Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. The competition is open to all residents of Australia aged 18 years and over except employees of the Promoter and Nintendo Australia, their immediate families and agencies associated with this promotion. This promotion will be running in The Australian Women’s Weekly magazine. 3. Promotional commences at 00:01am AEDST on 25 August 2010 and closes 28th September 2010 at 23:59pm AEDST (“Promotional Period”). (a) To enter, individuals must during the Promotional Period send their name, address, email and phone number contact details along with their answer in 25 words or less to the question “Why does your Dad deserve these terrific gifts?” Why does your dad deserve these terrific gifts?” Send your completed entry by email to fathersdaycomp@acpmagazines.com.au (b) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4. Incomplete, indecipherable, or illegible entries will be deemed invalid. 5. Only one (1) entry permitted per person. 6. This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on literary and creative merit. The judge’s decision in relation to all aspects of this promotion is final and binding on all who enter and no correspondence will be entered into. 7. Judging will begin on 1st October 2010 at the Promoter’s premises. This promotion will be judged by a panel of judges appointed by the Promoter. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification. 11. Prizes are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified. 12. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate. 13. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoters) due to any reason beyond the reasonable control of the Promoters; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) redemption of the prizes. And/or (g) participation in the promotion. 14. All entries submitted become the property of the Promoter. Entries will not be returned to any entrant. By entering this promotion each entrant warrants to the Promoter that each entry submitted is an original artistic work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition.
