Terms & Conditions

1. Instructions on how to enter and prizes form part of these Terms and Conditions. The purpose of the
competition is to give viewers a chance to win 1 of 5 holidays to Hawaii.

2. Entry cost is $0.55 (including GST) for SMS and 190. Higher rates apply to calls to the 190 number
from mobile phones. Service not available from payphones.

WHO CAN ENTER?

3. The competition is open to residents of Australia aged 18 years and over where the Channel Seven
broadcasting signal is received
. Employees of Southern Star Entertainment Pty Ltd, (“Promoter”), the
Seven Network, Beinteractive Pty Ltd and their immediate families and agencies associated with this
promotion are ineligible to enter. The audience in the Deal-a-drome on the day of each show
(including the contestants) are also eligible to enter.

GENERAL TERMS

4. The competition commences on Friday 19 November 2010 at 17:30 (AEDT) and concludes on
Thursday 25 November 2010 at 23:59 (AEDT).

5. To enter, participants must be watching Deal or No Deal on the Seven Network where they will be
prompted to register their details for a chance to win. Details requested include (but are not limited to)
full name, address and phone number. Entrants can enter as many times as they like and will be
asked to register each day for a better chance of winning.

6. There will be a total of 5 rounds of the Hawaii Competition for which a competition winner will be
drawn each day. The Competition rounds will be as follows:

7. Entries must be received by 23.59 (AEST) on Thursday 25 Nov 2010 to be eligible, however a draw
will take place on each Draw Date and entries will roll over into each daily draw. The time of entry will
in each case be the time the 190 telephone call / SMS message is received by the Beinteractive
database. The Promoter accepts no responsibility for late, lost or misdirected entries including SMS
message note received by the Promoter or delays in the delivery of SMS message due to technical
disruptions, network congestion or for any other reason. SMS entries via the internet or computer
generation and are not attributable to a valid mobile phone account is invalid and will not be accepted.

8. Draws for each round will be conducted as specified in the above table at 09:00 (AEST) at
Beinteractive Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000.

9. Entries which are inaudible, incomplete or incomprehensible entries will not be eligible to be included
in any draw. The Entrant is responsible for ensuring that they dial the correct promotional number to
enter. In the event of an error, neither the Promoter nor Beinteractive Pty Ltd accepts responsibility for
either costs incurred, entries received or any other consequences.

HOW TO PLAY

10. To enter, participants must either:
a) Call 1902 555 653 (the “190 number”) and register their full name, address and daytime contact
number (“Contact Details”) or
b) Send a SMS message to 1977 2277 containing the entrant’s full name, suburb and state
(“Contact Details”).

11. The SMS entry mechanic is only open to consumers with an SMS compatible mobile phone
connected to a service provider which permits text messaging to the promotional SMS number. It is
recommended that entrants check with their individual service provider in this regard.

12. The Winner for each round is the person who is drawn at random from all eligible SMS and 190
entries received by 23.59pm on the day preceding the relevant Draw Date, as specified in the table in
Clause 6.

13. If an Entrant’s Contact Details change during the promotional period, it is the Entrant's responsibility
to notify the Promoter. A request to access or modify any information provided in an entry should be
directed to the Promoter.

14. Winners agree to participate in and co-operate in such publicity and promotional activities as
reasonably requested by the Promoter. The Promoter may record and reproduce on film, tape,
photograph and by other means Winners’ names, likeness, voice and appearance (“Recording”) and
use the Recording (in whole or in part) in any way without further consent or cost, including the right
to synchronise the audio from the recording with other visual images and the vision with other audio
and may use the Winners’ name, photograph, voice and biographical material in connection with
publicity and advertising for the Program and related corporate promotions.

PRIZES

15. Prizes and values are as follows: There will be one (1) winner selected at random from the pool of
eligible entries for each round during the Promotion Period on the Date of Play (as specified in the
table in clause 6). There will be five (5) prizes in total. Each prize includes:
(a) Return economy airfares for 2 adults from Sydney to Honolulu, Hawaii
(b) Departure taxes
(c) Airport / hotel transfers for 2 adults (Honolulu airport to Hilton Hawaiian Village Beach Resort &
Spa) plus fresh flower lei greeting
(d) 6 nights accommodation in an Ocean View room at the Hawaiian Village Beach Resort & Spa
Each prize is valued at a maximum of $9,500.

16. The total maximum potential prize value is $47,500.

17. The winners (and their companions) are responsible for all other expenses including spending
money, meals, drinks, transfers (unless specified), laundry charges, activities, incidentals, taxes,
energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other
ancillary costs. Travel insurance is highly recommended to protect against the additional costs
incurred in the event of unforeseen circumstances.

18. The winners and travelling companions must travel at the same time, must depart from Sydney and
are responsible for transport from their residence to Sydney airport for flight departure. Connecting
flights from other capital cities is not included in the prize.

19. Government taxes are an additional cost to the winners and their travelling companions and are
required prior to ticketing

20. The prize must be taken by 30 November 2011 and is subject to hotel and flight availability. The prize
is not available during peak times such as public holidays and school holidays and cannot be
changed once the booking has been made. Block out periods include 15 December – 16 January
2010, 15 March – 27 April 2011, 8 June to 31 July 2011 and 1 September – 31 October 2011
Bookings must be made at least 30 days prior to travel date.

21. Air tickets are available on the regular scheduled services of each airline and are subject to seasonal
embargos. Flight itinerary may have to be adjusted depending on the airlines departure city and their
current flight schedule. Frequent Flyer points are not available from any airline.

22. A credit card imprint or cash deposit may be required from the winner at check-in to the hotel, for all
incidental charges. Once accommodation vouchers are issued they are non-changeable.

23. It is the traveller’s personal responsibility to ensure that they have valid documentation, including but
not limited to valid passports and visas, which meet the requirements of immigration and other
government authorities at every destination. Any fines, penalties, payments or expenditures incurred
as a result of such documents not meeting the requirements of those authorities will be the sole
responsibility of the traveller/s.

24. Southern Star Entertainment Pty Ltd make no representation as to the safety, conditions or other
issues that may exist at any destination. International travel advice can be obtained from various
sources, including government, local consular offices and the web site of the Australian Department of
Foreign Affairs and Trade

25. Only one prize per household will be awarded (SA residents are entitled to win more than one prize).

26. In the event that for any reason whatsoever a winner declines to accept the prize or any element of
the prize when it is available then the prize or that element of the prize will be forfeited by the Winner.

27. Prizes will be awarded to the person named in the entry. However, in a dispute, will be awarded to
the account holder of the entry mechanism used to submit their entry (i.e. mobile phone account
holder of land line account holder).

28. The promoter shall conduct such further draws as may be deemed necessary for any unclaimed
prizes at Beinteractive Pty Ltd, Level 8, 155 George Street, Sydney NSW 2000 on Monday 28
February 2011 at 10:00 AEDT to distribute any prizes unclaimed by that date, subject to the relevant
State Regulation. Any winners will be notified in writing and published in The Australian newspaper on
Monday 7 March 2011.

29. Prizes are not transferable or exchangeable. All prize values are in Australian dollars. The Promoter’s
decision is final and no correspondence will be entered into regarding the competition result.

30. If the prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the prize
for a prize of equal or greater value, subject to State Regulation.

31. The Promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the
prize, if the Promoter determines, in their absolute discretion, that a winner is not in the mental or
physical condition necessary to be able to safely participate in the prize. It is a condition of accepting
the prize that the winner may be required to sign a legal release in a form determined by the Promoter
in its absolute discretion.

32. Prize winners are advised that Tax implications may arise from their prize winnings and they should
seek independent financial advice prior to the acceptance of the prize.

33. The Winners will be announced during the Program and will also be notified via telephone on the day
of each draw and in writing after that date. The names of the Winners will be published in the Public
Notices section of The Australian Newspaper on Friday 3 December 2010.

34. The Promoter reserves the right to request winners to provide proof of identity, proof of residency at
the nominated prize delivery address and/or proof of entry validity (including phone bill) in order to
claim a prize. Proof of identification, residency and entry considered suitable for verification is at the
discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will
forfeit the prize in whole and no substitute will be offered.

35. The Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in
the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory
or defamatory statements, disqualify any entrant who tampers with the entry process, who submits an
entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of
Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or
generally damaging to the goodwill or reputation of the Promotion and/or Promoter. The Promoter
reserves the right to disqualify a winner if Promoter becomes aware that the winner and/or the
winner’s entry is of a type described in this clause.

NO LIABILITY

36. In the case of the intervention of any outside act, agent or event which prevents or significantly
hinders the Promoter’s ability to proceed with the competition on the dates and in the manner
described in these terms and conditions, including but not limited to vandalism, power failures,
tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in
its absolute discretion cancel the competition and recommence it from the start on the same
conditions, subject to any written directions given under the relevant State Regulation.

37. The Promoter, The Seven Network & affiliates, Beinteractive Pty Ltd and their associated agencies
and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or
misdirected mail.

38. The Promoter, The Seven Network & affiliates, Beinteractive Pty Ltd and their associated agencies
and companies will not be liable for any misadventure, accident, injury, loss or claim that may occur
(except for any liability which cannot be excluded by law):
a) during the draw;
b) whilst undertaking any travel won on or connected with their entry into the draw; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail or telephone malfunction;
e) Due to the broadcast of any program relating to the competition or the publication of any material,
including any statements made by any compere, staff member, journalist, other Entrants or any
other person.
f) arising from or related to any problem or technical malfunction of any telephone network or lines
related to or resulting from participation in this promotion.
g) any incorrect or inaccurate information, either caused by the phone user or for any of the
equipment or programming associated with or utilised in this competition, or for any technical
error, or any combination thereof that may occur in the course of the administration of this
competition including any omission, interruption, deletion, defect, delay in operation or
transmission, communications line or telephone, mobile or satellite network failure, theft or
destruction or unauthorised access to or alteration of entries.

39. The Promoter, The Seven Network (Operations) Limited assumes no responsibility for any error,
omission, interruption, deletion, defect, delay in operation or transmission, communications line
failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to
take any action that may be available.

40. If for any reason this competition is not capable of running as planned, including due to infection by
computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes
beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or
integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to
disqualify any individual who tampers with the entry process, take any action that may be available,
and to cancel, terminate, modify or suspend the competition, subject to any written direction given
under State Regulation.

41. The Promoter does not warrant or represent that the Home Viewer will win any particular amount of
prize money or other prize.

42. Beinteractive, on behalf of the Promoter, is collecting the entrant's personal information for the
purpose of conducting and promoting this competition (including but not limited to determining and
notifying winner). If you are not willing for this to occur you cannot participate in the Promotion.

43. Entrants’ personal information may be disclosed to State and Territory lottery departments and
winners’ names published as required under the relevant lottery legislation. A request to access,
update or correct any information should be directed to the Promoter.

44. All entries become the property of the Promoter. The Promoter is bound by the Privacy Act 1988
(Cth) in respect of your personal information. The Promoter collects personal information about you to
enable you to participate in this promotion including determining and notifying the winner and notifying
permit authorities (as stated above in Clause 33 & 34) and for use in the production and promotion of
the Program. The Promoter may share your personal information with the Promoter’s affiliated
companies and broadcaster of the Program, the Seven Network (Operations) Limited for this purpose
and you consent to this. The entrant’s details will not be used for future marketing purposes without
prior consent.
