Welcome to the Yates Junior Landcare Sunflower Challenge Yates and Junior Landcare are encouraging you to don your gardening gloves and grow giant sunflowers this summer! Yates will be sending free sunflower seeds to all children who register for the challenge. Not only is this a fun outdoors activity for but it is a great way for you to learn about sustainability, the environment and gardening. You can grow your sunflowers at home or at school and you will need to care for their plants during the hot summer weather. Please note that log-in details for the pumpkin or watermelon challenges will not work for this challenge so even if you have taken part in previous Junior Landcare challenges you must register again to take part in the sunflower challenge. Terms and Conditions ◦The Promoter is Landcare Australia Limited (ABN 63 008 656 513), 1/6 Help St Chatswood West NSW 2067 ◦Entry instructions and prize information form part of these Terms and Conditions. By participating, entrants agree to be bound by these Terms and Conditions. Competition Entry ◦Entry is only open to: ◦Primary and Secondary schools located within Australia, including public and private schools. To be eligible, the majority of students must be 16 or under at the time of registration. Teachers can register as an entire school, particular class or group (such as a school environment group). ◦Groups or organisations (including commercial and not-for-profit) within Australia where the majority of those participating are 16 years or under at the time of registration. ◦Individuals and families with individuals aged 16 years and under at the time of registration. ◦Each registrant must have a unique email address. ◦Each registrant is entitled to one packet of seeds. ◦No replacement seeds will be sent. This includes, but is not limited to: seeds being lost by the registrant, being lost in the mail, incorrect postage details or changed postage details. PLEASE ENSURE POSTAGE DETAILS ON REGISTRATION FORM ARE CORRECT BEFORE SUBMITTING. ◦Promoter’s decisions are final, and no correspondence will be entered into. ◦Registrations open Wednesday 11th August and close no later than Friday, 22nd October 2010. Registrations are capped at 10,000 packets of seeds and will close if this number is reached prior to the closing date. ◦If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. ◦The Promoter accepts no responsibility for late, lost or misdirected registrations. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. ◦If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of an entrant. ◦The Promoter assumes no responsibility for any error, defect, delay, theft or unauthorised access to or alteration of entries. Subject to any written directions given under the applicable law, if for any reason, the competition is not capable of operating as planned, including infection by computer viruses, tampering, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, or proper conduct of the competition, then the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify or suspend this competition. The Promoter reserves the right, in its sole discretion, to disqualify any individual Prizes ◦Prizes will be awarded in three categories – tallest sunflower, largest sunflower head and best photo. There will be two school/group winners (one tallest sunflower and one largest sunflower head), two individual winners (one tallest sunflower and one largest sunflower head) and a best photo winner. ◦As the winner of the individual prize will be under 18, the prize will be awarded to his/her parent or guardian. The school/group prize will be awarded to the individual whose name appears on the registration form, who will accept the prize on behalf of the school or group. ◦If for any reason a winner does not take the Major Prize or an element of the Major Prize at the time stipulated by the Promoter, then the prize or that element of the prize will not be redeemable for cash. ◦If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of prize) with a prize to the equal value and/or specification, subject to any written directions from the regulatory authority. ◦The Promoter takes no responsibility for the loss of prizes due to incorrect or imprecise contact details provided by an entrant. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as prizes. Intellectual Property and Privacy ◦Ownership (including intellectual property rights) in all entries (including text and photos) are assigned to the Promoter upon submission and remain the property of the Promoter. ◦Participants consent to the Promoter using the participant’s name, likeness, image and/or voice in the event that they are a winner (incl. photograph, film, file and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), Junior Landcare and Landcare Australia. Judging Criteria ◦Registrations are required to log-on and enter the height of their sunflower and diameter of their sunflower head once the sunflower reaches maturity. They are also required to upload photographs of the sunflower being measured. Participants who fail to do so risk invalidating their entry. ◦The judging criteria will be the height of the plant or the size of the flower head. If more than one sunflower falls within this range all within range will be verified unless this exceeds the Promoter’s capacity. Should there be multiple sunflowers within the finalist range a winner will be selected at random and verified. ◦The tallest sunflowers and largest sunflower heads will be verified at four stages during January and February. The largest measurements recorded over all stages will be the final winners. ◦The most creative photograph will be chosen by independent judges and is at the complete discretion of the judging panel. Any decisions of the judging panel are final. ◦The finalists in each category will be verified by an independent third party. Verification will be done where possible by a landcare group or NRM staff member in that area. In the case that there is no landcare group or NRM staff nearby or willing to assist another suitable local representative or a Yates associate or Yates or LAL staff member will verify the two finalists. Using this Website ◦Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall render an entry invalid. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. ◦The Promoter shall not be liable for any loss or damage suffered or sustained (including but not limited to consequential loss, loss of revenue, loss of profit or economic loss), including for personal injury or property damage suffered or sustained, as a result of accepting any prize or participation in any competition or prize, except for any liability which cannot be excluded by law. ◦Any costs associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. None of ours sprouted, even in the ever changing Melbourne weather of hot, cold, rain, then hot again (that all the other plants are loving).
