General Terms and Conditions ‘Win a Volvo’ 1. Information on how to enter and the prize form part of these Terms and Conditions. Entry into this promotion is deemed acceptance of these Terms and Conditions by each entrant. 2. To be eligible to enter the promotion, eligible entrants must purchase a specially marked promotion pack of Carr's crackers from a participating retail outlet during the promotional period. Eligible entrants must then visit www.ilovecarrs.com (http://www.ilovecarrs.com) and follow the prompts to enter the Carrs win a Volvo promotion. Individuals must fully complete the online entry form, including providing all of the required information. 3. Entry is only open to Australian residents aged 18 years or over with a full and valid Australian driver's license. Employees and their immediate families of the Promoter and its agents associated with this promotion are ineligible to enter. 4. Promotion commences 12:01am AEST on 20/09/2010 and closes at 11:59pm AEDST on 31/12/2010. A draw for the prize will be conducted at Anisimoff Legal, 4/448 St Kilda Rd, Melbourne VIC 3004 on 10/01/11 at 12.01pm. The first valid entry drawn will win the prize. The winner will be notified by email (to the address provided when entering) within seven working days of the competition closing date. The winner's name will be published in The Australian on 31/01/11. The name of the winner will also be published on the Promoter's website: www.ilovecarrs.com (http://www.ilovecarrs.com) from 31/01/11 to 28/02/11. 5. Entrants must retain a copy of their original purchase receipt(s) clearly showing the purchase of the specially marked Carrs crackers during the promotional period and the original specially marked Carrs promotion pack as proof of purchase and up until such time as the winner is notified. If an entrant is unable to provide proof of purchase for the prize claim when requested by the Promoter, then the prize claim will be ineligible and deemed invalid. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the promotional period but prior to entry. 6. Total prize value is up to $44,950 and includes one Volvo C30 T5 S, Geartronic (automatic), five cylinder 2.5 litre turbocharged car, 2010 model, registration, third party insurance, stamp duty and dealer delivery charges (which may vary State by State). The prize is not transferable or exchangeable and cannot be taken as cash or for any goods or services unless expressly agreed to in writing by the Promoter. The Promoter accepts no responsibility for any additional costs or requirements including but not limited to tax or social security implications that may arise from acceptance of the prize winnings. The Promoter may, in its absolute discretion, accommodate the winner's colour preference (excluding metallic options), subject to availability. The winner must collect the prize from their nearest authorised Volvo dealership. 7. As a condition of accepting the prize, the winner must sign legal documentation as and in the form required by the Promoter and prize supplier in their absolute discretion, including but not limited to a legal release and indemnity form. 8. In the event that the prize remains unclaimed three (3) months after the original draw, a draw for the unclaimed prize may take place on 11/04/11 at the same time and place as the original draw, subject to any written directions from a regulatory authority. The Winner will be notified by email within seven days of being drawn. Winner's name will be published in The Australian on 29/04/11. 9. The Promoter's decision is final and no correspondence will be entered into. 10. In the event that the prize is not available despite the Promoter's reasonable endeavors to procure the prize, the Promoter reserves the right to substitute a prize of equal recommended retail value, subject to any written directions from the relevant Regulatory Authorities. 11. The Promoter reserves the right, at any time, to verify the validity of entries and entrants, including an entrant's identity, age and place of residence and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 12. Multiple entries permitted, subject to the following: (a) only one (1) entry permitted per qualifying purchase; and (b) each entry must be submitted separately and in accordance with entry requirements. 13. Incomplete entries will be deemed invalid. 14. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. 15. Except for any liability that cannot be excluded by law, the Promoter including its employees and agents excludes all liability (including negligence), for any loss or damage, including loss of opportunity; whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction including but not limited to problems arising from worms, trojan horses, viruses or other corruption of any computer by whatever source or reason (whether or not under the Promoter's control): (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim (c) that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) or use of the prize. 16. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 17. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities (for the purpose of conducting the promotion only). Entry is conditional on providing this information.
