late, lost, misdirected, incomplete, incorrectly submitted or illegible entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, destruction, transmission interruption, communications failure or otherwise. RailCorp has no control over communications networks or services, the internet, or computer or telephone networks or lines and does not accept responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. RailCorp is not liable for any consequences of user error including (without limitation) costs incurred. Any form of automated entry using any device or software is invalid. Entry via email is deemed to be received at the time of receipt into RailCorp’s database not at the time of transmission by the entrant.
10.The prizes will be determined as follows:
The first valid entry drawn on 21 September 2010 (“Draw Date”) will win a ‘MyTrain’ pass valid for a period of 365 days for travel on CityRail Services between the two stations nominated on the ticket (“Yearly Pass”) (Yearly Pass value will not exceed RRP of $3,328.00); and
The next 10 valid entries drawn on the Draw Date will win a ‘MyTrain’ 14 day pass valid for a period of 14 days for travel on CityRail services between the two stations nominated on the ticket (“Rail Pass”) (Rail Pass value will not exceed RRP of $148.00 each).
11.The total value of the prize pool is RRP $4,808.00.
12.RailCorp accepts no responsibility for any variation in the prize value between winners due to differences in nominated destination stations on the Rail Pass or Yearly Pass. Subject to the prize values above not being exceeded, winners may request any valid destination stations for their Rail Pass or Yearly Pass. RailCorp also retains the absolute discretion to limit or otherwise determine the destinations for all Rail Passes and the Yearly Pass issued as a result of in this competition, for any reason. Without limitation, prizes do not include any accommodation, transfers or any spending money.
13.Prizes and participation in this competition are subject to any conditions imposed by RailCorp, as applicable.
14.All the usual conditions apply to train travel by the Rail Pass and the Yearly Pass as found at http://www.cityrail.info/travelling_with/conditions_of_travel/
15.RailCorp, and its related bodies, will not be liable for any losses, expenses, damages, personal injury or death which is sustained (whether or not arising from any persons negligence) in connection with the competition or acceptance or using of any prize(s) except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
16.Winners will be notified by email to their nominated email address within 3 business days of the Draw Date (“Confirmation Email”). It is the responsibility of each entrant to ensure the details provided in their entry are correct.
17.If a Confirmation Email is undeliverable for any reason including, but not limited to, an error in the destination email address as supplied by the entrant or, any error in, or action of an ISP or email provider (including filtering), a second Confirmation Email will be sent to the winner. Should the second Confirmation Email also be undeliverable for any reason, that prize will be redrawn.
18.In order to claim their prize, each winner must confirm their receipt of the Confirmation Email and acceptance of the prize no later than midnight 21 days after the Draw Date. If a winner fails to claim their prize within this time period, they will forfeit their prize and it will be redrawn.
19.As a condition of entry, entrants must provide RailCorp with all the details required to issue prizes including but not limited to their personal details, proposed start date of their Rail Pass or Yearly Pass and the stations they nominate (subject to a maximum ticket RRP value of $148 for Rail Passes and $3,328 for a Yearly Pass) as start and end points for their Rail Pass or Yearly Pass. This information may only be provided at the time of entering the competition in the form prescribed by RailCorp.
20.Entrants must, at RailCorp’s request, participate in all promotional activities (such as publicity and photography) surrounding this competition or, the winning of any prize, free of charge, and they consent to RailCorp and its related bodies, using their name and image in promotional material. Without limitation, entrants consent to being broadcast, filmed, photographed or otherwise recorded without compensation while participating in this competition, or in taking or using any prize, and they consent to RailCorp repeating any such broadcast, film or other recording at any time.
21.Winners may be published on the RailCorp or its related bodies’, including the CityRail, website.
22.Each entrant must ensure that any other person whose details have been provided by the entrant to RailCorp for the purposes of the entrant’s participation in this competition has given their implied or express consent for their details to be provided to RailCorp and any of its related bodies and to be contacted by RailCorp or any of its related bodies in relation to this competition.
23.If an entrant is unable to or, refuses or fails to take part in any element of this competition or, a winning entry is deemed not to comply with these terms and conditions, RailCorp reserves the right to discard that entrant’s entry and proceed as if that entrant had not entered the competition.
24.If due to any reason whatsoever RailCorp becomes aware after an entrant has won a prize that the entrant has not complied with these terms and conditions, that entrant will have no entitlement to the prize, even if RailCorp has announced them as a winner and that entrant will be required, at the direction of RailCorp, to return, refund or otherwise make restitution of the prize.
25.RailCorp may, in its absolute discretion cancel, or otherwise cease to provide any benefit of a prize or prizes to a winner(s), if the winner(s) behaves in a manner which may affect the reputation of RailCorp and any of its related bodies, is contrary to the law or, is otherwise inappropriate.
26.The start date for all prizes must be less than 28 days after the Draw Date. Any prize not commenced by that date will commence on a date determined by RailCorp at its absolute discretion.
27.Without limiting clause 15, RailCorp and its related bodies will not be liable for any damage to or, delay in transit of prizes. Prizes will be provided by RailCorp to the winner/s in the manner notified by RailCorp.
28.Subject to law if a prize, in the opinion of RailCorp, can not be provided for any reason, then RailCorp reserves the right to provide an alternative prize of up to the same value as the prize being replaced.
29.Each prize must be taken as stated and no compensation will be payable if a winner is unable to utilise a prize as stated. Prizes are not exchangeable or redeemable for cash or other goods or services. A prize can not be transferred to any other person. Nominated stations cannot be changed once nominated.
30.In the event that any entrant forfeits or, does not claim a prize or, is otherwise unable to comply with or, satisfy these terms and conditions, RailCorp reserves the right to conduct a redraw or redraws in respect of any such prize(s). Any redraws will be held at times nominated by RailCorp at its discretion.
31.No prize is transferable or exchangeable, nor can it be redeemed for cash. If, for any reason a winner does not take an element of any prize at the time stipulated by RailCorp, then that element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that element of the prize
32.RailCorp reserves the right to disqualify any entrant that tampers with the entry process. RailCorp is not responsible for any technical malfunctions or problems with internet, email or network congestion including injury or damage to any person’s computer related to this promotion.
33.RailCorp may require the winner/s to provide identification as requested by RailCorp including (without limitation) proof of identity. Identification considered suitable for verification is at RailCorp’s discretion and may include suitable photo identification (such as a driver’s licence or passport).
34.RailCorp has the absolute discretion to amend these terms and conditions, delete or introduce new terms and conditions to ensure the compliant and effective running of this promotion. RailCorp will, in its sole discretion, determine all questions or issues whatsoever (including without limitation, any matters of ambiguity, doubt, judgement or interpretation) that may arise in respect of this promotion. RailCorp’s decision will be final.
35.RailCorp may, without giving rise to any liability, terminate this promotion at any time without cause or providing notice of reasons.
36.The information entrants provide will be used by RailCorp for the purpose of conducting this competition. By entering this competition, entrants consent to the storage of their personal information on the databases of RailCorp and its related bodies and RailCorp and its related bodies may use this information for future promotional and marketing purposes regarding their products and services including contacting entrants via electronic messaging. RailCorp may disclose entrants’ personal information to its contractors and agents to assist in conducting this competition or communicating with entrants. RailCorp is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can obtain a copy of the information held on them by RailCorp by contacting RailCorp Communications Group on (02) 892 1861.
