CONDITIONS OF ENTRY
1.Instructions on “How to Enter” form part of these Conditions of Entry. The competition is open to all residents of Australia except employees of the Promoter, their immediate families and agencies associated with this promotion. By participating, entrants agree to be bound by these conditions. Entries must comply with these conditions to be valid.

The promotion commences 12.00am (AEST) September 13, 2010 and ends 11.59pm (AEDST) November 26, 2010. Entrants will be required to answer and complete the online entry form at www.australianalmonds.com.au/recipe along with an original recipe that includes almonds. No responsibility is accepted for late, lost, incomplete, illegible or misdirected entries.

2.This is a game of skill and chance plays no part in determining the winners. All valid entries will be judged individually on their merits, based on creativity and originality. The judge’s decision is final and no correspondence will be entered into.

3.All entries must include the entrant’s name, address, postcode, daytime phone number (including area code), mobile phone number (if applicable), email address and date of birth in order to be eligible for entry. All entries must be original and must not incorporate any material which has been previously published. Incomplete entries or those with copyright, pre-used, defamatory or offensive content will be ineligible to win the prize.

4.Judging will take place at the Promoter’s premises (9 William Street, Berri SA 5343) on December 6 2010 at 11:30am (EDST). This promotion will be judged by a panel of judges appointed by the Promoter. All valid entries received within the Promotional Period will be entered into the judging.

5.The winners will be notified by phone and in writing via email within five (5) working days of the judging and the names of the prize winners will be published on the promoters website at www.australianalmonds.com.au on 18/12/10.

6.The five most creative entries, as determined by the judges, will each win a $1,000 AUD cash prize. Total prize pool valued at $5,000 AUD. The prize will be awarded to the winner in the form of a cheque made out to the name of the winner. Prize is not transferable or exchangeable and cannot be taken as cash. The Promoter accepts no responsibility for late, lost, misdirected entries interrupted communications or unavailable network server or other connections, failed telephone, mid-delivery or computer transmissions or other errors of any kind, whether human, mechanical or electronic. In the event that one or more of the winner’s is under 18 years of age, the prize(s) will be awarded to a parent or legal guardian of the entrants.

7.The prize winners must at the Promoter’s request, participate in any marketing and promotional activity in relation to winning the prize, free of charge, and consent to the Promoter using their name and image in such promotional material.

8.By entering the Competition, each entrant warrants that their entry, including their recipe, is their own original work, and that they own all rights, including copyright in all elements of their entry. Each entrant indemnifies the Promoter in the event that this warranty is false.

9.Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Conditions of Entry; and/or (e) any tax liability incurred by a winner or entrant.

10.Subject to State and Territory law, in the event of technical malfunction or any other matter that interferes with or has the potential to interfere with the proper conduct of the promotion, the Promoter reserves the right to suspend, cancel, modify or terminate the Promotion.

11.All entries become the property of the Promoter and may be communicated to the public by the Promoter or used for promotional purposes, subject to the Promoter’s privacy policy which is available at www.australianalmonds.com.au. By entering the Competition, the Prize winners agree to the use of their name, image, audio-visual recording and/or photograph/s without compensation, and agree that the Promoter will own copyright in any such images, audio-visual recordings and photograph/s.

13.Details from entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) and for promotional purposes surrounding this promotion.
