Competition Terms and Conditions

Information on how to enter forms part of these Terms and Conditions. Entry into the competition constitutes acceptance of these Terms and Conditions and an acknowledgement that this is part of the Jacqui E VIP loyalty program, which is governed by the Jacqui E VIP Membership Terms and Conditions (available at www.jacquie.com.au/asp/vip_join.asp).
To be eligible for entry into this competition, a person must be a resident of Australia or New Zealand, aged 18 years or over and a current Jacqui E VIP Member ("Eligible Entrant"). Employees of Jacqui E Pty Ltd or their related entities and agencies are not eligible to enter this promotion.
This promotion commences at 00:01 (AEST) Monday 23rd August 2010 and closes at 23.59 (AEST) Sunday 5th September 2010 ("Promotion Period"). Entry must be made via Internet only. Any costs associated with accessing the promotional website remain the responsibility of each entrant and are dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid and will result in an ineligible entry.
To enter the Prize Draw an Eligible Entrant must make a qualifying purchase at a participating Jacqui E store during the Promotion Period, present their Jacqui E VIP Membership card, or identify themselves as a Jacqui E VIP Member at the time of making a purchase and then log onto www.jacquie.com.au by completing the entry form in the full manner required by providing their own full name, address, store of purchase, VIP number and email address.
Incomplete, ineligible or incomprehensible entries will be deemed invalid. Entries must be received by the Promoter during the Promotion Period. Entries will be deemed to be accepted at the time of receipt into the promotional database and not at the time of transmission.
For all completed valid entries, a notification page will advise consumers their entry has been successfully received. If an entry is not successful because it is not in the required format, fields are incomplete or ineligible a "try again" message will be sent to the entrant. The "try again" message will prompt the entrant to check their entry form and resubmit their entry in the required form.
One entry per receipt number is permitted. Entrants may be required to present proof of purchase for all entries made. Proof of purchase includes providing the Promoter with their purchase receipt within the required time frame set out by the Promoter.
All entries must be received by Jacqui E Pty Ltd during the Promotion Period.
Entrants can only enter in their own name. The Promoter reserves the right to request the winners to produce (within the requested time) appropriate photo identification or other documentation (to the Promoter's satisfaction, at its sole discretion) in order to confirm the winners' identity, age, residential address, eligibility to enter and claim a prize, and any information submitted by the winners in entering the promotion before issuing a prize. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or the winning entry has not been verified or validated to the Promoter's satisfaction within the time requested, the winner's entry will become invalid. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. The prizes will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
The Major Prize draw will take place at 11:00am (AEST) on Wednesday 8th September 2010 at Oxygen Interactive Marketing, Level 1, 16 Palmer Parade, Cremorne VIC 3121. Winners will be notified in writing and the major winner's name will be published in The Australian newspaper or New Zealand Herald on Monday 13th September 2010.
Major Prize: The first valid entry randomly drawn will win a weekend away for two (2) people to Sydney. The prize includes two (2) return economy airfares for two (2) people from the winners nearest capital city to Sydney, two (2) nights accommodation in a penthouse apartment at The Establishment Hotel, a $500 Aria Restaurant Voucher, a $500 Four Season Spa Voucher and transfers to and from the hotel. Total prize is valued up to $4,900.
Minor Prize: The next six valid entries randomly drawn will each win a $150 Jacqui E voucher.
Total maximum prize pool value is $5,800 AUD.
Major Prize is subject to hotel and flight availability and cannot be changed once the booking has been made.
The Major winner and travelling companion must travel at the same time, must depart from the same capital city and are responsible for transport from their residence to their nearest capital city for flight departure. If the winner resides in NSW then the flight component of the prize will not be included and the winner and their travelling companion will receive transfers via executive car to and from the airport (90 minutes each way).
The Major winner (and their companion) is responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances.
Government taxes are an additional cost to the winners and their travelling companions and are required prior to ticketing.
Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline.
A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges.
The prize must be taken within 12 months of the prize draw and is subject to hotel and flight availability. The prize is not available during peak times such as public holidays and school holidays and cannot be changed once the booking has been made.
The Jacqui E Gift Cards cannot be used in conjunction with any other discounts or special offers.
Once prizes have left the Promoter's premises, the Promoter takes no responsibility for prizes damaged, delayed or lost in transit.
Jacqui E and Oxygen Interactive Pty Ltd make no representation as to the safety, conditions or other issues that may exist at any destination.
If a prize is unclaimed or the winning entrant is unable to satisfy these Terms and Conditions by 17:00 (AEDST) on Wednesday 8th December 2010 then a second chance prize draw will take place at 11.00am (AEDST) on Monday 13th December 2010 at the same location as the original prize draw. All Eligible Entrants who have submitted an entry during the Promotion Period will be entered into the second chance prize draw. In the event of a winner, they will be notified by mail and telephone. Winner's of a prize valued over $250 will have their name and postcode published in The Australian or New Zealand Herald newspaper on Friday 17th December 2010.
The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participants or any other person's computer related to or resulting from participation in or down-loading any materials in this promotion.
Caution: any attempt to cause malicious damage or interference with the normal functioning of the Website application or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by an entrant, the entrant agrees to indemnify the Promoter for those losses, damages and costs.
If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions under State or Territory legislation.
The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
Prize values are correct at the time of printing and are subject to change without notice. Jacqui E Pty Ltd accepts no responsibility for changes to prize values. All prizes are not exchangeable, transferable or redeemable for cash or other goods or services. Any tax implications for Eligible Persons, which may arise from this promotion are the responsibility of the Eligible Persons, and independent advice should be sought.
The Promoter reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address in order to claim a prize. Proof of identification and residency considered suitable for verification is at the discretion of the Promoter.
The winners agree to participate in all reasonable promoted activities in relation to the promotion as requested by the Promoter and its agents and sign any release document provided by the Promoter, in its absolute discretion. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner of a draw (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose for collection of entrants' personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies or promotional partners who may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants' personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner's name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below.
Jacqui E Pty Ltd and its respective related bodies corporate, officers, employees and agents will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss), or for personal injury suffered or sustained in connection with this competition, the promotion of this competition or the use of the prize, except for any liability that cannot be excluded by law.
