Conditions of Entry

1              To be eligible to enter the Promotion, an individual must be an Australian resident aged 18 years and over, who has (or can obtain) a passport which is valid for at least 6 months from 14/11/2011, who is able to take the major prize on the dates specified by the Promoter, and is able to visit the specified destinations (see condition 14).

2              The Promoter is Schweppes Australia Pty Ltd (ABN 51 004 243 994) of L5 111 Cecil Street, South Melbourne, Victoria 3205 Australia, telephone 1800 244 054 (“Promoter”). 

3              Information on how to enter and prizes form part of these conditions of entry.  The entrant is responsible for ensuring their familiarity with the Conditions of Entry at the time of participation.  Participation in this Promotion constitutes acceptance of these Conditions of Entry.

4              The Promotion commences at 12.01am (Melbourne time) on 1/11/2010 and closes 11.59.59pm (Melbourne time) 21/03/2011 (“Promotion Period”). 

5.            Subject to paragraph 6, entry to the Promotion is only open to Eligible Entrants. An “Eligible Entrant” is an individual who, during the Promotion Period:

(a)   either purchases a specially marked Schweppes product which has a unique code printed on the reverse of the label/packaging (depending on which product is purchased) OR in the case of selected 300mL Schweppes product purchases through HORECA (hotels, restaurants, cafes) outlets, has a necktag with a unique code printed on the reverse of the necktag;

(b)   visits the Promotion page (www.schweppesalchemist.com.au) (the “Website”); and

(c)   completes the Promotion entry form, including:
i)     their full name;
ii)    email address;
iii)     daytime contact phone number;
iv)     the unique code from the specially marked Schweppes product/necktag; and
v)      their drink creation recipe (using the Website tools) and name.

6.            Entry to the Promotion is not open to directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this Promotion.  “Immediate families” means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manager, employee, officer or contractor.

7.            Multiple entries are allowed, however:
·            each entry must include a different drink creation;
·            only one entry is allowed per specially marked Schweppes product with a unique code printed on the reverse of the label/packaging or necktag with a unique code printed on the reverse of the necktag;
·            must be received during the Promotion Period; and
·            each entrant is eligible to win a maximum of one prize only
.

Entrants must retain ALL original promotion label/packaging/necktags (including the unique code).

8.            Entries containing a drink creation that has exactly the same name as one that has already been entered, will be invalid.  Entries must be the entrant’s original work.  Incomplete and/or ineligible entries and entries containing obscene, offensive, defamatory, illegal, infringing, irresponsible, inappropriate and/or unsuitable content, as determined by the Promoter at its sole discretion, will be deemed invalid and are not eligible to win a prize.

9.            This is a game of skill; chance plays no part in determining the winners.

10.          The Promotion voting period (“Voting Period”) commences at 12.01am (Melbourne time) on 1/11/2010 and closes at 11:59:59pm (Melbourne time) on ) 21/03/2011.  (Voters must be aged 18 years and over.)

11.          Voters may vote for as many drink creations as they choose, but may only vote once per drink creation in a 24 hour period. Any form of automated entry using any device or software is invalid. If voters are detected using multiple email accounts to vote a number of times on a single drink creation all of their votes will be invalidated.

12.          Winners will be determined by 10:00am on 4/04/2011 at Life Lounge, 285 St Kilda Road St Kilda Australia 3182.

13.          At the end of the Promotion Voting Period, the Eligible Entrants who have entered the ten (10) valid entries for the drink creations that have received the most votes will be the finalists. Each of the finalist’s entries will be individually judged (by representatives of the Promoter) based on originality and creative merit, and the major prize winner will be determined by the judges in their absolute discretion.

14.          The major prize is a 28 day world tour for two, with stopovers in the following destinations: Tokyo, Berlin, London, Paris, Montreal, Rio de Janeiro and Melbourne. The major prize must be taken between 14/06/2011 – 14/11/2011.

The major prize comprises:
·           two (2) return business class airfares (‘around the world’) to the selected destinations, departing from the winner’s nearest capital city (carrier selected by the Promoter);
·           return transfers (luxury car) between airport/hotel at all destinations;
·           accommodation in a 4 or 5 star hotel at each destination (standard room twin share) including breakfast. (Tokyo: 3 nights; Berlin: 3 nights; London: 3 nights; Paris: 3 nights; Montreal: 4 nights; Rio De Janeiro: 4 nights; Melbourne: 3 nights);
·           return transfers between hotel/ bar (as selected by the Promoter) at each destination; and
·           AU$12,000 spending money.
The major prize is valued at up to $70,000 (inc GST) depending on the winner’s location of residence.

The person participating or nominated to participate in the major prize must be aged 18 years or over. The major prize is subject to booking, visa and flight availability (including accommodation) and must be taken during the specified period (14/06/2011 – 14/11/2011). No extension will be permitted.  The winner must advise at least two (2) months in advance when they wish to take the major prize. (The winner and participant must allow time for issuing of visas where required, prior to travel.)  Any alterations to confirmed major prize details will be at the expense of the winner and will only be permitted with the Promoter's prior consent.  The winner and participant taking the trip must depart and return at the same time using the same air carrier.  The winner is responsible for ensuring that all necessary documentation to travel is obtained (including valid passports and required visas), otherwise the winner’s entry will be deemed invalid. Winner and participants passports must have a minimum six (6) months validity from 14/11/2011.All additional spending money, meals, taxes, insurance, additional transfers and all other ancillary costs, including any costs associated with passports and visas and costs associated with transport etc from the winner’s and other participant’s place or places of residence to the winner’s nearest Australian capital city are the responsibility of the winner.  It is strongly recommended that the winner and participant of the major prize acquire adequate travel insurance (this is not provided as part of the major prize).  The Promoter also strongly recommends that the winner and participant acquaint themselves with travel information/recommendations provided on the Australian government website www.smartraveller.gov.au.The winner and participant are required to sign an indemnity in a form approved by the Promoter in favour of the Promoter and all involved parties prior to participating.  If they do not sign that indemnity form, they will not be able to participate in the major prize. The winner and participant agree to comply with any reasonable directions and guidelines notified to them by the Promoter or its agents.

15           The next 50 valid entries that receive the highest number of votes will each win a minor prize. In the case of a tie in the last position for minor placement, all entries that are tied will be individually judged (by representatives of the Promoter) based on originality and creative merit, and the winner(s) will be determined by the judges in their absolute discretion.

16           For winners whose home is located within 45 km of the GPO in Melbourne, Sydney, Brisbane, Adelaide and Perth (“Major Metropolitan Cities”): each minor prize is a mixing party (up to three hours) to be held at the winner’s home (for 10 people) located in one of the Major Metropolitan Cities (where allowed by licencing regulations/legislation), and comprises:
·            a Schweppes mixologist to teach participants how to make perfect mixed drinks;
·            alcohol for up to the equivalent of six standard drinks per person;
·            up to 10 litres of mixer/soft drinks;
·            grazing food for 10 (including crackers, biscuits and lavosh bread; dips; fruit and cheese selection; nuts and pretzels); and
·            party supplies (including glassware and table decorations).

Persons participating or nominated to participate in a minor prize must be aged 18 years or over. For regional winners whose home is located outside one of the Major Metropolitan Cities (“Regional Winners”), or where the Promoter’s agency is not able to obtain the necessary liquor licence or other required approval to conduct a mixing party in a particular location including one or more of the Major Metropolitan Cities by 14/06/2011: the minor prize is a cash prize to the value of AU$2500 in the form of a cheque or EFT transfer. Mixing parties in Major Metropolitan Cities must be taken between 14/06/2011 – 14/09/2011 (inclusive) and is subject to availability. Block out periods on public holidays apply. No extension will be permitted.  Any alterations to confirmed minor prize details will be at the expense of the winner and will only be permitted with the Promoter's prior consent.  Each minor prize is valued at up to $1,180 (inc GST).Total minor prize pool: $59, 000 (inc GST).

17           All winners will be notified by email and published on the Website on 04/04/2011.

18           The judges' decisions are final and no correspondence will be entered into.

19           All entries become the property of the Promoter and will not be returned to the entrant.  By entering this Promotion, an entrant:a)       consents to the Promoter making copies of or publishing the whole or any part of their entry (including the drink creation) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this Promotion or for any other purposes without payment to the entrant (of royalties, compensation or otherwise); and b)      undertakes to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.

20           Prizes are not transferable or exchangeable and may not be redeemed for cash or any other form of compensation. In the event for any reason a prize winner does not take the prize (or an element of the prize) at or by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and neither cash nor any other form of compensation will be supplied in lieu of the prize. 

21           The value of the prizes is accurate as at 8/03/2010.  The Promoter accepts no responsibility for any variation in the value of the prizes after that date.  If for any reason a prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value. 

22           Entries not fully complying with these conditions of entry will be deemed invalid and are not eligible to win a prize.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

23           The Promoter accepts no responsibility for any breach of contract or any infringement or other violation of copyright or any other intellectual property rights or proprietary rights through the acceptance of entries into this contest and each entrant takes full responsibility for any such claims made in relation to their entry. 

24           By submitting an entry, entrants acknowledge and agree that the entry may be published on the Website and that their nominated name (or screen name) submitted with the entry may be displayed next to or associated with the entry on the Website.  The Promoter may at its sole discretion remove valid entries from the Website at any time.  Invalid entries will not be published on the Website.

25           By submitting an entry, each entrant agrees to assign all rights in the entry and other material submitted as part of or in connection with an entry (“Material”) to the Promoter and consents to the Promoter using the entry and Material in any manner the Promoter wishes (including modifying, adapting or publishing the entry and Material in whole or in part), by way of all media, including, without limitation, posting their entry and Material on the Website without payment to the entrant (of royalties, compensation or otherwise).

26           The Promoter may require entrants to validate any one or all of their entries in the Promotion at any time during the Promotion prior to being eligible to claim a prize. 

27           The Promoter reserves the right to request winners provide proof of identity, proof of age and proof of residency at the nominated prize delivery address, and other proof to demonstrate compliance with conditions of entry.  Identification considered suitable for verification is at the sole discretion of the Promoter.

28           The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, deletion, theft, destruction, transmission interruption, communications failure, or otherwise, or any technical difficulties or periods of unavailability of the entry mechanism during the Promotion Period. The Promoter has no control over networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.  The Promoter is not liable for any costs incurred, responses received or any other consequences of user error.

29           The Promoter reserves the right, in its sole discretion, to disqualify all entries from any person, and prohibit that person’s further participation in this Promotion, who tampers with, or benefits from any tampering with, the entry process or the operation of the Promotion or acts in violation of these conditions, acts in a disruptive or irresponsible manner, acts with the intent to annoy, abuse, threaten or harass any person, or fails to provide adequate identification to the satisfaction of the Promoter. The Promoter reserves sole discretion to disqualify entrants for fraud or illegality.

30           If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

31           If for any reason any aspect of this Promotion (including any prize) is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or the award of any prize, or invalidate any affected entries, subject to the approval of the authorities in each state and territory, where required.

32           Winners will be notified by email. The name and suburb of winners will be published online at www.schweppesalchemist.com.au.  The Promoter may also publish the name and the State/Territory of residence of the winner in a trade publication.  By entering this promotion, each entrant requests that his or her address not be published.

33           The Promoter and its associated agencies and companies accept no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.  Where the operation of the Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.

34           By entering the Promotion, winners confirm that they agree to participate in the Promoter’s publicity activities as requested.  Winners have no right to seek any royalty, payment or other compensation from the Promoter or its agents, for such participation, and they consent to the Promoter using their name, image and entry in any promotional material.

35           The agreement created under these Conditions of Entry is subject to the laws of Victoria, and entrants and the Promoter submit to the non-exclusive jurisdiction of the courts of that State.

36           The Promoter, its associated agencies and companies and the agencies and companies associated with this Promotion will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death or damage to property, which is suffered or sustained (whether or not arising from any person’s negligence) and by any person in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

37           All entries will be the property of the Promoter.  The information entrants provide will be used by the Promoter for the purpose of conducting this promotion and for the other purposes of collection as set out in the Promoter’s privacy policy.  The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery departments and winners’ names may be published as required under the relevant legislation.  The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.  Entrants can request access to the personal information the Promoter holds about them by contacting Consumer Services on 1800 244 054.  The Promoter’s full Privacy Policy is available at www.schweppesaustralia.com.au

I can get it to work OK but you need to have:

It says you have to be over 18 yrs old

WARNING THIS COMP MAY TAKE OVER YOUR LIFE!!! This is a voting comp that goes for almost 5 months. No prizes for voters and you cant even see what your vote count is. It would be hard to get votes for that long with no incentive for the voters, then you might also put all your time and effort in and not even know what your score is. Some computer whiz/hacker will probably dodge the system and get twenty thousand votes!!!!!! (gosh...im in a bit of a negative mood tonight and its showing in my comments- sorry!! :lol:)

Ive done a few voting comps and it is HARD work. It will definaltely take dedication doing this one. Its my dream prize but im not going to enter.

16           For winners whose home is located within 45 km of the GPO in Melbourne, Sydney, Brisbane, Adelaide and Perth (“Major Metropolitan Cities”): each minor prize is a mixing party (up to three hours) to be held at the winner’s home (for 10 people) located in one of the Major Metropolitan Cities (where allowed by licencing regulations/legislation), and comprises:
·            a Schweppes mixologist to teach participants how to make perfect mixed drinks;
·            alcohol for up to the equivalent of six standard drinks per person;
·            up to 10 litres of mixer/soft drinks;
·            grazing food for 10 (including crackers, biscuits and lavosh bread; dips; fruit and cheese selection; nuts and pretzels); and
·            party supplies (including glassware and table decorations).
Persons participating or nominated to participate in a minor prize must be aged 18 years or over.
For regional winners whose home is located outside one of the Major Metropolitan Cities (“Regional Winners”), or where the Promoter’s agency is not able to obtain the necessary liquor licence or other required approval to conduct a mixing party in a particular location including one or more of the Major Metropolitan Cities by 14/06/2011: the minor prize is a cash prize to the value of AU$2500 in the form of a cheque or EFT transfer.
Mixing parties in Major Metropolitan Cities must be taken between 14/06/2011 – 14/09/2011 (inclusive) and is subject to availability. Block out periods on public holidays apply. No extension will be permitted.  Any alterations to confirmed minor prize details will be at the expense of the winner and will only be permitted with the Promoter's prior consent.
Each minor prize is valued at up to $1,180 (inc GST).
Total minor prize pool: $59, 000 (inc GST).
17           All winners will be notified by email and published on the Website on 04/04/2011.
18           The judges' decisions are final and no correspondence will be entered into.
19           All entries become the property of the Promoter and will not be returned to the entrant.  By entering this Promotion, an entrant:
a)       consents to the Promoter making copies of or publishing the whole or any part of their entry (including the drink creation) and otherwise exploiting the entry and any rights in relation to the entry, to publicise this Promotion or for any other purposes   without payment to the entrant (of royalties, compensation or otherwise); and
b)      undertakes to the Promoter that their entry is not, and its use by the Promoter will not be, in breach of any third party intellectual property rights.
20           Prizes are not transferable or exchangeable and may not be redeemed for cash or any other form of compensation. In the event for any reason a prize winner does not take the prize (or an element of the prize) at or by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and neither cash nor any other form of compensation will be supplied in lieu of the prize.
21           The value of the prizes is accurate as at 8/03/2010.  The Promoter accepts no responsibility for any variation in the value of the prizes after that date.  If for any reason a prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value.
22           Entries not fully complying with these conditions of entry will be deemed invalid and are not eligible to win a prize.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
23           The Promoter accepts no responsibility for any breach of contract or any infringement or other violation of copyright or any other intellectual property rights or proprietary rights through the acceptance of entries into this contest and each entrant takes full responsibility for any such claims made in relation to their entry.
24           By submitting an entry, entrants acknowledge and agree that the entry may be published on the Website and that their nominated name (or screen name) submitted with the entry may be displayed next to or associated with the entry on the Website.  The Promoter may at its sole discretion remove valid entries from the Website at any time.  Invalid entries will not be published on the Website.
25           By submitting an entry, each entrant agrees to assign all rights in the entry and other material submitted as part of or in connection with an entry (“Material”) to the Promoter and consents to the Promoter using the entry and Material in any manner the Promoter wishes (including modifying, adapting or publishing the entry and Material in whole or in part), by way of all media, including, without limitation, posting their entry and Material on the Website without payment to the entrant (of royalties, compensation or otherwise).
26           The Promoter may require entrants to validate any one or all of their entries in the Promotion at any time during the Promotion prior to being eligible to claim a prize.
27           The Promoter reserves the right to request winners provide proof of identity, proof of age and proof of residency at the nominated prize delivery address, and other proof to demonstrate compliance with conditions of entry.  Identification considered suitable for verification is at the sole discretion of the Promoter.
28           The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, deletion, theft, destruction, transmission interruption, communications failure, or otherwise, or any technical difficulties or periods of unavailability of the entry mechanism during the Promotion Period. The Promoter has no control over networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.  The Promoter is not liable for any costs incurred, responses received or any other consequences of user error.
29           The Promoter reserves the right, in its sole discretion, to disqualify all entries from any person, and prohibit that person’s further participation in this Promotion, who tampers with, or benefits from any tampering with, the entry process or the operation of the Promotion or acts in violation of these conditions, acts in a disruptive or irresponsible manner, acts with the intent to annoy, abuse, threaten or harass any person, or fails to provide adequate identification to the satisfaction of the Promoter. The Promoter reserves sole discretion to disqualify entrants for fraud or illegality.0            If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
31           If for any reason any aspect of this Promotion (including any prize) is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or the award of any prize, or invalidate any affected entries, subject to the approval of the authorities in each state and territory, where required.
32           Winners will be notified by email. The name and suburb of winners will be published online at www.schweppesalchemist.com.au.  The Promoter may also publish the name and the State/Territory of residence of the winner in a trade publication.  By entering this promotion, each entrant requests that his or her address not be published.
33           The Promoter and its associated agencies and companies accept no responsibility for any tax implications that may arise from the prize winnings.  Independent financial advice should be sought.  Where the operation of the Promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values.
34           By entering the Promotion, winners confirm that they agree to participate in the Promoter’s publicity activities as requested.  Winners have no right to seek any royalty, payment or other compensation from the Promoter or its agents, for such participation, and they consent to the Promoter using their name, image and entry in any promotional material.
35           The agreement created under these Conditions of Entry is subject to the laws of Victoria, and entrants and the Promoter submit to the non-exclusive jurisdiction of the courts of that State.
36           The Promoter, its associated agencies and companies and the agencies and companies associated with this Promotion will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death or damage to property, which is suffered or sustained (whether or not arising from any person’s negligence) and by any person in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
