Terms and Conditions
1. Information on how to enter form part of these conditions of entry. Participation in this competition constitutes acceptance of these terms & conditions of entry.

2. Entry is open to residents of Australia who are 18 years of age and over. Employees & their immediate families of the Promoter, the Promoter’s associated companies and agencies are ineligible to enter

3. The promotion commences at 12.01am EDT on 18 October 2010 and closes at 11.59pm EDT on 28 February 2011 (Promotion Period).

4. To enter, eligible entrants must, during the Promotional Period log on to http://www.news.com.au/travel/world and complete the entry form to be entered in the competition. All eligible entries will be entered into the applicable draw. There is a maximum of one entry per person in each draw and a maximum of two entries for the entire promotion period.

5. The two draws will take place at 3.00pm on 2 March 2011 at 15 Grosvenor Street, Neutral Bay, NSW 2089. All entries received between 12.01am and 11.59pm from the Draw Start Date to the Draw Close Date (as outlined in the table below) will be entered in the applicable draw. All winners will be notified by telephone, email and announced at http://www.news.com.au and in The Australian newspaper on 9 March 2011.

6. The first thirteen (13) eligible entries drawn in each draw will be the winners. The first 4 eligible entries drawn will receive the applicable Major Prize (Prizes 1-4) and the next 9 eligible entries drawn will each receive the applicable Minor Prize (Prizes 5-13). The prizes will be awarded in the following order in each draw;

2   Marine Major Prize: The 2nd entry drawn will learn the skills to experience the sensational marine life of Norfolk Island with a Beginner Scuba lesson. The winner will also receive a full wetsuit steamer so they can take to the waters any time of the year. Lesson includes instruction in a pool and open water dive which will take place at a location stipulated by the promoter at a location convenient to the winner. Travel to and from the lesson will be at the expense of the winner.    $1,000

3   Nature and Bush Major Prize: The 3rd entry drawn will receive an Australian bush package of the latest camping gear including 4 person tent, 2 camping mattresses and 2 sleeping bags. (Includes nation-wide delivery)   $1,000

4   History and Culture Major Prize: The 4th entry drawn will have their family’s history come alive with beautiful canvas prints of their favourite photos. Available in various sizes, (Includes nation-wide delivery)   $1,000

Total value of all Prizes in each Draw is $4,990.
Total value of all prizes awarded in the promotion is $9,980.

7. The Promoter accepts no responsibility for any variation in the value of a Prize. A Prize is not transferable or exchangeable. A Prize is not redeemable for cash and must be taken as offered. In the event that an element of the Prize is not available, the Promoter reserves the rights to substitute a prize of equal or greater value, subject to the written directions of any relevant authority. All prizes will be selected by the Promoter. Prize supplier terms & conditions apply.

8. Acceptance of the Prize constitutes consent on the Prize Winner’s part to allow the use of the Prize Winner’s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation, except where prohibited by law.

9. If a Prize is unclaimed by 4:00pm AEST on 2 June 2011, a second chance draw will be held at 2.00pm on 23 June 2011 15 Grosvenor Street, Neutral Bay, NSW, 2089, subject to any written directions given by State Authorities. The winner/s of a second chance draw/s, if any, will be notified by phone and in writing and will also be published in The Australian newspaper on 30 June 2011.

10. The Promoter’s decision is final. No correspondence will be entered into. All decisions and actions of the Promoter and its staff will be exercised according to their absolute discretion.

11. The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, who submits an entry which is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of the Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.

12. The Promoter takes no responsibility for lost, late, incomplete or misdirected entries.

13. The Promoter makes no representations or warranties as to the quality/suitability/merchantability of any of the goods/services offered as the Prize. To the extent permitted by law, the Promoter, its related bodies corporate and their associated agencies, and any company associated with the Promotion, will not be liable for any loss or damage whatsoever to person or property and including, but not limited to, direct (including economic) or indirect/consequential (including economic) loss by reason of any act or omission, deliberate or negligent, in connection with the arrangement for supply, or the supply, including any damage in transit of any goods/services by any person to the Prize Winner or for personal injury suffered or sustained, as a result of accepting, taking part in and/or using the Prize. Subject to the foregoing, if the Promoter is liable for any claim by an entrant, including a claim arising from the Promoter’s negligence, the Promoter’s liability for any such claim will not exceed $1,000.

14. The Promoter accepts no responsibility for any tax implication that may arise from the Prize winnings. Independent financial advice should be sought by a Prize Winner prior to accepting a Prize.

15. If for any reason the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes, which corrupt or affect the fairness or integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

16. All entries become the property of Promoter and may be used for promotional purposes without any further reference, payment or other compensation to the entrant. Any opt-ins becomes the property of Norfolk Island Tourism. The Promoter may use information it collects in relation to you to provide you with information regarding further offers, promotions or goods and services provided by the Promoter. If you elect to receive information from third parties, the Promoter may also disclose your personal information for that purpose. You consent to the Promoter’s use and disclosure of information about you as contemplated by this paragraph. To remove your information from the Promoter’s records, please contact the promoter. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information that the Promoter holds about them or obtain a copy of the Promoter’s privacy policy by contacting the Promoter.

17. Each winner consents to the use of his or her name and state of residence for promotional and marketing purposes and agrees to participate in reasonable promotional activities as requested by the Promoter.

18. All entrants agree to have competition answers used for publicity purposes.

19. Third parties may provide Promoter with services which permit the running of the Promotion. In doing so and for that purpose only, such third parties may collect your details and provide them to the Promoter and others for that same purpose. If you are not willing for this to occur you cannot participate in the Promotion.

20. Each Prize Winner acknowledges that the Prize may be subject to additional terms and conditions imposed by third parties. The Prize Winner must become acquainted with any such additional terms and conditions prior to taking the Prize. The Promoter does not accept any responsibility and is not liable for any additional conditions imposed on the taking of the Prize, nor for the breach of those conditions by any person.
