TERMS AND CONDITIONS OF ENTRY – FROM THE GOUND UP BUILD YOUR DREAM PROMOTION(“THE PROMOTION”)

HOW TO ENTER

   1. To be eligible to enter the Promotion, participants must be an Australian resident 18 years of age and over (“Eligible Entrant”). Employees & their immediate families of the Promoter, the Promoter’s associated companies and agencies, and Stockland are ineligible to enter.
   2. Information on how to enter and prize details form part of these terms and conditions; however, to the extent that there is any inconsistency between these terms and conditions and any other published material, these terms and conditions will prevail. By participating in this Promotion, each participant fully and unconditionally agrees and acknowledges that these terms and conditions are binding.
   3. In these terms and conditions, the Promoter is Jack of All Trades Productions Pty Ltd (Subsidiary of Brand New Media) ABN 11 137 349 538, c/o Brand New Media, “The Pavillion”, 201 Miller Street, North Sydney NSW 2060 (“the Promoter”) and Stockland is Stockland Wallarah Peninsula Pty Ltd ACN 478 467 197 of Level 25, 133 Castlereagh Street, Sydney, NSW 2000.
   4. The Promotion commences at 3.30pm Eastern Standard Time (“EST”) on 24 October 2010 and closes at 11.59pm EST on 3 January 2011 (“the Promotion Period”).
   5. The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these terms and conditions.
   6. To enter this Promotion, an Eligible Entrant must, during the Promotion Period:
         1. Watch at least one episode of From the Ground Up to find the clue; and
         2. Log on to http://www.thegroundup.com.au  or http://www.domain.com.au/groundup  and complete the entry form including the correct answer to the clue for the applicable episode and submit their entry.
   7. Only one entry per eligible entrant per episode will be permitted. An Eligible Entrant will receive one Entry in the draw for each correct entry submitted during the promotion period. (“Eligible Entry”).

Entries are processed automatically. The Promoter will accept no responsibility for lost, late, incomplete, illegible, or misdirected Entries.

   8. There is one prize to be won. The first Eligible Entry drawn (“Winning Entrant”) will entitle the Eligible Entrant to $50,000 off the purchase price (“Prize Rebate”) of any land lot (“Lot”) at Stockland’s Murrays Beach development at Lake Macquarie, NSW.   The Prize Rebate amount will be applied as a reduction of the purchase price of the Lot.
         1. The Promoter takes no responsibility for any variation in the Prize Rebate value. Prize Rebate is not transferable, exchangeable or redeemable for cash.
   9. The Prize Rebate draw will be conducted at 2.00pm EST on 4 January 2011 at 15 Grosvenor Street, Neutral Bay NSW 2089 (the “Draw”).
  10. The Winning Entrant will be determined by way of a computerised random selection from a computer database containing all Eligible Entries submitted from Eligible Entrants. The allocation of the Prize Rebate to the Winning Entrant is final and the Promoter will not enter into any correspondence in relation to the Prize Rebate or the Promotion.
  11. The Winning Entrant will be notified by phone and in writing immediately after the draw on 4 January 2011 and will be announced during Episode 10 of From the Ground Up which will be televised on Channel Ten on 8 January 2011. The winner’s name will be published in the Financial Review newspaper on 11 January 2011. Entrants are responsible for keeping the Promoter informed of any changes to their contact information during and immediately following the Promotion Period.
  12. The Promoter reserves the right to request that the winner shows evidence that they are financially able, or have been approved by their financial institution to purchase a Lot at Murrays Beach, NSW.
  13. To claim the Prize Rebate the Winning Entrant must:
         1. pay to Stockland a holding deposit of $1,000 on their chosen Lot by 8 April 2011;
         2. enter into a Contract for Sale of Land in respect of their chosen Lot within 14 days of their solicitor or licensed conveyance receiving the Contract for Sale of Land from Stockland; and
         3. complete the purchase of the Lot in accordance with the Contract for Sale of Land. The Winning Entrant will not be entitled to receive the Prize Rebate if they do not complete under the Contract for Sale of Land.

Before entering into a Contract for Sale of Land, you should obtain appropriate independent legal and financial advice.

  14. The Winning Entrant must disclose the Prize Rebate to any lender financing the purchase of their Lot.  Stockland will not be held responsible for any effect the Prize Rebate may have on any loan valuation or stamp duty calculation.
  15. If the Winning Entrant has not entered into a Contract for Sale in accordance with clause 14 then they are no longer eligible to receive the Prize Rebate.. The Promoter will comply with any applicable legislation regarding any unclaimed Prize Rebate and any written directions of any competent authority in that regard. If permitted by the applicable legislation, the Promoter will conduct a redraw at the same location as the original draw at 2.00pm on 21 April 2011. Any redrawn winner will be notified by telephone and in writing. The winner’s name will also be published in the Financial Review newspaper on 28 April 2011.  This will be the only further redraw and no correspondence will be entered into in this regard.
  16. Stockland and the Promoter and their related bodies corporate and their respective officers, employees and agents accept no liability for:
         1.  any loss (including but not limited to that arising from any person’s negligence), damage or personal injury whatever (including but not limited to direct, indirect and consequential loss) in connection with using the Prize Rebate, except any liability that cannot be excluded by law in which case that liability is limited to the minimum allowable by law; or
         2. any inability of the Winning Entrant to claim or use the Prize Rebate.

  17. Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. If the information requested is not provided, the participant may not participate in the Promotion or claim a Prize and their entry may be discarded. Unless otherwise advised, the Promoter may also share this information with third parties, including, but not limited to, prize suppliers and may also use the personal information for promotional, marketing and publicity purposes including sending electronic messages. Entrants should direct any request to access, update or correct personal information to the Promoter.

It is a condition of entry into the Promotion that the Winner consents to the publication of their name and city of origin in any advertisements or articles relating to the Promotion or the Prize and participates in any media releases which may include photographs of the Winner by the Promoter without compensation, and agrees that the Promoter will own copyright in any such images and photograph/s and in all material incorporating the photograph/s. By entering this promotion, participants consent to the use of their names and likenesses in this manner. Personally-identifying information collected from participants in this Promotion will be handled in accordance with all applicable laws in Australia.

  18. Neither the Promoter or the Promoter’s associated companies and agencies will be responsible for any problems or technical malfunction of any computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet.
  19. If this Promotion is not capable of running as planned for any reason  (including but not limited to failure or malfunction of any computer equipment by reason of infection by computer virus, power failure, bugs, tampering, unauthorised intervention, fraud, or technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right in its sole discretion to disqualify any individual who undermines the fairness of the Promotion (by, for example, using or exploiting errors in the entry process to obtain a competitive advantage over other Eligible Entrants) and, after consulting with the relevant legislative authorities, to cancel, terminate, modify or suspend the Promotion.
