EzyGreen Solar Hot Water - Competition Guidelines
Terms and Conditions
1. Information on how to enter the competition forms part of the competition conditions.
2. Competition entry is deemed acceptance of these terms and conditions.
3. The prize consists of one Rinnai Impressor 8 Burner Gas Barbeque, or equivalent to the value of $5168 to be supplied by AGL Assist, Unit 4, 185 Beverly Street, Morningside QLD 4170. The prize cannot be redeemed for cash.
4. CitySmart Pty Ltd (CitySmart) of level 2, 29 Adelaide Street Brisbane is the promoter of this competition.
5. The competition period: The competition will commence at 9:00am, Thursday 11 November 2010 and close 4pm, Monday 20 December 2010. The winner will be drawn by 4pm Wednesday 22 December 2010 by a CitySmart officer and the decision of that officer shall be conclusive and no correspondence will be entered into. The winner will be notified by 12pm Thursday 23 December 2010.
6. How to enter: Entrants must fully purchase and/or install an AGL Assist solar hot water system through the EzyGreen program during the time specified in these terms and conditions. Failure to fully complete the purchase or accept the terms and conditions of the competition within the period specified shall render the entry invalid.
7. The winner will be the first entry randomly drawn from the complete pool of entries.
8. To be eligible to enter this competition, a person must:
a. Make whole purchase, including any final or residual payments, of an AGL Assist solar hot water system through the EzyGreen program.
b. Fully and correctly complete and submit the entry form as included in the EzyGreen solar hot water competition email.
c. Be at least eighteen (18) years of age or have the consent of their parent or guardian to enter the competition, and have the form signed by the parent of guardian.
d. Not be an employee or contractor of CitySmart Pty Ltd, Brisbane City Council, AGL or AGL Assist or an immediate family member of an employee or contractor of CitySmart Pty Ltd, Brisbane City Council, AGL or AGL Assist.
9. The winner will be drawn between 3pm and 4pm on Wednesday 22 December 2010 at Level 2/79 Adelaide St Brisbane. The winner will be notified by telephone and/or email.
10. If the winner does not claim the prize by 12:00pm Friday 24 December 2010, the Promoter will redraw the prize until a contactable winner has been located and the prize is claimed. This will continue until a clear and correct winner is established.
11. Any additional expenses incurred by the prize winner, other than those outlined in these terms and conditions are the responsibility of the winner.
12. The Promoter makes no representations or warranties as to the quality, sustainability or merchantability of the prize. This paragraph is not intended to exclude any liability which cannot be excluded under Australia Consumer Protection laws. Any such liability is limited to the resupply of the prize.
13. The value of the prize is accurate and based upon the recommended retail price(s) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the prize after that date. The prize (including any unused portion) cannot be transferred, exchanged or redeemed for cash. The Promoter retains the right to substitute the prize with a prize of equal or greater value (including where the prize is unavailable).
14. The winner will be required, at their own cost, to collect the BBQ from AGL Assist, Unit 4, 185 Beverly Street, Morningside QLD 4170. The Promoter will use its best endeavors to make the prize available to the winner within 28 days of the draw.
15. Any tax liability arising as a result of accepting any prize is the responsibility of the winner.
16. The Promoter has no control over internet, networks or lines including bugs/viruses and server problems and accepts no responsibility for any problems associated with them, for whatever reason.
17. The Promoter will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any prize except for any liability which cannot be excluded by law.
18. The Promoter reserves the right to alter or amend these terms and conditions at any time and to cancel the competition without further recourse to the entrants.
19. Important – Registration and Privacy Consent: All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant’s personal information to administer the Promotion, announce the winner and disclosing the entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter’s privacy policy (which is available on request). An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
20. The winner agrees to participate in any news media activities surrounding the Promotion. The Promoter reserves the right to use the winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity without compensation
