In these terms and conditions: (a) Existing Centre Member means a person who is registered on any of the Centres membership databases prior to the commencement of the Promotional Period; and (b) Referred Centre Member means any person referred by an Existing Centre Member who is not an Existing Member and who registers on any of the Centre databases during the Promotional Period. 7) Officers, employees and immediate families of officers and employees of the Promoter, the associated companies and contractors of the Promoter, retailers of the Centre and any other agencies associated with this Competition are ineligible to enter. 8) There is no limit to the number of people that an Existing Centre Member can refer. 9) Existing Centre Members may enter the Competition by completing an entry form on-line, in response to an email generated from the Centre they are subscribed to, and referring a person who is not an Existing Centre Member to join that Centre’s database (‘Referred Person’). After the Referred Person has joined the Centre’s database in accordance with these terms and conditions of entry, both the Existing Centre Member and Referred Person are entered into the prize draw. Entrants must clearly state their full name, address, phone number, valid email address and any other required contact details on the entry form. 10) The prize consists of a AU$2,000 in Centre gift card(s) from the Centre which the winner is a registered member and, at the discretion of the Promoter, may be presented to the winner as one (1) x $2000 gift card or as eight (8) x gift cards valued at $250 each. The total prize value is AU$2,000. All other ancillary costs associated with the Prize are the responsibility of the winner (‘the Prize’). 11) The winner of the Competition will be determined by electronic draw. The first valid entry drawn will win the Prize. The draw will take place at the BoilerRoom, 6 Bay Street Port Melbourne, Victoria, 3207, Australia at 11:30am AEDST on 14 October 2010. The winner need not be present at the draw. 12) The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. 13) The winner of the Prize will be notified by email within 2 days of the draw. The name and address of the winner will also be published at www.cfsgam.com.au/assetmanagement on 20th October 2010. 14) The Prize must be collected from the Centre Management office of the participating Centre that the entrant is registered with at a date agreed upon by Centre Management and the winner. Failure to collect the Prize within three month’s time of the draw will result in the Prize being forfeited. The Prize is non-transferable, non-exchangeable and cannot be redeemed for cash. 15) A draw for the Prize, if unclaimed within three month’s time of the draw, may take place on 17 January 2011 at the same time and place as the original draw to award the unclaimed Prize, subject to any directions from a regulatory authority (‘Second Draw’). The winner of the unclaimed Prize will be notified by telephone and the Promoter will record their address details so that the Prize may be awarded within 2 days of the Second Draw. The winner will also be notified in writing. The winner’s name, if any, will also be published at www.cfsgam.com.au/assetmanagement on 21st January 2011. 16) Entry into the Competition will not be permitted if: (a) a Referred Person is an Existing Centre Member prior to the Promotional Period; or (b) the Existing Centre Member or Referred Centre Member unsubscribes from the Centre database before the Competition is drawn. 17) An entry that is incomplete, illegible or non-compliant with these terms and conditions is invalid and will not be accepted or considered. 18) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age, place of residence and place of employment) or claims for the Prize and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry or claim for the Prize which is not in accordance with these Terms and Conditions of Entry. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 19) An entry is only considered valid if the Entrant agrees to participate in any public relations activities the Centre undertakes about the Prize if the customer wins a Prize, including photographs for press and other media promotions. 20) The winner will be required to provide proof of identity on acceptance of the Prize. 21) It is a condition of entry that the entrant consents to the Centre using the entrant's name, likeness, image and/or voice in the event they are the winner of the Prize (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products or services, distributed and/or supplied by the Promoter or the participating Centres. 22) If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Competition, as appropriate. 23) Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these terms and conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize. 24) The Promoter's decision is final and no other correspondence will be entered into. 25) By entering the Competition, an entrant releases and indemnifies the Promoter (including its officers, employees and agents) from and against all actions, liabilities, penalties, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Competition or winning or failing to win a prize, or using or permitting any other person to use the prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable. 26) The Prize will be valid for redemption between 20 October 2010 until 19 October 2011 (‘Validity Period’).
