Information on how to enter and prizes forms part of these Terms and Conditions of Entry. Participation in this promotion is deemed acceptance of these Terms and Conditions of Entry.
The promotion is open to Australian residents only. The Promoter’s employees and their immediate families and the Promoter’s agencies associated with this promotion are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

To enter, individuals must, during the Promotion Period, visit:
www.pawclub.com.au and follow the prompts to the survey page; or
www.yahoo7.com.au/heartyourdog

and input the following details:
their gender;
their postcode;
their answers to the ten survey questions;
their name;
their email address;
the month and year they would like to receive a reminder to take their dog in for a heart worm injection;

and then submit the fully completed entry form.

Individuals can also opt to send details of this promotion to a friend by providing their friend’s name and email address. Entrants should only nominate friends, family, colleagues and other individuals who they have a direct relationship with, and who consent to receiving these types of messages.

Limit one (1) entry per person.

Promotion commences on 1 November 2010 and final entries close at 11:59PM AEDST on 27 February 2011 (Promotion Period). Entries close for each draw at 11:59PM (Sydney Time)on the dates specified in the table below. All draws will take place at 2pm at Orchard Marketing, Suite 512, 19a Boundary Street, Rushcutters Bay NSW 2011 on the dates specified in the table below. Entries in each minor draw will NOT be entered into any subsequent minor draws but will be entered into the Major Prize Draw. Winners will be notified in writing and winners of prizes valued at over $250 will have their names published in The Australian on the dates specified in the table below.

The first two (2) valid entries drawn in each minor prize draw will receive a Nintendo DS with the game Nintendogs, valued at $320. The next two (2) valid entries drawn in each minor prize draw will receive a doggy bag, valued at $60.

The first ten (10) valid entries drawn in the major prize draw will receive an iPhone 4, valued at $1,000. The phone prize is a handset only. Winner will be responsible for making all arrangements for connection with a service provider and payment of all associated connection, access and call charges.

The Promoter’s decision is final and no correspondence will be entered into.
A draw for any unclaimed prizes may take place on 3 June 2011 at the same time and place as the original draws, subject to any directions from a regulatory authority. Winners will be notified in writing and their names (for prizes over $250) will be published in The Australian on 27 June 2011.

The total prize pool value is $22,920.

In the event that the winner of any prize is under the age of 18 the prize will be awarded to their parent or legal guardian on their behalf.
Prize values are correct at the time of printing. Prizes are not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prizes.
Entries not completed in accordance with these Terms and Conditions of Entry or received after the Promotion Period ends will not be eligible. Incomplete or incomprehensible entries will be disregarded. No responsibility is accepted for late, lost or misdirected entries.
The Promoter reserves the right to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions of Entry or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address and/or proof of entry validity in order to claim a prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the Promoter may deem the winner invalid, and the winner will forfeit the prize in whole and no substitute will be offered.
If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
Where a prize is unavailable for any reason, the Promoter reserves the right to substitute for the prize another item of equal value and/or specification, as determined by the Promoter, subject to any necessary approval of the relevant gaming authorities.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) and the companies associated with this promotion exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions of Entry; or (e) use of a prize.
The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought.
The Promoter and its agencies and companies associated with this promotion will take no responsibility for prizes damaged, lost or stolen in transit.
All entries become the property of the Promoter. The information from the entries is being collected by the Promoter and/or the Promoter’s agencies and the companies associated with this promotion to enable them to manage this promotion and contact the potential winners. This information may be entered into a database and may be provided to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may also use the entrant’s personal details for future promotional, marketing and publicity purposes. Winners agree to allow their image and name to be used by the Promoter for publicity purposes without any further reference or payment or other compensation.
