By taking part in this promotion participants agree to be bound by these conditions of entry. The Promotion commences at 12.01 am (Australian Eastern Daylight Saving Time (“AEDST”)) on 27 October 2010 and entries close at 11.59 pm (AEDST) on 24 December 2010 (“Promotion Period”). The Promotion is only open to "Eligible Entrants", being individuals who: are aged 18 years or older; and are residents of Australia; and submits each entry for this Promotion in accordance with these conditions of entry; and enters this Promotion for himself or herself exclusively and not on behalf of any other person or group of persons, including a syndicate of persons; and are not employees of the Promoter or any of its related corporations or any of its agencies associated with the Promotion; and are not employees of Arctic Wolf Pty Ltd; and are not a spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin of such an employee; and have not won a prize/prizes valued, either individually or collectively, at more than $5,000 from the Promoter, or in any promotion run by the Promoter, in the prior 12 months; and have not been discovered to have used or attempted to use any more than one name in order to qualify to win any contest run by the Promoter except in the case of a legal change of name; and have not been discovered to have breached conditions of entry of previous contests run by the Promoter. All entrants acknowledge that the Promoter can rely on these conditions of entry even if the Promoter only learns of a person's ineligibility after the Promoter has awarded the prize to the ineligible person. Return of the prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs. HOW TO ENTER To participate in this Promotion, an Eligible Entrant must purchase any product from the Chamilia range from any participating retailer or from any Australian authorised Chamilia online stockist during the Promotion Period ("Qualifying Purchase"), visit www.chamilialastingmemoriespromo.com.au, follow the prompts to the competition entry page, complete the online entry Form, and describe in 25 words or less “why Chamilia will make a lasting Christmas memory for you or that someone special”, and submit the fully completed online entry from so that it is received by the Promoter by 11.59 pm (AEDST) on 24 December 2010. Any internet costs associated with accessing the Promotion website is the responsibility of each entrant and are dependent on the Internet service provider used. All entries become the property of the Promoter. CRITERIA AND JUDGING The judging of the entries will commence on 10 January 2011 at 10.30 am (AEDST) at Brandwave office, Suite 23, Level 11, 809-811 Pacific Highway, Chatswood NSW 2067. Each entry will be judged by a panel of judges on the basis of originality and creativity. One of every seven entries received, up to a maximum of 150 entries, will be selected by the panel for inclusion in a finalists’ list on the basis that they are deemed good enough to be in the running for the major prize. The major prize winner will be selected on the basis of the entry which best demonstrates originality and creativity. The other finalists will receive minor prizes. This is a game of skill, and chance plays no part in determining the prize winners. The prize winners will be notified by phone and mail, and the major prize winner will have their details (initial, surname and state) published in The Australian newspaper on 28 January 2011. Prize winners must claim their prizes within four (4) weeks after they have been notified of their prizes. Unclaimed Prize Judging: If an original prize winner does not claim their prize by 11.59 pm (AEDST) on 23 February 2011, they will automatically forfeit their right to the prize or if the prize winner’s entry is deemed invalid or a claimed prize is forfeited for any reason, then the next best entry will be deemed as a winning entry. The process will continue until the prize has been claimed or entries are exhausted whichever occurs first. The winner of the unclaimed major prize will be notified by mail and phone and will have their details (initial, surname and state) published in The Australian newspaper on 2 March 2011. All qualifying entrants, being those whose entries are judged to be good enough to be in the finalists’ list, will each receive a minor prize, and go in the competition to win the major prize, being accommodation for two staying for two nights in a pool view room on Hayman Island Resort including transfer fees and $1,000 towards the cost of the return air flights. PURCHASE & ENTRY REQUIREMENTS Offer available on all Chamilia branded products. Multiple entries accepted subject to: each entry must be associated with a separate Qualifying Purchase (as detailed above); and a limit of two (2) entries are permitted per person or household per day; and a total of 100 entries per person and or household for the Promotion Period. All entries in the Promotion may be subject to verification by the Promoter, including: All Eligible Entrants MUST retain a photocopy of their purchase receipt(s) and product barcode(s) (evidencing their Qualifying Purchase) for all entries submitted as proof of purchase ("proof of purchase"). Eligible Entrants may be required to, within 7 days of being asked to do so, send their proof of purchase in order to validate their entry(ies). A reply paid address will be provided to entrants. Entrants must also retain a photocopy of the proof of purchase submitted for verification purposes. The Promoter recommends that Entrants send their proof of purchase via registered post, however, this is not a condition of entry; and All Entrants MUST also deliver to the Promoter (by a means determined by the Promoter) copies of any other documents the Promoter may request establishing eligibility to enter or win, including but not limited to evidence of age, residence or identity. The Promoter may make one or more requests for such documents. Once the identity of documents available is established, an Entrant must deliver requested copies within 7 days of being asked to do so. At the Promoter's request, an Entrant MUST also, within 7 days of being asked to do so, allow the Promoter to inspect and copy the original of any such document. The Promoter may, at its absolute discretion, disqualify any entrant/s and declare any or all entries made by an entrant/s invalid if the entrant/s: Tampers with the entry process, including the use of any automated entry software or any other mechanical or electronic means that permit the Entrant to automatically enter repeatedly; or Shares proof of purchase requirements in order to gain competitive advantage over other Entrants; or Tampers with the operation of the Promotion or web site; or Is found to be using multiple aliases or email addresses; or Acts in a disruptive manner; or Fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction; or Fails to produce items as required or produces items that, in the Promoter's opinion, are illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way; or Acts in violation of these conditions of entry. If an Entrant is found to be in breach of these terms and conditions they may be ineligible to enter all future promotions run by the Promoter at its absolute discretion. A message will appear online to let them know if they have submitted a valid entry. Response times may vary and are subject to network coverage and availability and/or other technical problems. UNRECOGNISED CODE If any Entrant has submitted an entry with an incorrect code, a message will be displayed online highlighting that their code is not recognised by the database. They will then be asked to check the code sent against the product barcode and to resubmit their entry. There is an automated limit on unrecognised barcodes. An Entrant may be blocked, at the discretion of the Promoter, from submitting any further barcodes once the limit has been reached. Errors and omissions accepted at the Promoter's discretion. PRIZES There is one (1) 'major prize' which comprises of accommodation for two staying for two nights in a pool view room on Hayman Island Resort including transfer fees and $1,000 towards the cost of the return air flights (“Accommodation”), valued at a maximum of $2,580.00 for two (2) adults. In order to be entitled to the Accommodation, the major prize winner and their nominated companion must comply with these conditions. The major prize winner and their companion must be 18 years of age or older, All aspects of the Accommodation are for the two (2) adults staying in the room together. All components of the Accommodation must be taken together as a single stay to be booked by the Promoter. Any part of the Accommodation that is not taken for any reason is forfeited. Notice of intent to use the Accommodation must be received at least 30 days prior to proposed Accommodation dates. The Accommodation cannot be used during gazetted school holiday periods in any Australian State or Territory. The Accommodation is also subject to room availability. The prize must be taken within 12 months of the major prize winner’s notification date and no extension of the validity date of this prize will be permitted. The prize must be taken as offered; no correspondence will be entered into. Once the Accommodation been arranged by the Promoter, any changes to the Accommodation arrangements will be at the expense of the major prize winner. No compensation will be payable if a winner or their guest is unable to use the major prize (or any part of it) as stated for whatever reason. The Accommodation cannot be exchanged for other accommodation at other locations. The Accommodation does not (except as expressly stated) include: any other accommodation; any incidental hotel charges (such as mini-bar charges, telephone calls, in house movies, food and beverages); any insurance (such as travel or health cover); any vaccinations or other medical or health related services; any other ancillary costs which may be incurred by holidaymakers. The major prize winner must hold a valid credit card and present it on check-in at the Accommodation to cover any incidental hotel charges. Use of the Accommodation is subject to such other terms and conditions as may be imposed by those involved in staging the Accommodation and/or those involved in providing other goods or services included in the prize ("Third Party Terms"), and the major prize winner and their nominated companion bear all risks associated with failure to comply with any of them. They will be required to maintain an acceptable standard of behaviour while a participant in the program. The Promoter assumes no liability (and will provide no compensation) to the major prize winner and/or their nominated companion who, as a result of any failure to comply with any Third Party Terms: is unable to use the Accommodation (or any part of it); or suffers any other loss or damage. The major prize winner and their nominated companion must, if requested by the Promoter, agree to and sign: an eligibility form confirming their compliance with these conditions and eligibility to accept the prize and/or participate in the prize; and a liability release, waiver and/or indemnity in respect of their use of the Accommodation, in a form determined by the Promoter and in favour of the Promoter and/or any person or other entity associated with this Promotion or the Accommodation. A person who does not comply with this condition forfeits their prize and/or right to participate in the prize. “Minor prizes” - There are one hundred and fifty (150) Chamilia beads available while stocks last at a minimum retail value of $33.00. Total Prizes valued at $8,500,00. Limit of one (1) prize may be awarded per winning household. If for any reason a prize winner does not take a prize or an element of a prize at the time stipulated by the Promoter then that prize or element of the prize will be forfeited by the winner and cash will not be supplied in lieu of that prize or element of the prize. Where relevant, the prize winners should look to the manufacturer of products and the provider of services awarded as prizes for all warranties. However, these conditions of entry do not exclude or limit the application of any statutory provision (including a provision of the Trade Practices Act 1974) where to do so would contravene that statute or cause any part of these terms and conditions to be void. Minor Prizes will be delivered to the residential addresses supplied by the prize winners. Where a prize is unavailable for any reason, the Promoter may substitute that prize with another item of equal or higher value as determined by the Promoter, subject to the approval of the respective regulatory gaming authorities, where required. The Promoter accepts no other liability or responsibility for any loss incurred by a prize winner or any other party if any prize (or part of a prize) is unavailable for any reason. To the full extent permitted by law, the Promoter, its associated companies and agencies ("Relevant Party") exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any Eligible Entrant and/or prize winner. The prize winners(s) must, at the Promoter's request, participate in all promotional activity (such as publicity and photography) surrounding the winning of the Prize, free of charge, and they consent to the Promoter using their name and image in any promotional material. The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought by prize winners. A prize winner must, if requested by the Promoter, agree to and sign: an eligibility form confirming their compliance with the Conditions of Entry and eligibility to accept a prize; and/or a liability release in a form to be determined by the Promoter at their discretion. GENERAL Confirmation of printing errors and other quality control matters will not be used as a reason for refusing payment of a prize. All entries are deemed to be received at the time of receipt in the Promotion database and NOT time of transmission by the Entrant. No responsibility accepted for late, lost or misdirected entries. At the Promoters discretion, any contact details incorrectly entered by an Entrant may invalidate the relevant entry. The judges’ decision is final and no correspondence will be entered into. Incomplete, indecipherable or illegible entries will be deemed invalid. Entries not completed in accordance with these terms and conditions or received after close of entry will not be considered. Incomplete entries will be disregarded. The Promoters decision in relation to any aspect of the Promotion is final and binding on every person who enters. No correspondence will be entered into. If for any reason this Promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right to cancel, terminate, modify or suspend or recommence the Promotion, subject to the approval of the authorities that have issued permits for its conduct. The Promoter assumes no responsibility for: any error, omission, interruption, or delay in the operation or transmission of any communication sent to (or by) the Promoter or any Entrant whether caused by problems with communication networks or lines, computer systems, software or internet service providers, congestion on any carrier network or otherwise; Any theft, destruction or unauthorised access to, or alteration of such communications; any problem with, or technical malfunction of, any computer system or other equipment used for the conduct of the Promotion; any incorrect or incomplete information which may be communicated in the course of the administering this Promotion. CAUTION: Any attempt to deliberately undermine the legitimate operation of this Promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. PERSONAL INFORMATION All entries become the sole property of the Promoter. The information provided by entrants will be used by the Promoter for the purpose of conducting this Promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this Promotion or communicating with entrants. Entrants consent to the storage of their personal information on the Promoter's database and the Promoter may use this information for future Promotion, marketing and publicity purposes regarding its products, including contacting the Entrant via electronic messaging unless an entrant has marked the "opt-out" box on the online entry form. Entrants can request to access, update or correct any personal information about them held by the Promoter or may request that they not receive further Promotional or marketing communications from the Promoter by contacting the Promoter at the address below. Should a participant's contact details change during the Promotion Period, it is the participant's responsibility to notify the Promoter.
