FAIR GAME IN WASHINGTON DC HOLIDAY - TERMS AND CONDITIONS 1.THE PROMOTER: This competition is promoted by the Fairfax Radio Network Pty Limited. The affiliate stations on which the promotion will run are 2UE, 3AW, 4BC, 6PR and FIVEaa (the ”Talk Radio Network”) 2. By participating in the Fair Game in Washington DC Holiday promotion on 2UE, 3AW, 4BC, 6PR and FIVEaa, you are deemed to have accepted these Terms and Conditions. 3. Entrants must be 18 years or older. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, brother, sister, step-brother or step-sister. Entrants and their nominated companion must be able to take the Prize before 15 November 2011 subject to the restrictions and requirements outlined in these Terms and Conditions and as advised by the prize provider. 4. The Promoter reserve the right, at any time, to request the entrants and/or winners to provide evidence to verify the validity of entries (including proof of identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Identification considered suitable for verification is at the discretion of the Promoter. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in their sole discretion, to determine the identity of the entrant. 7. The promotion will commence on Monday 15 November at 8.30am local time in each state, and the promotion will close on Sunday 5 December at 5.00pm local time in each state (the “Promotion Period”). 8. Choosing the Winners: The National Promotions Department of the Promoter in Melbourne will assess all valid entries received across the Talk Radio Network, and judge what they believe to be the most worthy story and deserving entry (in the Promoter’s absolute discretion) of the Prize according to the entry mechanics specified on the competitions page. Judging will take place at Media House, Level 7, 655 Collins Street Docklands, Victoria on Tuesday 7 December from 3.00pm AEDST. 9. One winner will be chosen from all valid entries received by the Talk Radio Network,(at the Promoter’s absolute discretion) and this winner will be notified via telephone and email by a representative of the Talk Radio Network. 10. The Promoter’s decision is final and no correspondence will be entered into. 11. One winner from all entries received will receive the following package for two people based on 2 people sharing a room. All elements are subject to availability at time of booking. • Return flights from winner’s nearest capital city to Washington DC (economy) (Flights may not necessarily be direct and are subject to availability at time of booking) • Return airport/hotel transfers in Washington DC • 5 nights hotel accommodation in Washington DC (4 star minimum) or equivalent as determined by the Promoter • Spy School Experience • Entry into the Spy Museum • Comprehensive travel insurance 12. The Prize package is valued at up to AUS$11,450.00 (inc. GST). 13. Redeeming the Prize is conditional on availability and on the winner and their nominated companion’s acceptance of the terms and conditions of travel of the nominated airline carriers and other prize providers, and in accordance with any other normal travel practices and applicable terms and conditions. 14. Entrant’s and their nominated companion must be the holder of a current passport with at least 6 months validity from the travel date. 15. Visas, valid passports, additional spending money, meals and any other ancillary costs, including but not limited to insurance and any applicable insurance excesses, not listed as part of the Prize above are the responsibility of the winner and his/her nominated companion as incurred. It is the winner's responsibility to organise transport to/from the airport departure/return point. The winner and his/her nominated companion must have valid travel insurance for their period of travel and adequate insurance for the countries of travel. 16. The winner may be required to provide a credit card upon check in to hotel for any incidentals. 17. If any Prize (or part of any Prize) is unavailable, the Promoter, in its discretion jointly, reserve the right to substitute the Prize (or that part of the Prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority, however there is no obligation on the Promoter’s to do so and if a replacement cannot be provided the winner will forfeit the Prize (or part thereof not provided). 18. The Prize, or any unused portion of a Prize, is not transferable or exchangeable. 19. The Holiday package is to be taken within 12 months of the start of the Promotion Period and cannot to be taken over public holidays. 20. It is the winner’s responsibility to obtain ESTA visas for the USA before travelling. 21. Entrants consent to the Promoter and the Talk Radio Network using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promoter, the Talk Radio Network and promoting any products manufactured, distributed and/or supplied by the Promoter or the Talk Radio Network. 22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserve the right, in their sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 23. Except for any liability that cannot be excluded by law, the Promoter and the Talk Radio Network (including their officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of this Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the prize. 24. The Promoter and the Talk Radio Network collect personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Entrants consent to the Promoter and the talk Radio Network using, for an indefinite period unless otherwise advised, the Entrants’ personal information provided for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant.
