Up to 10 entries will be chosen! "Makeover my Community" Promotion Terms & Conditions Terms and Conditions 1. Information on how to enter and the Prizes form part of these terms and conditions. Submission of an entry in the "Makeover my Community” promotion ("Promotion") is deemed acceptance of these terms and conditions. 2. The promotion commences 12:01am, (AEST) on 16 August 2010, and closes at 23:59pm (AEST) 30 September 2010 (unless extended at the Promoter's discretion) ("Promotion Period"). 3. The Promotion is conducted by ING Bank (Australia) Limited (ABN 24 000 893 292) of 140 Sussex Street, Sydney, New South Wales, Australia ("Promoter"). 4. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who participates in the Promotion not in accordance with these terms and conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. Eligibility 5. Entry into the Promotion is only open to Australian residents aged 18 years or over ("Eligible Entrants") who have been authorised by a community group, club organisation or not-for-profit organisation (“Organisation”) to submit an entry on its behalf. 6. You are not required to be or become an ING DIRECT customer to enter this Promotion. 7. Entry is not open to directors and employees of the Promoter, and each of their immediate family members (including de-facto partners and children of those partners), and the retailers, suppliers, associated companies and associated agencies of the Promoter. 8. Each Eligible Entrant will automatically be entered into the Promotion only after they have registered and completed the online entry form. How to Enter 9. To enter the Promotion, Eligible Entrants must, during the Promotion Period: (a) log onto makeoveryourbanking.com.au; (b) register to win by completing their personal details on an online entry form; (c) submitting the following information via the online entry form (“Entry”): (i) name of the Organisation on whose behalf the Eligible Entrant is submitting an entry; (ii) in 500 words or less, an explanation of the relevant community and why it needs a makeover; (iii) in 500 words of less, a description of the proposed makeover; (iv) the estimated value of the makeover (to be between $1,000 and $50,000); and (v) in 500 words or less, how make-over will benefit the community. Entries 10. By submitting an Entry, Eligible Entrants consent and grant the Promoter, a non-exclusive, royalty-free, sub-licensable, irrevocable and transferable licence to use, reproduce, and/or display and use their Entry (together with the Eligible Entrants name, State or Territory and photograph) on the ING DIRECT website and use for other promotional purposes in any way that the Promoter sees fit. In addition, winners and their associated Organisations may be required by the Promoter to take part in publicity associated with the Promotion both during and after the Promotion Period. 11. Multiple Entries are not permitted. Only one Entry per person and per Organisation is permitted. Only one Entry per valid email address and phone number is permitted. Only one Entry per browser permitted. No bulk or third party Entries are permitted and will be disqualified. 12. All Entries will be pre-approved by the Promoter before they are entered into the Promotion. 13. Eligible Entrants are prohibited from submitting entries that (i) infringe, or will cause the Promoter to infringe, the intellectual property rights (or other rights) of any third party, or which include the personal information of any third party; or (ii) contain material that is unlawful, obscene, defamatory, libellous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offence, give rise to civil liability, breach any law, or is otherwise inappropriate. The Promoter reserves the right to automatically disqualify any such Entries and the Eligible Entrant acknowledges that they may not be notified by the Promoter that they have been disqualified. 14. Eligible Entrants agree that the Promoter has the right to disqualify any Eligible Entrant who has or is suspected of violating the terms and conditions of the Promotion. 15. All entries become and remain the property of the Promoter. Judging 16. All Entries will be judged by a judging panel constituted by representatives of the Promoter and its partners to select up to 10 prize winners, in the judging panel's sole discretion. 17. Judging will take place at Level 2, 140 Sussex Street, Sydney, NSW 2000 between 30 September 2010 and 11 October 2010 (unless extended at the discretion of the Promoter). 18. The "Makeover my Community" judging panel is made up of the following representatives of the Promoter and its chosen partners: Vic Wolff Executive Director, Marketing & Communications, The Promoter Christian Bohlke Head of Branding & Communications, The Promoter Lauren Teague Experience Marketing, The Promoter Caroline Thomas Director, Caroline Thomas Consulting The Promoter reserves the right to make changes to the "Makeover my Community" judging panel. 19. This is a game of skill. Chance plays no part in determining a winner. Each Entry will be judged based on the following criteria: I. Community benefit: A number of people, rather than a single individual, will immediately benefit from the makeover at its completion II. Urgency: The makeover will positively impact the community within a 12 month time period III. Longevity: The makeover has evidence of longer term community benefits IV. Cost: The total cost of the makeover must be valued between $1000 and $50,000. V. Community clearly identified: The Entry must clearly stipulate the Organisation the funding will be allocated to, to complete the makeover. 20. Winners will be notified by the Promoter within 2 business days after the judging date as outlined in clause 21 by electronic mail and phone as nominated in their online entry form on Monday, 11 October (or at a later date if the Promotion is extended). Winners will also be announced on the Promoters website and in the next available edition of the Promoter's The Juice newsletter. Prizes 21. There will be a total prize pool (“Prizes”) of $100,000 which will be split amongst the winning Entries (if more than 1). 22. The Prizes will be allocated to up to a maximum of 10 Entries. Amounts awarded to each winning Entry may be based on the amount requested in the winning Entry, but the Promoter is under no obligation to allocate the amount requested. Regarding the determination of Prizes, the Promoter's decision is final and no correspondence will be entered into. 23. The Prizes will take the form of a bank cheque for the relevant amount payable to the winning Organisation(s). Expenditure of Prize 24. Winning Organisations must use their Prize to implement the makeover as outlined in the Entry. The Winning Organisation is responsible for obtaining all permits, approvals and licences required to implement the makeover and it must comply with all laws, regulations and local council or authority requirements. 25. The Promoter may require written proof of expenditure of the Prize from all Organisations who win a Prize by 31 October 2011. 26. Winning Organisations are required to spend their Prize by 31 October 2011 or they may be required to return all or part of the Prize. 27. If a Winning Organisation is awarded a Prize and: (a) the Organisation does not use the Prize as set out in these terms and conditions; (b) the Organisation breaches these term and conditions; (c) it is subsequently determined that the Organisation was not eligible to enter this Promotion; or (d) the Promoter's association with the Organisation adversely affects the Promoter's brand, reputation or image, the Promoter may take action to recover the amount of the Prize awarded to the Organisation. 28. It is a condition of entry that the Promoter may require the winning Organisations to enter into an agreement detailing the matters above in addition to other matters relating to expenditure of the Prize. Liability and Indemnity 29. Except for any liability that cannot be excluded at law, the Promoter (including its officers, employees and agents) excludes all liability (including in negligence) for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by Promoter) due to any reason beyond the reasonable control of Promoter; (d) any tax liability incurred by a winner or entrant; (e) any personal injury suffered or sustained as result of the receipt or use of the Prize by an Organisation or anyone participating with that Organisation. Personal Information 30. Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, Prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. 31. Unless otherwise advised, Promoter may also use the personal information for promotional, marketing and publicity purposes including sending electronic messages. Eligible Entrants should direct any request to access, update or correct information to Promoter. General 32. If there is a dispute as to the identity of an Eligible Entrant, Promoter reserves the right, in its sole discretion, to determine the identity of the Eligible Entrant. 33. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any reason beyond the reasonable control of Promoter, Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate. 34. It is a condition of accepting any Prize that, if requested by Promoter, a Prize winner must verify by statutory declaration that their winning entry complies with, and they agree to be bound by, these terms and conditions. 35. An entrant may at any time request that he or she be withdrawn from the Promotion, and Promoter must use its reasonable efforts to withdraw the entrant as soon as practicable. 36. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought. 37. The agreement created under these terms and conditions is subject to the laws of New South Wales, and entrants and the Promoter submit to the non-exclusive jurisdiction of the courts of that State. 38. If a provision of these terms and conditions is invalid, illegal or unenforceable, then to the extent of the invalidity, illegality or unenforceability, that provision must be ignored in the interpretation of these terms and conditions. All other provisions of these terms and conditions remain in full force and effect. |
