The competition has two rounds.

Round 1.0 - I.T. Innovation.

To win a share of $100,000 in support for your business, you'll be judged on the quality of your entry - including how you overcame your biggest I.T. Challenge, and how innovative your I.T. team was in facing it. Remember, we're looking for a team that has used technology and originality to transform their business.

But you can also be judged on how popular you are. (Harsh, we know.) The winner of the Popular Vote gets an HP Netbook, so make sure you share your entry on Facebook with friends, family and colleagues. We've even included a special Supporters Pack to give your colleagues a nudge.

Entries close 15 January 2011, then our distinguished panel of judges will assess your entry. We'll judge small to medium sized business (less than 200 employees) and large business (more than 200 employees) separately.

Round 2.0 - The 'Ultimate Challenge'.

From Round 1, we'll choose nine finalists to attend the Ultimate Sporting Challenge. It will happen in Melbourne on Friday 11 February 2011.

By then we'll know you're handy with a hard drive, so this is your chance to test yourself in a different arena entirely.

You'll get to return a serve from Aussie tennis great Alicia Molik, face Wallaby Matt Giteau, or go up against Carlton Captain and Brownlow Medallist Chris Judd ... so let's just say it won't be your typical day in the office.

If you're on the I.T. Team, enter here for your business' chance to win a share of $100,000 in support from Optus and an HP Netbook for yourself. If you're not in I.T., then make sure you share it with someone who is.

   1. Information on how to enter and prizes forms part of these Terms and Conditions. Entry into the "Ultimate I.T. Challenge" promotion ("Promotion") is deemed to be an acceptance of these Terms and Conditions.
   2. Promotion commences Sunday, 24, October, 2010 at 9.00am (AEST) and entries close on Saturday 15 January 2011 at 11.50 pm (AEST) ("Promotion Period").
   3. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.
   4. This is a game of skill and chance plays no part in determining the winners.
      Entry
  5. Entry is only open to Australian residents aged 18 years and over who are currently working as information technology professionals or business proprietor in an Australian business. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.
   6. To enter, entrants must, during the Promotional Period submit entries containing the following information:

   7. All entrants must agree to be available to attend the IT Challenge Sports Event on 11 February 2011 in Melbourne VIC should they make the final nine.
   8. The Promoter reserves the right to reject any entry which is not made in accordance with these Terms and Conditions.
   9. Entries may only be submitted via the competition website: www.optus.com.au/ITChallenge
  10. For the purposes of determining the finalists and winners of the Main Prizes (as defined below), eligible entries received will be placed into one of two possible categories:
          * entries received from employees of small and medium businesses (with less than 200 employees) ("SMB Category");
          * entries received from employees of large businesses or government entities (with more than 200 employees) ("Enterprise Category");
      as determined on the date the entry is received.
      Judging & Assessment
  11. There will be a three part judging process to determine:
          * A short list of the 20 best entries out of all eligible entries; and
          * A panel short list of 9 finalists (6 in the SMB Category and 3 in the Enterprise category) out of the short list of 20;
          * The four (4) winners of the Main Prizes (3 in the SMB Category and 1 in the Enterprise category) out of the 9 finalists.
  12. The assessment and selection of the finalists and the winners of the Main Prizes shall be based on merit and the quality of the submission to the entry questions for the I.T. Challenge.
  13. The judging will be conducted by experts appointed by the Promoter acting reasonably.
  14. If any entrant selected as a winner or a finalist is not ready, willing and able to strictly comply with these Terms and Conditions then the Promoter may in its absolute discretion determine that the said entry is void and that a substitute entrant be selected as the finalist or winner as the case may be.
  15. The finalists and winners will be notified by the contact phone number and email address stated at point of entry and by way of the Promotion website www.optus.com.au/ITChallenge on or around the dates specified below:
          * The first 100 entries which will receive a HP Netbook will be notified by the 15 of January 2011
          * 9 Finalists: 26 January 2011
          * 4 Main Prize Winners: 11 February 2011
          * Most Popular Entrant Winner: 26 January 2011
  16. The entrants acknowledge and agree that the Promoter will not be held responsible for changing the above dates. Any changes to the dates will be specified on the Promotion website www.optus.com.au/ITChallenge.
      Prizes
  17. The prizes available in this Promotion are:
          * Four (4) prizes benefiting the business(es) which engage the winning entrants to share in a maximum value of $100,000 ("Main Prize(s)"); and
          * One hundred (100) x HP Mini 5102 Netbooks (Intel® Atom N450 Processor (1.66GHz, 512KB L2 cache, 667MHz FSB, Memory 1 x 2GB DDR2 SDRAM, running at 667MHz, Internal 160GB 7200rpm SATA hard drive with HP 3D DriveGuard )) which have a recommended retail price of $969 each; and

          * One (1) x HP Mini 5102 Netbook (Intel® Atom N450 Processor (1.66GHz, 512KB L2 cache, 667MHz FSB, Memory 1 x 2GB DDR2 SDRAM, running at 667MHz, Internal 160GB 7200rpm SATA hard drive with HP 3D DriveGuard )) which has a recommended retail price of $969 to be awarded to the 'Most Popular Entrant' Winner:
  18. Enterprise Category Prize (More than 200 employees): the prize available to the winner of the Enterprise Category for employees of large businesses or government entities will be:
          * Optus products or services to the value of $50,000 for the business which employs the winner; or
          * $25,000 to help promote the business which employs the winner (including but not limited to a payment towards advertising costs, website development, signage, marketing consultants etc);
      as nominated by the winner.
  19. SMB Category Prize (1-199 employees): the prizes available to the three (3) winners of the SMB Category for employees of small and medium businesses will be:
          * Optus products or services to the value of $16,900.00 for the business which employs the winner; or
          * $10,000 to help promote the business which employs the winner (including but not limited to a payment towards advertising costs, website development, signage, marketing consultants etc);
      as nominated by the winners.
  20. The nine (9) finalists selected by the Judges will each:
          * be awarded an HP Mini 5102 Netbook (Intel® Atom N450 Processor (1.66GHz, 512KB L2 cache, 667MHz FSB, Memory 1 x 2GB DDR2 SDRAM, running at 667MHz, Internal 160GB 7200rpm SATA hard drive with HP 3D DriveGuard )) which has a recommended retail price of $969 each; and
          * participate in the IT Challenge Sports Event, with either Alicia Molik, Matt Giteau and Chris Judd.
  21. One hundred (100) Netbooks (HP Mini 5102 Netbooks(Intel® Atom N450 Processor (1.66GHz, 512KB L2 cache, 667MHz FSB, Memory 1 x 2GB DDR2 SDRAM, running at 667MHz, Internal 160GB 7200rpm SATA hard drive with HP 3D DriveGuard )) which have a recommended retail price of $969 each will be awarded to the first 100 eligible entries made in accordance with these Terms and Conditions as reasonably determined by the Promoter. No individual may be awarded more than one Netbook.
  22. Sports Event prize consists of a signed sports jersey from either Alicia Molik, Matt Giteau and Chris Judd.
  23. One (1) Netbook (HP Mini 5102 Netbooks(Intel® Atom N450 Processor (1.66GHz, 512KB L2 cache, 667MHz FSB, Memory 1 x 2GB DDR2 SDRAM, running at 667MHz, Internal 160GB 7200rpm SATA hard drive with HP 3D DriveGuard )) which has a recommended retail price of $969, will be awarded to the most popular entrant as determined by the number of "likes" recorded for that entry on the promotion facebook site.
  24. The prizes are not transferable or exchangeable and are not redeemable for cash. Any other costs associated with the prizes are the responsibility of the winners or finalists.
  25. If the Promoter determines, in its absolute discretion, that the winner is not in the necessary condition to safely participate in or receive a prize, the Promoter reserves the right to refuse to award to the winner any part of a prize.
  26. Total value of the prizes available in this Promotion is around AU$ 206,321 including GST (though the maximum prize available to any entrant is only a proportion of this). If the Promoter is unable to provide a winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize.
  27. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion. No responsibility will be taken for lost, late or misdirected entries not received by the Promoter. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
  28. If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or mechanical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available.
  29. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process or the reasonable instructions of the Promoter (consistent with these Terms and Conditions) will be ineligible to participate in this Promotion or win any prize and their entry will be declared invalid.
  30. If the winner selects Optus products and services as the prize for the business which employs the winner then these products and services are supplied by Optus under its standard terms and conditions (optus.com.au/ITChallenge).
      Conditions applicable to the Prizes
  31. The awarding of prizes is subject to the standard terms and conditions of individual prize and service providers (such as HP).
  32. If reasonably required by the Promoter any winner of the Main Prizes or any finalist shall sign a Deed accepting these Terms and Conditions before participating in the I.T. Challenge Sports Event or before accepting any prize.
  33. Prizes are non transferable and if for any reason an entrant cannot accept a prize then it is not Optus's responsibility to replace the prize with an alternative.
      Participation in the I.T. Challenge Sports Event
  34. The entrants acknowledge that if selected as one of the nine (9) finalists for the Main Prize they shall participate in the I.T. Challenge Sports Event in Melbourne Australia which will take place in or around 10 – 11 February 2011. The Promoter shall pay for the cost of economy fare domestic flights to and from Melbourne and for two nights of four star accommodation for the finalist (and one additional team member who are to attend but not participate in the I.T. Challenge Sports Day Event). If an entrant is unable or unwilling to participate in the I.T. Challenge Sports Event then the Promoter may in its absolute discretion determine that the said entry is void and may select a substitute entrant as the substitute finalist.
  35. The finalists (who are to participate in the I.T. Challenge Sports Event) must notify the Promoter in writing at least seven (7) days before the date of the I.T. Challenge Sports Event if the finalist is suffering from any health condition or injury or disability which would prevent them from properly participating in the I.T. Challenge Sports Event.
  36. The entrants (if selected as finalists to participate in the I.T. Challenge Sports Event) acknowledge that they participate in the I.T. Challenge Sports Event at their own risk and agree that if they are suffering from any health condition or injury or disability then they should refrain from participating in the I.T. Challenge Sports Event (and withdraw from the Promotion).
  37. The entrants (if selected as finalists to participate in the I.T. Challenge Sports Event) acknowledge that they release the Promoter and its contractors and agents from any liability arising from any adverse health condition or injury suffered by them which was caused or contributed to by their participation in the I.T. Challenge Sports Event.
      General Terms
  38. By entering the Promotion, the eligible entrant agrees and acknowledges that:
          * they must not act in an illegal or inappropriate manner while participating in the Promotion, including providing any material or information, that is defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
          * (if participating in the I.T. Challenge Sports Event) they must follow all reasonable instructions of the Promoter;
          * they will be video recorded and photographed during the I.T. Challenge Sports Event and/or Business Innovation Awards Night;
          * the Promoter may use video recordings, comments or photos (of the entrant and the business employing the entrant) or any materials submitted to the Promoter in connection with the entry (together the "Materials") for the purpose of conducting the Promotion, including but not limited to, displaying name of the entrant, the name of the business employing the entrant, and the use video recordings, comments or photos of the entrant and the said business, or part thereof, on various websites, WAP sites, TV and Print and for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
          * the Promoter may duplicate, alter, adapt and utilise the Materials in any form as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
          * the entrant grants the Promoter a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, modify and display the Materials in connection with the Promotion and Optus' (and its related bodies corporates') business, in any media formats and through any media channels. The above license granted by the entrant is perpetual and irrevocable;
          * the Promoter is under no obligation to use or display the Materials in connection with the Promotion;
          * that their Materials, or edited Materials, could be posted on various websites and WAP sites and may be commented on by members of the public, including criticised, and they will not hold the Promoter responsible in this regard;
          * they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
          * they waive all Moral Rights in the Materials that arise outside Australia; and
          * they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
  39. Incomplete, illegible or incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
  40. By entering this Promotion, the entrants warrant that they have obtained the prior consent of their employer to their participation in this Promotion and to the participation of the employer in this Promotion (to the limited extent set out in these Terms and Conditions).
  41. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
  42. The Promoter reserves the right to disqualify entries in the event of any non-compliance with these Terms and Conditions.
  43. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  44. The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  45. If for any reason this Promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion. It is a condition of accepting the Prize that the winner may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
  46. The winners agree to participate in any news and media/PR activities surrounding the Promotion. The Promoter reserves the right to use each winner's name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.
  47. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize.
  48. Entrants acknowledge that for the purposes of conducting the promotion the following information and materials may be disclosed on the promotion website:
          * Name of the company which engages the entrant;
          * entrant's first name;
          * approximate size of company;
          * approximate size of IT Team;
          * the entrant's answer to the question: "What makes your IT Team so special?";
          * the image of the entrant;
          * the video entry submitted by the entrant;
      however no other personal information supplied by the entrant will be disclosed on the promotion website.
  49. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant's personal information to administer the Promotion, announce the winners and disclosing the entrant's personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter's privacy policy.   18. Enterprise Category Prize (More than 200 employees): the prize available to the winner of the Enterprise Category for employees of large businesses or government entities will be:
          * Optus products or services to the value of $50,000 for the business which employs the winner; or
          * $25,000 to help promote the business which employs the winner (including but not limited to a payment towards advertising costs, website development, signage, marketing consultants etc);
      as nominated by the winner.
  19. SMB Category Prize (1-199 employees): the prizes available to the three (3) winners of the SMB Category for employees of small and medium businesses will be:
          * Optus products or services to the value of $16,900.00 for the business which employs the winner; or
          * $10,000 to help promote the business which employs the winner (including but not limited to a payment towards advertising costs, website development, signage, marketing consultants etc);

  20. The nine (9) finalists selected by the Judges will each:

  21. One hundred (100) Netbooks (HP Mini 5102 Netbooks(Intel® Atom N450 Processor (1.66GHz, 512KB L2 cache, 667MHz FSB, Memory 1 x 2GB DDR2 SDRAM, running at 667MHz, Internal 160GB 7200rpm SATA hard drive with HP 3D DriveGuard )) which have a recommended retail price of $969 each will be awarded to the first 100 eligible entries made in accordance with these Terms and Conditions as reasonably determined by the Promoter. No individual may be awarded more than one Netbook.
  22. Sports Event prize consists of a signed sports jersey from either Alicia Molik, Matt Giteau and Chris Judd.
  23. One (1) Netbook (HP Mini 5102 Netbooks(Intel® Atom N450 Processor (1.66GHz, 512KB L2 cache, 667MHz FSB, Memory 1 x 2GB DDR2 SDRAM, running at 667MHz, Internal 160GB 7200rpm SATA hard drive with HP 3D DriveGuard )) which has a recommended retail price of $969, will be awarded to the most popular entrant as determined by the number of "likes" recorded for that entry on the promotion facebook site.
  24. The prizes are not transferable or exchangeable and are not redeemable for cash. Any other costs associated with the prizes are the responsibility of the winners or finalists.
  25. If the Promoter determines, in its absolute discretion, that the winner is not in the necessary condition to safely participate in or receive a prize, the Promoter reserves the right to refuse to award to the winner any part of a prize.
  26. Total value of the prizes available in this Promotion is around AU$212,330 including GST (though the maximum prize available to any entrant is only a proportion of this). If the Promoter is unable to provide a winner with the nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value to the nominated prize.
  27. The Promoter accepts no responsibility for any entries not received for any reason during the Promotion. No responsibility will be taken for lost, late or misdirected entries not received by the Promoter. The Promoter is not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
  28. If, for any reason, the Promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failure or mechanical failure or any other causes beyond the control of the Promoter, which corrupt or affect the administration security, fairness or integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to take any action that may be available.
  29. Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process or the reasonable instructions of the Promoter (consistent with these Terms and Conditions) will be ineligible to participate in this Promotion or win any prize and their entry will be declared invalid.
  30. If the winner selects Optus products and services as the prize for the business which employs the winner then these products and services are supplied by Optus under its standard terms and conditions (optus.com.au/ITChallenge).
      Conditions applicable to the Prizes
  31. The awarding of prizes is subject to the standard terms and conditions of individual prize and service providers (such as HP).
  32. If reasonably required by the Promoter any winner of the Main Prizes or any finalist shall sign a Deed accepting these Terms and Conditions before participating in the I.T. Challenge Sports Event or before accepting any prize.
  33. Prizes are non transferable and if for any reason an entrant cannot accept a prize then it is not Optus's responsibility to replace the prize with an alternative.
      Participation in the I.T. Challenge Sports Event
  34. The entrants acknowledge that if selected as one of the nine (9) finalists for the Main Prize they shall participate in the I.T. Challenge Sports Event in Melbourne Australia which will take place in or around 10 – 11 February 2011. The Promoter shall pay for the cost of economy fare domestic flights to and from Melbourne and for two nights of four star accommodation for the finalist (and one additional team member who are to attend but not participate in the I.T. Challenge Sports Day Event). If an entrant is unable or unwilling to participate in the I.T. Challenge Sports Event then the Promoter may in its absolute discretion determine that the said entry is void and may select a substitute entrant as the substitute finalist.
  35. The finalists (who are to participate in the I.T. Challenge Sports Event) must notify the Promoter in writing at least seven (7) days before the date of the I.T. Challenge Sports Event if the finalist is suffering from any health condition or injury or disability which would prevent them from properly participating in the I.T. Challenge Sports Event.
  36. The entrants (if selected as finalists to participate in the I.T. Challenge Sports Event) acknowledge that they participate in the I.T. Challenge Sports Event at their own risk and agree that if they are suffering from any health condition or injury or disability then they should refrain from participating in the I.T. Challenge Sports Event (and withdraw from the Promotion).
  37. The entrants (if selected as finalists to participate in the I.T. Challenge Sports Event) acknowledge that they release the Promoter and its contractors and agents from any liability arising from any adverse health condition or injury suffered by them which was caused or contributed to by their participation in the I.T. Challenge Sports Event.
      General Terms
  38. By entering the Promotion, the eligible entrant agrees and acknowledges that:
          * they must not act in an illegal or inappropriate manner while participating in the Promotion, including providing any material or information, that is defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
          * (if participating in the I.T. Challenge Sports Event) they must follow all reasonable instructions of the Promoter;
          * they will be video recorded and photographed during the I.T. Challenge Sports Event and/or Business Innovation Awards Night;
          * the Promoter may use video recordings, comments or photos (of the entrant and the business employing the entrant) or any materials submitted to the Promoter in connection with the entry (together the "Materials") for the purpose of conducting the Promotion, including but not limited to, displaying name of the entrant, the name of the business employing the entrant, and the use video recordings, comments or photos of the entrant and the said business, or part thereof, on various websites, WAP sites, TV and Print and for the Promoter's future promotional and marketing purposes without further reference or compensation to them;
          * the Promoter may duplicate, alter, adapt and utilise the Materials in any form as the Promoter wishes at any time, anywhere, and by any means. The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
          * the entrant grants the Promoter a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, modify and display the Materials in connection with the Promotion and Optus' (and its related bodies corporates') business, in any media formats and through any media channels. The above license granted by the entrant is perpetual and irrevocable;
          * the Promoter is under no obligation to use or display the Materials in connection with the Promotion;
          * that their Materials, or edited Materials, could be posted on various websites and WAP sites and may be commented on by members of the public, including criticised, and they will not hold the Promoter responsible in this regard;
          * they unconditionally and irrevocably consent to any act or omission that would otherwise infringe any of their moral rights in the Materials (as defined in Part IX of the Copyright Act 1968 (Cth)) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
          * they waive all Moral Rights in the Materials that arise outside Australia; and
          * they agree not to institute, maintain or support any claim or proceeding for infringement of their Moral Rights in the Materials.
  39. Incomplete, illegible or incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third party rights, including intellectual property rights, are not eligible to win.
  40. By entering this Promotion, the entrants warrant that they have obtained the prior consent of their employer to their participation in this Promotion and to the participation of the employer in this Promotion (to the limited extent set out in these Terms and Conditions).
  41. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
  42. The Promoter reserves the right to disqualify entries in the event of any non-compliance with these Terms and Conditions.
  43. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
  44. The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  45. If for any reason this Promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion. It is a condition of accepting the Prize that the winner may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.
  46. The winners agree to participate in any news and media/PR activities surrounding the Promotion. The Promoter reserves the right to use each winner's name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.
  47. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of the Prize.
  48. Entrants acknowledge that for the purposes of conducting the promotion the following information and materials may be disclosed on the promotion website:
          * Name of the company which engages the entrant;
          * entrant's first name;
          * approximate size of company;
          * approximate size of IT Team;
          * the entrant's answer to the question: "What makes your IT Team so special?";
          * the image of the entrant;
          * the video entry submitted by the entrant;
      however no other personal information supplied by the entrant will be disclosed on the promotion website.
  49. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the mandatory personal information requested then you will not be able to take part in the Promotion. By entering this Promotion, each entrant is taken to consent to the Promoter using the entrant's personal information to administer the Promotion, announce the winners and disclosing the entrant's personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the entrant is taken to consent to the Promoter's privacy policy.
