   1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

   2. Promotion commences on 16/08/2010 and ends at 11:59pm AEDST on 08/10/2010 (“Promotional Period”).

   3. Entry is only open to Australian residents. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

   4. To be eligible to enter, entrants must, during the Promotional Period, visit www.accidentalpirate.com.au, follow the prompts to the competition entry page and participate in the online survey. Once individuals complete the five (5) survey questions and submit their survey, they will be given the opportunity to complete and submit an online entry form. Only the individuals who complete the five (5) survey questions, input the requested details and submit the online entry form will be entered into the draw.

   5. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

   6. Incomplete or indecipherable entries will be deemed invalid.

   7. Only one (1) entry permitted per person.

   8. The draw will take place at The Furnace, Level 11, 60 Miller Street, North Sydney NSW 2060 on 15/10/2010 at 9:00am AEDST. Winners will be notified in writing. The Promoter’s decision is final and no correspondence will be entered into.

   9. The first one thousand (1,000) valid entries drawn will each win a $5 Video Ezy New Release DVD rental voucher. Video Ezy New Release DVD rental vouchers are valid at participating Video Ezy stores upon surrender of the voucher. If a winner is not a Video Ezy member then they will be required to sign up to become a Video Ezy member (in any Video Ezy store) in order to redeem their voucher (signing up to become a Video Ezy member will be at no cost to the winner). There is a Limit of one (1) voucher to be redeemed per member per day. Not to be used in conjunction with any other offer. Normal Video Ezy membership & hiring conditions apply. Excludes games, TV series, box sets & reserved titles. Not valid on public holidays or store discount days. Voucher expires one (1) month from the date of issue.

  10. Any ancillary costs associated with redeeming the voucher are not included. Any unused balance of the voucher will not be awarded as cash. Redemption of the voucher is subject to any terms and conditions of the issuer including those specified on the voucher.

  11. If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute that prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  12. Total prize pool value is $5,000.  Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash.

  13. A draw for any unclaimed prizes may take place on 17/01/2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing.

  14. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  15. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

  16. Except for any liability that cannot be excluded by law, the Promoter and Ezy Entertainment Marketing Pty Ltd (including its officers, employees and agents ,associated entities and all related bodies corporate) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize.

  17. The Promoter and Ezy Entertainment Marketing Pty Ltd collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to The Furnace  (an advertising and marketing agency helping with the conduct of the promotion), and may also disclose the details of any winners to the NSW lottery authority. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of Ezy Entertainment Marketing Pty Ltd.
