HEY HEY IT’S SATURDAY Promotion FORD BLINDFOLD COMPETITION Service Provider 5th FINGER Version 2010.1 Date 13/11/10 HEY HEY IT’S SATURDAY – FORD BLINDFOLD COMPETITION (“THE COMPETITION”) CONDITIONS OF ENTRY (“THE RULES”) 1. Information on how to enter and prizes form part of these Conditions of Entry. Entries not completed in accordance with the Conditions of Entry or received after close of entry will not be considered. Incomplete or inaudible entries will be disregarded. The judge’s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into. 2. Entry is open to all residents of Australia, aged 18 years and over, except for employees of the Promoter, The Nine Network Australia, ACP Magazines Ltd, ninemsn Pty Ltd, Ticketek Pty Ltd, 5th Finger Pty Ltd and their immediate families, and all companies and agencies associated with this promotion. The entrant must have a current Australian Drivers license. The Entrant must be able to attend the Channel 9 Studios at 22 Bendigo Street, Richmond, Victoria 3121 to take part in the FORD BLINDFOLD COMPETITION contest. 3. At its sole discretion the Promoter may exclude any person(s) with a criminal record. At its sole discretion the Promoter may exclude any person who has appeared on any broadcast Quiz or Game Show within the 6 months prior to the record date. REGISTRATION PROCESS 4. The Competition opens at 1930 ADST on Saturday 13 November 2010 and closes at 09:00 ADST on Wednesday 24th November 2010. Three entrants will be drawn to attend the Hey Hey It’s Saturday recording at 22 Bendigo Street Richmond, Victoria, on Saturday 27th November 2010. 5. The draw will take place at 5th Finger Pty Ltd, 264 George St, Sydney NSW 2000 at 09.30 ADST on Wednesday 24th November 2010. The three entrants drawn will be contacted by telephone and in writing on Wednesday 24th November 2010. An unclaimed prize draw will take place at 5th Finger Pty Ltd, 264 George St, Sydney NSW 2000 at 15.00 ADST on Thursday 25th November, 2010. 6. There are two ways of registering for the FORD BLINDFOLD COMPETITION: a. 1-90 Call: Participants can call and register their full name, address, and daytime phone number to 1902 555 499 Maximum 1-90 entry cost per message is 55c including GST. Calls from mobiles and pay phones may attract a higher rate. b. SMS: Participants can text their full name, address, and daytime phone number to 199 55 499. Participants only need to submit a phone number that they can be contacted on if it differs from the mobile phone they entered the competition on. Maximum SMS entry cost per message is 55c including GST. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. 7. The entrant must be available to attend the Channel 9 studios at 22 Bendigo Street Richmond, Vic 3121, on Saturday 27th November 2010. If the drawn winner cannot attend the studio in person on the 27th November 2010, they will be permitted to nominate a proxy (friend or family member) to attend in their place. 8. If a medical circumstance in some way restricts your ability to enter the competition through the required mechanic, you are still eligible to enter however you must briefly state your circumstances upon entry. 9. Multiple competition entries are permitted, subject to the following: (a) only one entry permitted per SMS message or 1-90 Call; and (b) each entry must be submitted separately and in accordance with the entry requirements. 10. No responsibility accepted for late, lost, misdirected, incomplete or inaudible entries. 11. The Promoter reserves the right to draw additional reserve entries (and record them in order), in the event that an invalid entry is drawn or an entrant drawn is ineligible. 12. The Promoter will provide travel for each FORD BLINDFOLD COMPETITION Contestant and a companion only as follows: a. If the Contestant is from QLD, ACT, NT WA, SA, NSW or TAS they will receive two return economy airfare(s) from the Contestant’s nearest capital city to Melbourne and one night room only accommodation in a minimum three star hotel for the night of the FORD BLINDFOLD COMPETITION appearance date as determined by the promoter. The Contestant and the person they choose to travel with must share a room. b. If the Contestant is from Victoria and whose official place of residence is at least 200 kilometres from the Channel 9 Studios located at 22 Bendigo Street, Richmond VIC 3121 they will be provided with one nights’ room only accommodation in a minimum three star hotel (up to the value of $250) for the night of the FORD BLINDFOLD COMPETITION appearance date as determined by the promoter. If the drawn entrant is from Victoria but whose official place of residence is within 200 kilometres from the Channel 9 Studios located at 22 Bendigo Street, Richmond VIC 3121 then the accommodation will not be provided. c. Travel must be taken to coincide with the FORD BLINDFOLD COMPETITION Segment and is subject to booking and flight availability and accommodation, up to the value of $1,600. Itinerary is to be determined by the Promoter at its absolute discretion. Unless otherwise indicated, Contestants are responsible for all costs involved in taking part in the Competition, including but not limited to, travel to and from the FORD BLINDFOLD COMPETITION Segment, additional accommodation, meals, taxes and any other ancillary costs. No fee will be paid to any Contestant for any attendance in respect of any loss of earnings incurred because of the attendance at the studio for the FORD BLINDFOLD COMPETITION segment. 13. The Promoter reserves the right to request that Contestants provide proof of identity. Identification considered suitable for verification is at the discretion of the Promoter. 14. It is a condition of participation that a Contestant will be required to sign legal releases in any form to be determined by the Promoter at its absolute discretion. 15. At its absolute discretion the Promoter reserves the right to refuse to allow any person participation in any or all aspects of the Competition if the Promoter determines that a Contestant is not in a mental or physical condition necessary to be able to safely participate in the Competition 16. The Contestant is required to divulge to the Producers any medical device they may require. Contestants who wear a hearing device, or other electronic device or any other medical aide as prescribed by a Medical Practitioner may also be asked to provide proof of their medical requirement of such a device. Such device may be deemed a security risk. RECORDING THE PROGRAM 17. On the appearance date as specified by the promoter the Contestants will be met at the studio and will be required to sign a standard form Agreement in relation to the Program. The standard form Agreement will include, amongst other things, confirmation that the Contestant: a. understands and agrees to the Rules; b. consents to the recording of their contribution to the Program and to the exploitation of the Program in all media worldwide; and c. consents to a search of their person and belongings to ensure that they do not have any device or other thing that would assist them in the Competition, as deemed necessary by the producers. 18. The Ford Blindfold Competition will run as follows: a. When the 3 Contestants attend the recording of Hey Hey It’s Saturday on Saturday 27th November 2010, they will each be asked to select one of three numbers (ie 1, 2 & 3) from a container or any other item deemed suitable by the promoter at it’s absolute discretion. Each of the 3 contestants will be blindfolded. In the Studio three Ford vehicles will be covered and numbered one to three. The Contestants will be guided in front of their numbered vehicles facing the audience. b. The car covers will be removed to reveal a Mondeo. The Contestant standing in front of the Mondeo wins the vehicle. PRIZES 19. The prize being offered is a Ford Mondeo Zetec Hatch valued at $41,579 drive away. 20. The total maximum prize pool value that can be won as part of this Competition is up to $41,579. Availability of the prize is subject to the promoter. 21. In the event that the prize is unavailable, the Promoter reserves the right to substitute the prize in its discretion with an alternative prize to the same and equal recommended retail value and/or specification, subject to any written directions from a regulatory authority 22. The conditions for this prize are as follows: The winner will receive 1 x Ford Mondeo Zetec Hatch valued at up to $41,579 including GST (depending on statutory charges in the state/ territory in which the car is redeemed). Cost Breakdown being (VIC as example): a. Registration (incl. CTP) $510 b. Stamp Duty $1,608 c. Number plate fee: $13 d. Admin/record fee: $13 e. Dealer delivery: $1,695 f. Vehicle $37,740 g. Including standard fittings, registration and on road costs. h. Prize does not include; petrol, comprehensive insurance and all other ancillary costs associated with redeeming and owning the prize. i. The winner will be required to pick up the vehicle from a dealer. The winner will be asked to nominate their closest Ford dealer to help deliver the car on our behalf. j. Receipt of a prize vehicle is subject to the winner being able to lawfully take possession of the prize vehicle and comply with all registration and compulsory third-party insurance requirements of the state/territory in the state/territory the winner elects to register the prize vehicle. k. The Promoter takes no responsibility for any mechanical body or paint repairs from the date and time of delivery. Vehicles depicted in all promotional material are not necessarily the same colour or grade as the prize vehicle. l. The winner will not be able to select the vehicle colour, this will be determined by the Promoter. Additional insurance, options, accessories, fuel and all other ancillary costs are the responsibility of the winner. The abovementioned quoted value of $41,579 is for an automatic transmission. m. In acceptance of the prize, the winner acknowledges that they may incur ongoing costs associated with the prize, which are the entire responsibility of the winner. n. The Promoter will organise the vehicle to be delivered to the dealership. The winner is advised that it may take several weeks for the vehicle to have its pre-delivery work finalised and delivered to the dealership, subject to the winner’s location, state and territory vehicle registration, and dealership requirements. The winner should allow 28 days for this process. o. If the winner is unable to collect the vehicle, the winner may incur cost of transporting the vehicle, if needed, from their nearest dealership to an alternate prize claim point as nominated by the winner and deemed acceptable by the Promoter. Any costs associated with the transport of the vehicle to an alternate location will be responsibility of the winner. There are no added charges when a winner picks up the prize from their nominated dealer. p. It is a condition of winning that the prize winner provides the Promoter with their full name, address, license and a copy of their current Australian driver’s license prior to the awarding of the prize. q. Winner must have a current valid Australian driver’s license. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such winner may assign the motor vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. r. Where specific models of prizes are not stipulated, the Promoter will award their choice of model of equal value to the value stipulated in these terms & conditions. 23. Prizes are not transferable or exchangeable. 24. The winner will be notified in writing and published in The Australian on Thursday 2nd December 2010. 25. In the event the broadcast time for a scheduled episode is changed, the competition start and end times for those episodes will be moved in line with the new broadcast times for that episode. The total time available for viewers to enter will remain the same, with the close time being advised during the broadcast. If required, the draw time will be delayed until the episode has been broadcast and will be conducted at 9:30am ADST on the first business day following the close of the draw period. This is subject to regulatory authority approval. 26. In the event that for any reason whatsoever the prize winner does not take the prize or an element of the prize at the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited by the prize winner and cash will not be awarded in lieu of the prize or that element of the prize. 27. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize. In the event that a potion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way. 28. By entering the promotion via SMS an entrant consents to the Promoter using their personal details for the purposes of sending one (1) mobile terminated (MT) reply message which includes a confirmation of your entry in the promotion AND details of a special offer made by one of our partners. 29. It is a condition of accepting a prize that the winner agrees to be interviewed, photographed and filmed at any time during the acceptance of the prize by the Promoter or their agents for a story or feature on this promotion to be developed and featured on the Nine Network (or any other form of media it deems suitable) without further remuneration or reference to the participant. Details may feature on Nine Network on a date to be determined by the Promoters. The inclusion of any such feature (including but not limited to creative control of the feature) will remain with the Promoter at all times. 30. Participants must ensure that all care is taken when dialing or sending messages to the promotional number. It is the complete responsibility of the participant to ensure that they dial or SMS the correct number, in the event that an error occurs the Promoter accepts no responsibility for either, costs incurred, responses received or all other consequences. This is the responsibility of the participant. 31. The Promoter accepts no responsibility for any SMS messages not received by the Promoter or delays in the delivery of the SMS message due to technical disruptions or for any other reason. An entry will only be counted as being received when it has been received by the Promoter’s software system, not when it was sent from the handset. 32. The Promoter reserves the right to verify, at any time during or after the closing of the promotion, the validity of all entries and to disqualify any entrant who tampers with the entry process, including techniques designed to avoid payment of call costs or who submits an entry that is not in accordance with these Conditions of Entry. SMS entries via the internet are not valid and will not be accepted. The use of any automated entry software, or any other mechanical or electronic means, that permits the participant to automatically enter repeatedly are not valid and will not be accepted. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 33. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 34. If for any reason this competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond the control of the Promoter which corrupts or affect the administration, security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and, subject to any written directions given by the various Lottery Departments, to cancel, terminate, modify or suspend the competition. 35. All entries become the property of the Promoter. The collection, use and disclosure of personal information in connection with this promotion is governed by the Promoter’s Privacy Notice available from Somers Carroll and these Conditions of Entry. To the full extent permitted by law, The Promoter will not be liable to you in respect of any claim for any loss or damage whatsoever (including, without limitation, any consequential, indirect, special, punitive or incidental damages) or for any personal injury suffered by you as a result of or in connection with the Promoter’s provision of the Service. Certain legislation may imply warranties or conditions or impose obligations (collectively Provisions) in relation to the Promoter’s provision of services to you which cannot be excluded, restricted or modified except to a limited extent.
