Terms and Conditions

1.   Information on how to enter this competition and prizes form part of these terms and conditions of entry. Entry into the draw is deemed acceptance of these conditions of entry. Entry is via www.instantxmas.com.au, www.instantchristmas.com.au and www.take40.com.

2.   Entry into this promotion is open to all Australian residents aged 10 years and over. Entrants under the age of 18 must obtain the prior permission of a parent or guardian over the age of 18 to enter. Employees of mcm media and their immediate families, associated agencies of mcm media and companies associated with the promotion are not eligible to enter the promotion. Any person who within 365 days prior to the day on which the promotion first commenced has won a prize in value which is greater than or equal to $100 from another mcm media promotion is not eligible to enter.

3.   To enter the promotion, Entrants are required to go to www.instantxmas.com.au, www.instantchristmas.com.au or www.take40.com click through to ?Fone Zone Instant Xmas Competition? and successfully complete a simple interactive game. The participant will then be asked to register their details. Entrants will be required to leave their details including name, date of birth, address, phone number and e-mail address. One complete and valid registration will provide the entrant one entry in the draw.

4.   Incomplete, incorrect and incomprehensible entries will be deemed invalid.

5.   Only one complete online registration will be accepted per day (midnight to midnight) from the same person. Multiple registrations in the same day will not provide multiple entries. Any participant who completes more than one online registration form per person, per day (midnight until midnight) will have all entries apart from their original entry on that day deemed invalid.

6.   The Promoter accepts no responsibility for any internet entries not received or included for any reason, including due to technical or other failure.

7.   The cost of accessing the promotional website will be dependent on the entrant?s individual Internet Service Provider and the responsibility of the entrant.

8.   Instant Win Prizes: 222 x Instant winner prizes will be available to random valid entrants during the promotional period. Participants will be notified online (via e-mail) if they are an instant winner and what prize they have won. Entrants consent to receiving this electronic message. Instant winners will be issued a 6 digit Prize Claim Number as determined by the Beinteractive Pty Ltd Instant Win system. The 6 digit Prize Claim Number will need to be recorded by the participant for prize verification purposes. In the event of any dispute with the Promoter, or at the Promoter?s request, Instant Winners will be required to correctly quote their unique Prize Claim Number to be awarded their prize. The Promoter reserves the right to withhold the awarding of an instant prize to a participant who cannot provide a valid, unique Prize Claim Number or does not meet the age restriction requirements. Any unclaimed or un-verified prizes will be awarded during the second chance draw.

9.   The competition commences on Tuesday 16 November 2010 at 12:00pm (AEDT) and registration commences at this time. All registrations must be received by 12:00pm (AEDT) on Friday 24 December 2010.

10.   At the conclusion of the competition all entrants excluding Instant Winning entries will be entered into a draw to win any un-won prizes. The draw will take place at Beinteractive, Level 8, 155 George St, Sydney NSW 2000 on Tuesday 4 January 2011 at 11:30 (AEDT).

11.   All winners will be notified in writing. Winners of prizes over $250 will have their details published in the public notices section of The Australian Newspaper on Tuesday 18 January 2011.

12.   The Promoter shall conduct such further draws as may be necessary at 11:30am (AEST) at Beinteractive Pty Ltd, Level 9, 155 George Street Sydney NSW 2000 on Monday, 4 April 2011 at 11:30am (AEST) to distribute any Prizes unclaimed by that date subject to State Regulation. Any winners will be notified in writing and winners of prizes over $250 will have their details published in The Australian Newspaper on Monday, 11 April 2011.

15.   Only one prize per person will be awarded (SA residents are entitled to win more than one prize). In the event that an entrant wins more than one instant prize, the first instant prize won will be awarded and the remaining prizes will be drawn.

16.   By accepting the prize, the winner agrees to participate in and co-operate as required with all reasonable media editorial requests relating to the prize, including but not limited to, being interviewed and photographed, filmed and/or chaperoned throughout the duration of the prize.

17.   In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner?s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.

18.   Judges decision is final and no correspondence will be entered into. Prizes are not exchangeable or transferable. All registrations are deemed to be received at the time of receipt into the Promoter?s database, and not at the time of transmission by the participant.

19.   All prize values are the recommended retail value as provided by the supplier and are correct at time of printing. The Promoter accepts no responsibility for any variation in prize value. If the prizes are unavailable for whatever reason, the Promoter reserves the right to substitute the prize for a prize of similar value subject to state regulation.

20.   Programming and other quality control errors will not invalidate an otherwise valid prize claim.

21.   Unless otherwise due to fraud or ineligibility under these conditions of entry, all existing claims for prizes and entitlements to claims will be met notwithstanding the advertised prize pool has been exceeded.

22.   Printing errors or other quality control matters outside the control of the individual player shall not be used as the sole basis for refusing to award a prize.

23.   The Promoter and each of their related bodies corporate, associated agencies and companies associated with this competition will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person?s negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

24.   Should a participant?s contact details change during the competition period, it is the participant?s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.

25.   mcm media and each of their related bodies corporate, associated agencies, and companies associated with this promotion will take no responsibility for any delay in delivery once prizes have left the Promoter's premises.

26.   The Promoter reserves the right to request winners to provide proof of identity, proof of residency at the nominated prize delivery address, and/or proof of entry validity. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof of identity, the winner will forfeit their prize in whole and no substitute will be offered.

27.   All entries become the property of the Promoter. The Promoter collects personal information about you to enable you to participate in this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion) but no further use of this information will be made without prior consent. Entrant?s personal information may be disclosed to State and Territory lottery departments and winners names published as required under the relevant lottery legislation.

28.   If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition, subject to state regulation.

29.   In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes; the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to state regulation.

30.   The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this competition by any person who tampers with or benefits from any tampering with the entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.
