WHO CAN ENTER
1. Subject to the terms and conditions of this competition, entry is open to all
Australian residents aged 18 years of age or over (‘Eligible Entrant’).
RESTRICTIONS ON ENTRY
2. Tasmanian Government employees and their immediate family members or of
the companies (including but not limited to printers, suppliers and providers) and
agencies associated with this Competition are ineligible to enter.
3. The Promoter reserves the right, at any time, to verify the validity of entries and
entrants (including an entrant’s identity, age and place of residence) and to
disqualify any entrant who submits an entry that is not in accordance with these
Terms and Conditions or who tampers with the entry process. Failure by the
Promoter to enforce any of its rights at any stage does not constitute a waiver of
those rights.
COMPETITION PERIOD
4. The Competition opens at 9:00am (AEST) on Thursday 23rd September 2010 and
closes at 11:59pm (AEST) on Wednesday 1st December 2010.
HOW TO ENTER AND ENTRY CONDITIONS
5. To enter, Eligible Entrant’s must go to www.discovertasmania.com, follow the
prompts and complete the online competition entry form and state 25 words or less
why they want to win a secret escape to Tasmania.
6. An Eligible Entrant may enter multiple times, however each entry must be
submitted separately and in accordance with the entry requirements.
7. Entries will be deemed to be accepted at the time of receipt and not at the time of
transmission.
8. Entries must comply with all applicable laws and not infringe any copyright or other
intellectual property or contain any material that may be off ensive or defamatory.
9. Entries that do not comply with these terms and conditions will be deemed
ineligible.
10. Incomplete, ineligible or incomprehensible entries will not be accepted. The
Promoter accepts no responsibility for lost, incomplete, incorrectly submitted,
delayed, corrupted or misdirected entries, claims or correspondence destruction,
transmission interruption, communications failure or otherwise. By entering
the competition, entrants acknowledge that the Promoter has no control over
communication networks or lines and accepts no responsibility for any problems
associated with them, whether due to traffi c congestion, technical malfunction or
otherwise. Entrants further agree that they will not hold the Promoter liable for any
consequences of user error including (without limitation) any costs, fees, expenses
incurred.
JUDGING
11. All valid entries received will be entered into the prize draw and the prize winner
selected by a judge nominated by the Promoter on Monday 6th December
2010. One single entry will be selected to receive a prize according to criteria
pre-determined by the Promoter. The decision of the Judge is final and no
correspondence will be entered into. This is a game of skill and no chance plays no
part in determining the winner.
PRIZE
12. The prize winner will receive the opportunity to create their own itinerary for a trip
to Tasmania. This will be done through contact with a ‘Tassie Expert’ nominated
by Tourism Tasmania who will assist them in putting together their own holiday
itinerary. To contribute towards this holiday, the prize winner will receive the
following:
a. 5 nights’ accommodation with Innkeepers Tasmania for two persons;
b. Two adult return economy class airfares to Tasmania from any capital city in
Australia (prize the prize winner and their travelling companion, if applicable,
must travel together);
c. 6 days car hire from Red Spot Car Rental. CDAR class (small automatic) for
drivers of 21 years and over; and
d. Up to $500.00 credit towards an ‘experience’ of their choice which will be
booked through a Tassie Expert nominated Tourism Tasmania.
PRIZE RESTRICTIONS
13. The prize must be taken within 6 months of the prize winner being notified and may
be subject to additional conditions which will be passed on to the prize winner at
the time of accepting the prize.
14. Accommodation, car hire and experiences are subject to availability and cannot
be taken during Tasmanian school or public holidays. In addition please note, the
prize cannot be taken between the following dates:
a. 24 December 2010 and 31 March 2011; or
b. 22 April and 25 April 2011.
15. Unless expressly stated in these terms and conditions all other expenses are the
responsibility of the prize winner (and their travelling companion) including but
not limited to meals, spending money, transport, drinks, incidentals, mini-bar,
laundry, room service, telephone calls, activities, gratuities, service charges,
travel insurance, travel costs (including petrol and insurance), pre- and postaccommodation,
activities or excursions and all other ancillary costs.
16. The prize (or any component of the prize) must be taken as off ered and are not
exchangeable, transferable, redeemable for cash or for resale. In the event for any
reason the prize winner does not take any component of the prize within the time
stipulated or in accordance with these terms and conditions then that component
will be forfeited by the prize winner and cash will not be supplied in lieu of that
element of the prize. Where a component of the prize is unavailable for any reason,
the Promoter may substitute another comparable component of equal or higher
value as determined by the Promoter in its sole discretion.
17. Prize values are GST inclusive and are in Australian dollars. Prize values are the
recommended retail value as provided by the supplier and are correct at time of
printing. The Promoter accepts no responsibility for any variation in prize value.
18. Eligible Entrants ordinarily residing in Tasmania will forfeit the airfare component of
the prize.
19. The prize winner agrees to participate in all reasonable promotional activities as
requested by the Promoter, unless otherwise notifi ed to the contrary at the time of
acceptance of the Prize.
NOTIFICATION OF PRIZE WINNER
20. The prize winner will be notifi ed by email and their name will be published on the
discovertasmania.com website by 5pm on Monday 6th December 2010.
COLLECTION OF PERSONAL INFORMATION
21. The Promoter collects personal information, as that term is defi ned in the Personal
Information Protection Act 2004 (Tas) in order to conduct the promotion and may,
for this purpose, disclose such information to third parties, including but not limited
to, prize suppliers or as otherwise required by law. Entry is conditional on providing
this information and the prize winner consenting to the use by the Promoter and/
its its competition partners of the prize winner’s name, his or her State of residence
and any other entry details for promotional, marketing and publicity purposes
including the sending of electronic messages. Entrants should direct any requests
to access update or correct information to the Promoter. All entries become the
property of the Promoter.
DISCLAIMER AND RELEASE
22. The Promoter makes no representations or warranties as to the quality, suitability
or merchantability of any goods or services off ered as prizes. To the fullest extent
permitted by law, the Promoter is not liable for any loss suff ered to the prize winner
and, where applicable, to any person accompanying the prize winner or any of their
property by reason of any act or omission, deliberate or negligent, by the Promoter
or its employees or agents, in connection with the arrangement for the supply, or
the supply, of goods and services by any person to the prize winner and, where
applicable, to any person accompanying the prize winner. To the fullest extent
permitted by law, any liability of the Promoter or its employees or agents for breach
of any rights that the prize winner or any person accompanying the prize winner is
limited to the payment of the costs of having the prize supplied again.
THE PROMOTER
23. The Promoter is the Crown in Right of Tasmania (including Tourism Tasmania)
represented by the Department of Economic Development, Tourism and the Arts of
Level 2, 22 Elizabeth Street, Hobart, Tasmania, 7001 (ABN 84 531 577 304). In these
Terms and Conditions, Tourism Tasmania means the body corporate established
pursuant to section 4 of the Tourism Tasmania Act 1996 (Tas) (ABN 58 800 480 938)
and forming part of the Department.
