TERMS AND CONDITIONS: 1. This promotion will be advertised during the 2010 Cricket coverage aired on Nine Network Australia. Information on how to enter and prizes form part of these Conditions of Entry. Entries not completed in accordance with the Conditions of Entry or received after close of entry will not be considered. Incomplete or inaudible entries will be disregarded. The judge’s decision in relation to any aspect of the promotion is final and binding on every person who enters. No correspondence will be entered into. 2. Entry is open to all residents of Australia who are 18 years and over, who is available to travel in September 2011, except for employees of the Promoter, 5th Finger Pty Ltd and their immediate families, and all companies and agencies associated with this promotion. 3. At its sole discretion the Promoter may exclude any person(s) with a criminal record. At its sole discretion the Promoter may exclude any person who has appeared on any broadcast Quiz or Game Show within the 6 months prior to the record date. REGISTRATION PROCESS 4. The Competition open and close times and dates for each “Draw Period” are detailed in Table 1. The promotion commences at 9:00 AEDST Thursday, 25 November 2010 and finishes at 23:59 AEDST Friday 7th January 2011. Draws will take place at 5th Finger Pty Ltd, Level 7, Tower Building, Australia Square, 264 George St, Sydney NSW 2000 as stipulated in table 1 at 10:00 AEDST during the promotional period. All competition open, close and draw dates are shown in Table 1 below. The winners will be notified in writing and telephone and winners will be published in The Australian newspaper on the dates specified in Table 1 below. 5. There are three ways of entering the Vodafone Earl of Twirl Competition: Each test match a celebrity will be chosen to bat against a bowler (The Earl of Twirl) in a cricket net. The bowler will be masked or covered to hide their identity. During this segment viewers will be prompted to vote for who they think is the mystery bowler is which will be featured in an A,B & C format. a. 1-900 Call: Participants can call to register their answer and register their full name, address and a daytime contact telephone number to 1902 555 099 Maximum 1-90 entry cost per message is 55c including GST. Calls from mobiles and pay phones may attract a higher rate. Service Provider: 5th Finger Pty Ltd b. SMS: Participants can text in their answer along with their name and a daytime contact telephone number phone number to 199 55 099. Participants only need to submit a phone number that they can be contacted on if it differs from the mobile phone they entered the competition on. Maximum SMS entry cost per message is 55c including GST. The SMS entry mechanic is only open to consumers with a SMS compatible mobile phone connected to a service provider which permits text messaging to the promotional SMS number. It is recommended that entrants check with their individual service provider in this regard. c. Online: Participants can visit http://wwos.ninemsn.com.au/vodafoneteabreak follow the prompts and register their answer and their full name, address and a daytime contact telephone number. Submit your completed entry as instructed. 6. Multiple competition entries are permitted, subject to the following: (a) only one entry permitted per online entry, SMS message or 190 call; and (b) each entry must be submitted separately and in accordance with the entry requirements. 7. The Promoter is neither responsible nor liable for late, lost, misdirected, incomplete or inaudible entries. At the conclusion of each test match a draw will be conducted out of all the entrants that have guessed the correct bowler to win the minor prize. At the conclusion of all 5 test matches a draw will be conducted from all the correct entries from all five (5) individual draw periods to win the Major prize. 9. For the removal of doubt, each draw is individual. Entries do not collate from draw to draw. For each Draw Period, the Promoter will randomly select one (1) phone, SMS and online entrant from all valid entries registered in the Draw Period as the winner. 10. An entrant is limited to being drawn once during the course of the Competition PRIZES 11. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that the Cape Town Test is postponed, cancelled, rescheduled or relocated for any reason whatsoever. The Promoter is neither responsible nor liable for any loss or damage suffered in the event that members of the Australian cricket team are unavailable or postpone, cancel, reschedule the meet and greet for any reason whatsoever. The members of the Australian cricket team available to participate in the meet and greet is subject to the individual team members schedule and availability at the time of the arranged meet and greet. The Promoter makes no guarantees to the availability of any particular Australian cricket team player. 13. In the event that a prize, or part of a prize, is unavailable, the Promoter reserves the right to substitute the prize of part of the prize in its discretion with an alternative prize or part of the prize to the same and equal recommended retail value and/or specification subject to any written directions from the various Lottery Departments. 14. Prizes are not transferable or exchangeable. Any prizes won will be sent to address as stipulated in their entry. 15. If the winner is under the age of 18 years, the prize will be fortified by the winner. 16. The major prize must be redeemed in September 2011, to coincide with the Event to take place in Cap Town South Africa. Tours component of the prize etc must be taken at a time that coincides with scheduled tours. Redemption of each component of the prize is subject to booking an availibity at time of booking. 17. The winner (and their companion) are responsible for all other expenses including spending money, meals (unless specified), drinks, transfers (unless specified), laundry charges, activities (unless specified), incidentals, energy surcharges, gratuities, services charges, passports, visas, travel insurance and all other ancillary costs associated with redeeming the prize. Travel insurance is highly recommended to protect against the additional costs incurred in the event of unforeseen circumstances. Cost of obtaining travel insurance is the responsibility of the winner. 18. A credit card imprint or cash deposit will be required from the winner at check-in in order to stay in the accommodation, for all incidental charges. Once accommodation vouchers are issued they are unable to changed/ altered. 19. Unless expressly stated in these terms and conditions all other expenses (including travel to and from the departure point) become the responsibility of the winner. 20. The prize (or any part thereof) cannot be sold, is not transferable or exchangeable and cannot be taken for cash. The Promoter is neither responsible nor liable for any variation in the value of the prize. 21. A valid passport is required for all international journeys. It the responsibility of the winner and their travel companion to ensure they have all required travel documentation (including but not limited to passports and visas) as required for travel. 22. Flights and accommodation must be booked and redeemed to coincide the Event. Dates of the Event will be provided by the promoter and/ or service provider. 23. The two (2) flights must be utilized at the same time, for the same travel dates, from the same departure point to the same destination. 24. The winner will be provided with a letter announcing their prize winning status. This letter must be (only original letter will be accepted as valid) when redeeming flight tickets – the letter will be forwarded to the winner. This is a validity issue to ensure the recipient of the flight(s) and accommodation is the actual winner of the competition. 25. Adequate travel insurance for the duration of the trip must be organised by the winner at his/her own expense. Meals or tips, transfer fees (other than specified), excess baggage, government taxes, airport charges and any other personal expenses not specified in the prize package must be paid for by the winner. 26. The Promoter takes no responsibility for prizes damaged, delayed or lost in transit. 27. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. International travel advice can be obtained from various sources, including government, local consular offices and the web site of the Australian Department of Foreign Affairs and Trade. 28. All prizes must be taken as offered. The prize, or any unused portion of the prize, is not transferable or exchangeable and cannot be redeemed as cash. The prize is valued in Australian dollars. The Promoter accepts no responsibility for any variation in the prize value. Prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
