Prize must be taken by 26 May 2011. 13. Accommodation is based upon two people sharing. Specified accommodation is subject to availability at the time of booking. Winners are able to extend their trip at their own expense. Winners must have access to a personal email account on the internet. Alternatives may be offered for hotels, restaurants and tours are dependent on availability. Travel insurance is not provided but strongly recommended by the Promoter. US Visa‟s are the responsibility for the winner. The Promoter and its associated agencies and companies make no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade. The winner and their companion must possess a valid Australian passport with a minimum of (6) six months validity from the date of scheduled return to Australia or New Zealand. It is the responsibility of the winner and their companion to ensure that they have full and correct documentation for travel. The Promoter and its associated agencies and companies will not be held responsible for any loss or delay that may occur as a result of any passport or visa not being produced for travel. 14. Unless expressly stated in these terms and conditions all other expenses become the responsibility of the winner. The winner (and their companions) are responsible for all expenses including but not limited to spending money, meals, drinks, incidentals, mini-bar, laundry, room service, telephone calls, activities, insurance, taxes (other than specified), energy surcharges, gratuities, services charges, passports, travel insurance and all other ancillary costs. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all incidental charges. 15. Flights leave from Melbourne, Australia and land in Los Angeles, USA. If the winner is a Tasmanian resident, travel to Melbourne for departure is the winner and their companion‟s responsibility. Return flights from Los Angeles to any Australian capital city. The winner and their travelling companion must travel on the same flight. 16. Flights and accommodation are subject to availability at the time of booking, are non-transferable and cannot be exchanged for travel to other destinations. If the winner and their travelling companion wish to extend their trip they will be able to do so at their own expense. 17. The Promoter reserves the right to redraw the prize in the event of an entrant failing to comply with these terms and conditions or forfeiting or not claiming the prize by 28/02/2011. If the prize remains unclaimed by that date, a second draw will be held at 12.00pm AEST on 18/03/2011 at the same location as the original draw. Disposal of any unclaimed prizes may be made subject to any written directions given by any government authority and pursuant to any relevant legislation. All unclaimed prize draw winners will be contacted by phone and mail immediately. Any winner/s will also be announced in The Herald Sun newspaper on 25/03/2011. 18. The Promoter, other entities associated with this competition and their related bodies corporate, and each of their officers, employees and agents shall not be liable for and shall be held harmless in respect of any loss, damage, or injury whatsoever which is suffered (including but not limited to direct or consequential loss) or sustained, as a result of or arising from the winner‟s acceptance and use of the prize, except to the extent that any such liability cannot be excluded by law. 19. Entry details remain the property of the Promoter. Acceptance of the prize is deemed to be acceptance by the winner of these terms and conditions and approval to use the winner‟s name and photograph for publicity purposes, unless specifically requested by the winner not to do so at the time of accepting the prize. 20. If the competition does not run for its duration due to, but not limited to, computer viruses, tampering, unauthorized intervention, fraud, technical failures or any other cause beyond the Promoter‟s control that corrupts or affects administration, security, fairness or proper conduct of the competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process.
