Standard Terms 1.1 Information on how to enter forms part of the terms of entry. 2. Competition entrants agree to grant the Promoter a perpetual non-exclusive licence to use their entries in any and all media worldwide and a fee will not be payable to the winner for such use. 3.8 The Promoter reserves the right in its sole discretion to reject bulk entries or non-genuine entries. 4. Prizes 4.1 There will be 1 prize winner ("Winner") each week that the Competition is run. 4.2 The prize for each week that the Competition is run ("Prize") is: Prize Description RRP 1x Qantas Travel Voucher AUD1,000 Total weekly Prize value is a MAXIMUM OF 1 x AUD1,000.00. The total prize pool for the Competition is a MAXIMUM of AUD13,000.00. Prize values are based on the recommended retail price at the date the relevant Prize is awarded. The Promoter accepts no responsibility for any variation in the value fo the prizes. 4.3 Prizes are not transferable and cannot be redeemed for cash. The prize winner should seek independent financial advice about any tax implications that may arise from the Prize. 4.4 The Qantas Travel Voucher is valid for 12 months for bookings made through Qantas Retail Travel offices in Australia to purchase tickets on Qantas operated flights. Travel booked using the Qantas Travel Voucher is subject to normal published availability and conditions at the time of booking. Qantas Travel Vouchers are non-transferable, cannot be redeemed for cash and cannot be replaced if lost or stolen. 4.5 The Promoter is solely responsible for the fulfilment of the Prize to the Winner. 5. How To Win 5.1 All entries completed and submitted in accordance with these Terms and Conditions will be judged at the Promoters office at Unit 3, 20 Cliff Street, Milsons Point NSW 2061, on the following Monday after the competition closes. The Prize Winner will be the entrant whose entry fulfils the entry criteria and whose answers are judged to be the most creative, original and interesting from all entries received. This is a game of skill. There is no element of chance in judging the Competition or in the determination of the Prize Winner. 5.2 The Winner will be selected by a panel of judges appointed by the Sponsor and the Promoter. 5.3 The Prize Winner will be notified by a telephone call at the conclusion of the judging, and an email advising the Winner of their Prize will also be sent by the Promoter. The winner will also be announced on the website. 5.4 The judges decision in relation to the Promoter's determination and notification of the Winner (including any decisions as to the Prize distribution) is final and the Sponsor will not enter into any correspondence regarding the result. 5.5 It is also a condition of accepting a Prize that the Winner must comply with all of the terms and conditions of use of the Prize and the Sponsor's requirements in relation to it. To the extent of any inconsistency with these Terms and Conditions, the terms and conditions of the Prize and of the Sponsor prevail. 6. No Liability 6.1 Subject to any restrictions in law, the liability of the Promoter and/or the Sponsor however such liability arises, including but not limited to liability arising by breach of any condition or warranty implied by statute or of this agreement or of any duty of tort (including negligence) is limited to the total value of the weekly Prize ie AUD1000. 6.2 The Promoter, the Sponsor and their associated agencies and companies will take no responsibility for Prizes that are damaged or lost in transit or mail that is late, lost or misdirected or for the level of advice provided as part of the Prize or any reliance on such advice. 6.3 The Promoter, the Sponsor and their associated agencies and companies will not be liable for any accident, injury, misadventure, loss (including but not limited to consequential loss) or claim suffered or brought by an entrant: (a) during the judging; (b) in the participation of a Prize; (c) as a consequence of late, lost or misdirected mail; (d) as a consequence of any technical failure or fault in relation to the use of the websites referred to in these terms and conditions (including but not limited to the failure to upload information and entries on such website or the failure to receive confirmation in relation to entries); or (e) due to the broadcast of the Program and the publication of any material, including any statements made by any staff member, journalist, other entrants or any other person. 6.4 The Promoter, the Sponsor and its affiliates assume no responsibility for any error (human or otherwise), omission, interruption, deletion, defect, delay in the operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the right to take any action that may be available. 6.5 If, for any reason, this Competition is not capable of being conducted as planned, including, but not limited to, reasons such as tampering, unauthorised intervention, fraud, technical failures or other causes beyond the control of the Promoter which corrupt or affect the administration of security, fairness, integrity or proper conduct of this Competition, the Promoter reserves the right, in its sole discretion, to disqualify any individual who interferes with the correct entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state legislation. 6.6 In the case of an intervention of an outside act, agent or event which significantly hinders or prevents the Promoter's ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, storms, natural disasters, acts of God, civil unrest, strike, war, acts of terrorism, the Promoter may in its absolute discretion, cancel the Competition and recommence it from the start on the same conditions. 6.7 Not withstanding anything in these terms and conditions, the Sponsor reserves the right at any time in its sole discretion to: (a) Cancel or modify the Competition or any part of the Competition; (b) Determine and/or vary these terms and conditions without prior notification, including but not limited to the eligibility criteria for the Competition, the selection of the winner, and the timing and venue of any act to be done, and all entrants, and Winners shall be bound by such determination and/or amendments; and (c) Substitute, withdraw or cancel the Prize without prior notice and without having to disclose any reason thereof and without payment of any compensation whatsoever. 7. All entries become the property of the Promoter and your name may be included on a database.
