VARIABLES

General:
1.1 Competition open to Current Kathmandu Summit Club members, who are residents of Australia.
1.2 Commencement time: 12:00am Australian Eastern Standard Time (AEST).
1.3 Commencement date: 21st October, 2010.
1.4 Closing time: 11:59pm AEST.
1.5 Closing date: 12th December, 2010.
1.6 Draw time: 12:00 noon AEST.
1.7 Draw date: 20th December, 2010.
1.8 Draw location: Unit 6/106 Old Pittwater Rd, Brookvale, NSW 2100.

WHO MAY ENTER The only persons who may enter and be awarded prizes are residents of the place specified in Condition 1.1 and are not (i) employees of, or contractors to, the Promoter or any of its agencies involved with this competition, or (ii) members of the immediate family of such employees and contractors. Spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee/contractor. The competition is open to persons under the age of 18. However if the winner drawn is under the age of 18, they must be accompanied on the prize by a parent or guardian over the age of 18. By participating, entrants agree to be bound by these conditions.

HOW TO ENTER To enter the Teva Kathmandu promotion, entrants must purchase any pair of Teva footwear from any Kathmandu store participating in the promotion, and have their Summit Club details registered at the time of purchase.

LIMITATIONS ON ENTRY One entry per Teva product purchased. Multiple entries per person are accepted. Persons wishing to enter must comply with condition 1.1.

DURATION The competition commences at the time specified in Condition 1.2 on the date specified in Condition 1.3. Entries must be received by the time specified in Condition 1.4 on the date specified in Condition 1.5.

SELECTION OF WINNERS The draw will be conducted at the time specified in condition 1.6 on the date specified in condition 1.7, and will be conducted at the location specified in condition 1.8. The first valid entry drawn will win the prize. The Teva Kathmandu promotion is a game of chance, thus skill plays no part in determining the winner, each entry has a random and equal chance of being drawn.

WINNER NOTIFICATION, PUBLICATION AND REDRAW The winner will be notified by phone and mail immediately following the draw. And the winner’s name and postcode will be published in The Australia newspaper on 29th December 2010. If the winner is not contactable after a 3 month period, the promoter has the right to redraw. The unclaimed prize draw will take place on 31st March, 2010, at 12 noon, at Unit 6/106 Old Pittwater Rd, Brookvale, NSW 2100. The winner of the redraw will be notified by phone and mail immediately following the draw. And the winner’s name and postcode will be published in The Australia newspaper on 7th April 2010.

PRIZES The prize is a holiday to the Teva Mountain Games located in Vail, Colorado USA, for 2 people (adults or children), and is valued at up to $9,999 and includes return economy airfares from the winner's nearest capital city to Denver, Colorado, USA; airport transfers to and from hotel; 8 nights’ 4-star hotel accommodation, travel insurance and a total of AUD$500 spending money. It is a condition of the promotion that the prize is taken on the following dates: Departing May 31st 2011 and returning June 9th 2011. If the winner is not available on these dates a redraw will take place and another winner will be drawn. Flights and accommodation are subject to availability at time of booking. Additional spending money, valid passports, visas, transport to & from departure point in Australia, meals and alcohol, additional transfers and insurance, and all other ancillary costs are the responsibility of the winner. It is a condition of accepting the prize that all components of the prize be taken during the trip and all persons taking the trip depart from & return to the winner's nearest capital city at the same time unless otherwise agreed by the Promoter & that all persons taking the trip sign a waiver of liability in the form determined by the Promoter in its absolute discretion. Promoter accepts no responsibility for variations in holiday prize value. The prize is not transferable, exchangeable or redeemable for cash.

PRIVACY AND COPYRIGHT By entering the competition, the major prize winner agrees to the use of their name, image and photograph/s for publicity and promotional purposes, without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s. The Promoter agrees not to use the personal contact details of any entrant for any other purpose, during or after the promotion, except where consent is given by the entrant to do so.

To the extent permitted at law, the Company and its related entities, officers, employees, contractors and agents disclaim any liability of any kind (including in contract, tort and breach of statutory duty) for loss, personal injury, death, property damage or otherwise that you may suffer yourself or cause to other persons or property as a result of any outdoor, adventure or related activity that you undertake or commence, whether inspired by True Alliance or its related entities, officers, employees, contractors and agents, or otherwise. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavours to procure within Australia, the Promoter reserves the right to substitute a different prize item of equal or greater value.
