Entry into Channel [V]’s “B430’s Global Animal Blog Jockey” competition (the “Competition”) is open to all Australian citizens aged over 18 years of age. The Promoter is XYZnetworks Pty Limited (ABN: 71 066 812 119) of Level 1, 5 Thomas Holt Drive, North Ryde, NSW 2113 (the “Promoter”). Information on how to enter forms part of the terms of entry. Entry into the Competition is deemed acceptance of these terms and conditions. 2. The Competition is only open to eligible entrants, being individuals who: a) are Australian citizens; b) who hold a valid Australian passport with a minimum 6 month validity from 28th November 2010; and c) are over the age of 18. People under the age of 18 are ineligible to enter. 3. The officers, management and employees (or immediate family of an officer, manager or employee) of the Promoter, the agencies associated with this Competition, FOXTEL, AUSTAR, Optus TV and their related bodies corporate are not eligible to enter. 4. Any entry that is made on behalf of an entrant by a third party, or otherwise by proxy, will be invalid. 5. The Competition is a game of skill, and chance plays no part in determining the winners. 6. The Competition commences on Monday 8 November 2010 at 00:01 (AEDT) and concludes on Friday 19 November 2010 at 10:00 (AEDT) (the “Competition Period”). All times and dates are times and dates in Sydney. All times are stated using the 24 hour clock. 00:00hrs is the start of a day and 24:00hrs is the end of a day. 7. To enter, participants must: a. go to the official [V] Music – Channel [V] Australia Facebook page at www.facebook.com/vmusic.com.au; b. go to the B430’s Global Animal tab within the Facebook page; c. complete all the details on the ‘Blog Jockey’ registration form. Details collected include (but are not limited to) full name, phone number, correct email address, suburb, state, post code, age, date of birth and answers to the questions. Mandatory details will be indicated on the entry form; and d. Complete the following tasks: i. View a picture and answer a question in 200 words or less; ii. Tell us in 200 words or less which Channel [V]J you would most like to be stuck on a desert island with; iii. Tell us in 200 words or less who is your favourite blogger and why? and iv. Provide us with any further blog links or personal website information to assist with your application; and e. Be available to be interviewed by the Channel [V] team in person or by telephone or video at any time throughout the Competition Period. 8. To be eligible to be judged for a Major Prize, entrants will be required to reach ‘BUS’ status in the B430 Global Animal Competition, by attaining votes in the B430 Global Animal Voter Competition. 9. Incomprehensible and incomplete entries will be deemed invalid. 10. Entrants in the Competition may only enter once. 11. Only one Prize per person will be awarded. Once an entrant has been selected as a ‘Blog Jockey’, they will not be able to participate in any further B430 Global Animal Blog Jockey competitions for the duration of the activity (until 20 March 2011). 12. The use of any automated software or any other mechanical or electronic means that permits the participant automatically to enter repeatedly is prohibited (“Repeat Entry Device”). If the Promoter reasonably believes that an entrant is using any Repeat Entry Device, the Promoter may disqualify that entrant without notice. 13. The Promoter reserves the right to request winners to provide proof of identity, proof of Australian citizenship, evidence of criminal history, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered. 14. The Promoter reserves the right to interview an entrant at any stage throughout the Competition; to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Competition and/or Promoter. The Promoter reserves the right to disqualify a winner if the Promoter becomes aware that the winner and/or the winner’s entry is of a type described in this clause. 15. Entries must be received by 10:00 (AEDT) on Friday 19 November 2010. The time of entry will in each case be the time the Facebook entry is received by the Beinteractive database. 16. The cost of accessing Facebook will be dependent on the entrant’s individual Internet Service Provider and the Promoter is not responsible for any costs associated with such internet access or entering the Competition. JUDGING AND AWARD OF PRIZE 17. All valid entrants who have completed the criteria successfully, and attained the status as outlined in Clause 8, will be judged by a judging panel at XYZnetworks Pty Ltd where the judging will take place at Level 1, 5 Thomas Holt Drive North Ryde NSW 2113 commencing on Friday 19 November 2010 at 12:00 (AEDT). All decisions of the Promoter are final and no discussions or correspondence will be entered into. 18. The criteria for judging will be based on the most original entry as judged by the Promoter. There will be 2 winners only. 19. The winners will be notified of their Prize by phone and in writing. 20. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry. 21. Should an entrant’s contact details change during the Competition Period, it is the entrant's responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter. AGE 22. The Competition is not open to people under the age of 18. Entries received from entrants who are under the age of 18 will be deemed ineligible. PRIZES 23. There will be a total of 2 Major Prizes awarded. One ‘Blog Jockey’ as judged by XYZnetworks Pty Ltd will go to FRANCE to be Channel [V]’s ‘Blog Jockey, and one will go to the UNITED STATES to be Channel [V]’s ‘Blog Jockey’. Subject to visa requirements, the particular trip allocated to each winner will be at the discretion of the Promoter. FRANCE PRIZE 24. One ‘Blog Jockey’ winner will win a trip to go surfing in the South of France. The prize includes the following: - 1 x Return Economy Airfare to Paris, leaving on 28 November 2010 from Sydney (or nearest capital city as determined by the Promoter) and flying to Paris, France, returning to Sydney (or nearest capital city) on 8 December 2010; valued at a maximum of $4,000; - 4 nights’ accommodation in Paris in a minimum 3 ½ star hotel, valued at a maximum of $1,400; - Return transfers from Paris to Biarritz/Hossegor, valued at a maximum of $500; - 4 nights’ accommodation in Hossegor (Southern France), valued at a maximum of $1,200; - Spending money for food, valued at a maximum of $1,320; and - Travel insurance, valued at a maximum of $300. (the “France Blog Jockey Prize”) The France Blog Jockey Prize package is valued at a maximum of $8,720.00. MIAMI PRIZE 25. One ‘Blog Jockey’ winner will win a trip to DJ in Miami. The prize includes the following: - 1 x Return Economy Airfare, departing from Sydney (or nearest capital city as determined by the Promoter) on 29 November 2010 to New Orleans, returning from Miami to Sydney (or nearest capital city) on 9 December 2010, valued at a maximum of $4,000; - Transfers from New Orleans to Miami, valued at a maximum of $500; - 4 nights’ accommodation in New Orleans in a minimum 3 ½ star hotel, valued at a maximum of $1,600; - 4 nights’ accommodation in Miami in a minimum 3 ½ star hotel, valued at a maximum of $1,600; - Spending money for food, valued at a maximum of $1,320; and - Travel insurance, valued at a maximum of $300. (the “Miami Blog Jockey Prize”) The Miami Blog Jockey Prize package is valued at a maximum of $9,320.00. Together, the France Blog Jockey Prize and the Miami Blog Jockey Prize are referred to as “the Prizes”. 26. Total Prize value is $18,040.00. 27. Prizes cannot be transferred and no element of the Prize can be redeemed for cash. 28. Before participating in any aspect of a Prize, winners will be required to sign a legal release form including warranties that they: a. Are available to travel on and for the dates specified by the Promoter to coincide with the filming of an episode of B430 and that the winner does not have any obligations which would prevent them participating in any aspect of the Prize; b. Do not have any pre-existing medical conditions which would prevent them participating in any aspect of the Prize; c. Are an Australian citizen who has the requisite travel documents, including but not limited to, valid passport and, if required, travel insurance; and d. Do not have a criminal record and are not the subject of any criminal proceedings, and if required by the Promoter will undergo an official Criminal Record Check. 29. Prize winners must acknowledge that they will be a part of the Channel [V] working crew and that they must meet minimum Blog Jockey requirements, including submitting a certain amount of written and video work as determined in the sole discretion of the Promoter. The Promoter will supply prize winners with equipment necessary to undertake this work. 30. Winners must meet visa requirements to participate in a Prize. In the event a winner does not meet minimum visa requirements for a particular country, the winner will forfeit the Prize, the Promoters will select another winner and no substitute prize will be offered, 31. Travel must be taken between 28/11/10 and 09/12/10 (or such other dates as specified by the Promoter) at the time specified by the Promoter and must coincide with the dates of the scheduled filming of series 3 of the Channel [V] program, B430. If a winner is, for whatever reason, unable to travel on a nominated date, or does not take an element of the Prize within the time stipulated by the Promoter then that element of the Prize will be forfeited by the winner, and the next entrant as judged by XYZ Networks Pty Ltd will be selected as the ‘Blog Jockey’. Cash will not be awarded in lieu of the prize or element thereof. 32. Travel dates and times are subject to change and the winners acknowledge that the Promoter may be required to modify travel arrangements on short notice. 33. The Prize must be claimed by 09:00 on 20 November 2010 and if a Prize remains unallocated or unclaimed, then the Prize will be forfeited and another winner selected by the Promoter. 34. The Prize winners are responsible for all other expenses including spending money (unless specified), meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, taxes (including departure taxes), energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs. 35. The Prize winners are responsible for transport from their residence to their nearest capital city for flight arrival and departure. 36. Government taxes are an additional cost to the Prizes winners and are required prior to ticketing. 37. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their current flight schedule. Frequent Flyer points are not available from any airline. 38. A credit card imprint or cash deposit may be required from the Prize winner at checkin to the hotel, for all incidental charges therefore each Prize winner will be required to have a valid credit card. Once accommodation vouchers are issued they are nonchangeable. 39. It is the Prize winner’s personal responsibility to ensure that they have valid documentation, including but not limited to valid passports (with a minimum 6 months validity from return date) and visas, which meet the requirements of immigration and other government authorities at every destination. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. 40. XYZ Networks Pty Ltd and Beinteractive Pty Ltd, make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade. 41. By entering this Competition, entrants accept and acknowledge full responsibility for their decision to participate as a ‘Blog Jockey’ should they be chosen as a Prize winner. The Prize winners agree and acknowledge that they will be travelling overseas and participating in potentially dangerous activities and they release the Promoter and other organisers, their related bodies corporate, affiliates, officers, agents and employees, from all liabilities, loss and damage of any kind arising at any time out of or in connection with the acceptance of, and participation in, the Prize. Without limiting the foregoing, the released parties will not be liable for any injury, sickness or death, property loss or damage or other direct or indirect loss or damage of any kind, howsoever sustained or incurred, in connection with or arising out of being part of the Channel [V] working crew or any other aspect of the Prize. The Prize winner acknowledges that they have been warned that there is a possibility of an accident causing injury, death or property damage in accepting and participating in the Prize. 42. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the entrants and the Prize winners. The Promoter will not reimburse a Prize winner for any expenses incurred by the Prize winner as part of the Prize, unless the expenses have been pre-approved in writing by the Promoter. 43. If the Prize is unavailable, for whatever reason, the Promoter reserves the right, in its complete discretion, to amend the dates and details of the Prize or to substitute the Prize for a prize of equal or greater value. 44. The Promoter reserves the right to refuse to allow a Prize winner to take part in any or all aspects of the Prize, if the Promoter determines, in their absolute discretion, that a Prize winner is not in the mental or physical condition necessary to be able to safely participate in the Prize. It is a condition of accepting the Prize that the Prize winner will be required to sign a legal release in a form determined by the Promoter in its absolute discretion. 45. By accepting the Prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the Prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the Prize. 46. In consideration for the Promoter awarding the Prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the Prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use. 47. In consideration for the Promoter awarding the Prize to the winner, the winner hereby permits the winner’s image and/or voice, as recorded, photographed or filmed during the winner’s participation in the prize to appear in connection with XYZ Networks Pty Ltd or the advertising or marketing thereof, in any media whatsoever throughout the world and the winner will not be entitled to any fee for such use. 48. In the event that for any reason whatsoever a winner does not take an element of the Prize at the time stipulated by the Promoter then that element of the Prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize. 49. Prize values are based upon the recommended retail prices at the time of printing (inclusive of GST). The Promoter accepts no responsibility for change in Prize value between now and the ultimate Prize redemption date. 50. Independent financial advice should be sought as tax implications may arise as a result of accepting the Prize. 51. It is a condition of accepting the Prize that the winner must comply with all the conditions of use of the Prize and the Prize supplier’s requirements. 52. It is a condition of accepting the Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion. GENERAL 53. Entrants enter the Competition at their sole risk. The Promoter, Facebook and Beinteractive shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 54. The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. 55. The Promoter reserves the right to cancel the award of prize/s to, and/or to disqualify any individual who, as determined in the sole discretion of the Promoter, has breached these terms and conditions or who has otherwise engaged in unlawful or improper conduct that is designed to jeopardise the fair conduct of the Competition. 56. XYZnetworks Pty Limited, Beinteractive, Facebook and their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of entries, and reserves the right to take any action that may be available. 57. The Promotion is not sponsored, endorsed, administered by, or associated with, Facebook. 58. If for any reason this Competition is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition. 59. The Promoter reserves the right, in its absolute discretion, at any time before the awarding of the Prizes to cancel or vary the Competition or to vary or cancel the award of the Prizes including, without limitation, circumstances where in the Promoter’s opinion (which it shall form in its absolute discretion): (a) a Prize winner does not satisfy the Competition entry requirements; or (b) the Promoter cannot conduct the Competition or award the Prize/s for any reason beyond its control. 60. In the event that the Promoter cancels the Competition or varies or withdraws the Prizes it shall not: a. be liable to any person for any loss or damage (including loss or damage caused by any negligence) arising out of, or in connection with, such cancellation, variation or withdrawal; and b. be required to conduct the Competition at any other time. 61. A decision of the Promoter in relation to any aspect of the Competition is binding and conclusive and no correspondence will be entered into. 62. All entries become the property of the Promoter. All opt-in entries will be entered into a database and the Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant.
