Terms and Conditions of Entry for the Father’s Day Triple Play Promotion
 

1.    Information on how to enter and prize details form part of these conditions.  Entry into this Promotion is deemed acceptance of these terms and conditions.

2.    The Promoter is Telstra Corporation Limited ABN 33 051 775 556 of Level 2, 400 George Street, Sydney NSW 2000 (“Promoter”).

3.    The Promotion will be open from 9.00 am Australian Eastern Standard Time (“AEST”) on 17 August 2010 and will continue until 11.00 pm AEST on 5 September 2010 ("Promotion Period").

4.    Entry is open to all Australian residents, aged 18 years and over, other than management, employees or contractors of the Promoter, and other agencies, firms, retailers or companies associated with the Promotion (including suppliers of prizes), and their immediate families ("Eligible Entrants").

5.    To enter and be eligible to win, Eligible Entrants must, during the Promotion Period:

(a)    visit participating Telstra branded stores (each a "Purchase Location") (a list of the participating stores can be found at Telstra.com);

(b)    either purchase outright or sign up to a new contact or re-contact with Telstra for one of the following;

(i)    Android phone; or

(ii)    T-Hub; and

(each an "Eligible Purchase")

(c)    at the time of purchasing, receive a flyer outlining the details of how to enter the Promotion, correctly complete and submit the online entry form at www.telstra.com/beinvolved including name, contact details (including address, telephone number and e-mail address), receipt number and/or ID number (as applicable), item purchased, where the item was purchase and the name of the Sales Consultant,
("Eligible Entry").

6.    Only one entry per Eligible Purchase will be accepted.


7.    Standard browsing charges apply, where applicable, in accessing the internet.

8.    A random electronic draw for the prize will take place at 4.00 pm AEST on 6 September 2010 ("Draw Date") at Level 2, 400 George Street,Sydney NSW 2000 ("Draw Location"). The draw will be conducted by a representative of the Promoter.

9.    The Eligible Entrant with the first valid Eligible Entry drawn will win a Triple Play prize pack, valued at $15,720.00 (inc GST) consisting of:

AFL Grand Final

(a)    return economy airfares for two adults from the winner’s nearest capital city to Melbourne, departing on 24 September 2010 and returning on 26 September 2010, valued at up to $1,400.00 (inc GST) (unless the winner’s nearest capital city is Melbourne, in which case this component of the Prize is forfeited);

(b)    two nights accommodation , twin-share for two adults at 5 star hotel in the Melbourne CBD, valued at up to $1,120.00 (inc GST);

(c)    two Corporate tickets to the AFL Grand Final to be held on 25 September 2010 at the MCG, Brunton Avenue, Richmond, VIC, valued at $4,000.00 (inc GST); and

(d)    return economy airfares for two adults from the winner’s nearest capital city to Sydney, departing on 2 October 2010 and returning on 4 October 2010, valued at up to $1,400.00 (inc GST) (unless the winner’s nearest capital city is Sydney, in which case this component of the Prize is forfeited);

(e)    two nights accommodation, twin-share for two adults at 5 star hotel in the Sydney CBD, valued at up to $1,120.00 (inc GST);

(f)    two Corporate tickets to the Telstra NRL Premiership Grand Final to be held on 3 October 2010 at ANZ Stadium, Edwin Flack Avenue, Sydney Olympic Park, NSW, valued at $1,600.00 (inc GST); and

Super Cheap Auto Bathurst 1000

(g)    return economy airfares for two adults from the winner’s nearest capital city to Sydney, departing on 8 October 2010 and returning on 11 October 2010, valued at up to $1,400.00 (inc GST) (unless the winner’s nearest capital city is Sydney, in which case this component of the Prize is forfeited);

(h)    three nights accommodation, twin-share for two adults at 4 star hotel in Bathurst, valued at up to $1,680.00 (inc GST);

(the “Consumer Prize”).

10.    The Sales Consultant, nominated by the winner of the Consumer Prize at the time of entry (referred to in clause 5(c)) will win their choice of one of the following three prizes: the AFL Prize (valued at $6,520.00 inc GST), NRL Prize (valued at $4,120.00 inc GST) or the Bathurst Prize (valued at $5,080.00 inc GST), as follows;

AFL Prize

(a)    return economy airfares for two adults from the winner’s nearest capital city to Melbourne, departing on 24 September 2010 and returning on 26 September 2010, valued at up to $1,400.00 (inc GST) (unless the winner’s nearest capital city is Melbourne, in which case this component of the Prize is forfeited);

(b)    two nights accommodation , twin-share for two adults at 5 star hotel in the Melbourne CBD, valued at up to $1,120.00 (inc GST);

(c)    two Corporate tickets to the AFL Grand Final to be held on 25 September 2010 at the MCG, Brunton Avenue, Richmond, VIC, valued at $4,000.00 (inc GST); or

NRL Prize

(a)    return economy airfares for two adults from the winner’s nearest capital city to Sydney, departing on 2 October 2010 and returning on 4 October 2010, valued at up to $1,400.00 (inc GST) (unless the winner’s nearest capital city is Sydney, in which case this component of the Prize is forfeited);

(b)    two nights accommodation, twin-share for two adults at 5 star hotel in the Sydney CBD, valued at up to $1,120.00 (inc GST);

(c)    two Corporate tickets to the Telstra NRL Premiership Grand Final to be held on 3 October 2010 at ANZ Stadium, Edwin Flack Avenue, Sydney Olympic Park, NSW, valued at $1,600.00 (inc GST); or

Bathurst Prize

(a)    return economy airfares for two adults from the winner’s nearest capital city to Sydney, departing on 8 October 2010 and returning on 11 October 2010, valued at up to $1,400.00 (inc GST) (unless the winner’s nearest capital city is Sydney, in which case this component of the Prize is forfeited);

(b)    three nights accommodation, twin-share for two adults at 4 star hotel in Bathurst, valued at up to $1,680.00 (inc GST);

(c)    two Corporate tickets to the SuperCheap Auto Bathurst 1000 to be held 7 October 2010 to 10 October 2010 at Mount Panorama, NSW, valued at $2,000.00 (inc GST),

(the “Sales Prize”).

Failure of the winner to claim the Consumer Prize does not affect the awarding of the Sales Prize pursuant to this clause 10.

11.    The winners will be notified by telephone and by email on 6 September 2010.  The winner's details will be published in The Australian newspaper on 8 September 2010. Entrants are not required to attend or be present at the draw.

12.    In the event that the Consumer Prize has not been claimed (however the Sales Prize has been claimed) by 10:00 am AEST on 13 September 2010, a random electronic re-draw for the Consumer Prize will take place at 2:00 pm AEST on 13 September 2010 at the Draw Location, subject to any written directions given by State and Territory gaming departments. The re-draw Consumer Prize winner will be notified by telephone and in writing on 13 September 2010. The re-draw winner’s details will be published in The Australian newspaper on 15 September 2010.

13.    In the event that the Sales Prize has not been claimed (however the Consumer Prize has been claimed) by 10:00 am AEST on 13 September 2010, a random electronic re-draw for the Sales Prize will take place at 2:00 pm AEST on 13 September 2010 at the Draw Location, subject to any written directions given by State and Territory gaming departments. The re-draw Sales Prize winner will be notified by telephone and in writing on 13 September 2010. The re-draw winner’s details will be published in The Australian newspaper on 15 September 2010.

14.    In the event that both the Consumer Prize and the Sales Prize have not been claimed by 10:00 am AEST on 13 September 2010, a random electronic re-draw for the prizes will take place at 2:00 pm AEST on 13 September 2010 at the Draw Location, subject to any written directions given by State and Territory gaming departments. The re-draw prize winners will be notified by telephone and in writing on 13 September 2010. The re-draw winner’s details will be published in The Australian newspaper on 15 September 2010.
General

15.    Please note, the total Prize pool will be affected by the Sales Prize chosen by the Sales Consultant. The maximum value of the total Prize pool is $22,240.00 (inc GST), calculated on the basis that the Sales Consultant chooses the AFL Prize, valued at $6,520.00. However, if the Sales Consultant chooses either the NRL Prize or the Bathurst Prize, then the total Prize pool will be lower.

16.    Prizes are not exchangeable and are not redeemable for cash except that the Prize may only be transferred where the alternative recipient is nominated at the time the Prize winner is notified that they have won a Prize. All other costs associated with the Prize, including but not limited to spending money, meals, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included and are the responsibility of the winner and their guests. Prize must be taken on dates specified and is subject to booking and flight availability. Blackout periods may occur. The AFL Prize will be valid for use on 25 September 2010 only, the NRL Prize will be valid for use on 3 October 2010 only and the Bathurst 1000 Prize will be valid for use between 7 October 2010 and 10 October 2010 only.

17.    The winner may be required to sign a release and indemnity form in favour of the Promoter and return that document to the Promoter prior to receiving the Prize.

18.    If a winner chooses not to take the Prize or any component of it (or is unable to), the Prize is forfeited and the Promoter is not obliged to substitute the prize or any component.

19.    The Promoter accepts no responsibility for any variation in the value of the Prize.

20.    If the Promoter is unable to provide a winner with the nominated Prize, the Promoter reserves the right to supply an alternative prize of equal or greater monetary value to the nominated Prize, subject to any written directions given by State or Territory gaming departments.

21.    The Promoter accepts no responsibility for any entries not received for any reason during the Promotion Period.  Entries will be deemed to be accepted at the time of receipt by the Promoter.  No responsibility will be taken for lost, incomplete, late or misdirected entries.  The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.

22.    If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available, subject to State and Territory regulations.

23.    Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.

24.    Incomplete, illegible or incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not valid or eligible to win.

25.    The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.

26.    By entering the Promotion, the entrant understands and agrees that the Promoter may use and disclose the information provided by the entrant on the terms and for the purposes (including marketing) set out in the Promoter’s Privacy Statement available at www.telstra.com.au/privacy/privacy_statement.html or by calling 1800 039 059, as if they were a customer of the Promoter. The entrant agrees that the Promoter can continue to contact them even after this Promotion ends. If the entrant would like to access or correct the personal information that the Promoter holds about the entrant, or if the entrant does not wish the information to be disclosed, the entrant should advise the Promoter by phoning 1800 039 059.

27.    By entering into the Promotion, the entrant agrees and acknowledges that:

(a)    they may be contacted by the Promoter to provide comments about the competition and the Promoter (or an agent of the Promoter) may take photos of them;

(b)    the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to them;

(c)    the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at any time, anywhere, and by any means.  The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;

(d)    by entering the Promotion, they grant to the Promoter on creation of the Materials  a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;

(e)    they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");

(f)    they waive all Moral Rights in the Materials that arise outside Australia; and

(g)    they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.

28.    To the extent permitted by law, the Promoter shall not be liable for any loss, damage or damage whatsoever (including but not limited to direct or consequential loss) or personal injury suffered or sustained in connection with this Promotion.

29.    The Promoter accepts no responsibility for any tax liabilities that may arise from winning the Prize.
