Win a Harley Promotion – Terms & Conditions

1. Information on how to enter, claim, prizes and gifts forms part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

2. Entry is only open to Australian or New Zealand residents who are employees or business owners of any Australian or New Zealand registered business (“Business”) who have been authorised to personally enter by the Business (“Entrants”), excluding: (a) employees of the Promoter and the Promoter’s agencies associated with this promotion and their immediate family members; (b) the Promoter’s resellers, wholesalers, suppliers, contract customers, contract caterers or operators with exclusive supply agreements and their employees; and (c) government and statutory bodies and their employees. Notwithstanding the foregoing, the Promoter may in its absolute discretion determine other Businesses and employees that are excluded. Entrants under the age of 18 years must obtain the consent of their parent or legal guardian to enter.

3. Promotion commences at 9am AEST on 1 October 2010 and closes 5pm AEDST on 31 January 2011 (“Promotional Period”), and no other entries/claims after this date will be accepted.

4. To enter the draw or claim a gift, Entrants must during the Promotional Period, purchase, on behalf of their Business, in a single transaction from any participating distributor nationally, either: (a) 6 or more units of Participating Regular Knorr or Hellmann’s Products as specified below; or (b) 1 or more units of Participating Bulk Knorr or Hellmann’s specified below(“Qualifying Purchase”), by completing in full the Turn In Order form and submitting it by one of the following methods:
(i) via fax to 1800 008 405 (for Australian residents) or 0800 614 411 (for New Zealand residents);
(ii) via hand to a Unilever representative; or
(iii) alternatively the Entrant can fax in their tax invoice recording the Qualifying Purchase to 1800 008 405 (for Australian residents) or 0800 614 411 (for New Zealand residents).
so that either the Turn in Order Form or tax invoice is received by 5:00pm AEDST on 31.01.2011.

5. Turn in Order forms will be available via a direct mail piece, in selected trade media publications, provided to individuals directly by a Unilever Foodsolutions representative, or be available at Unilever Sales Offices and can be downloaded at the Unilever Foodsolutions website www.unileverfoodsolutions.com.au or www.unileverfoodsolutions.co.nz. Cancellation of an order or return of one or more of the products from an order will invalidate any entitlement to an entry or gift in connection with the relevant order.

6. On the Turn In Order forms the Entrants will need to nominate who the gift and entries are to be awarded to, which can be either an individual or the Business (“Nominated Recipient”). The individual who submits the Turn In Order form warrants that they are authorised to nominate who is to be the Nominated Recipient. The Promoter accepts no responsibility should the individual not have obtained the appropriate approval. Notwithstanding the foregoing, if the Business is a registered club, in accordance with the applicable laws in which the club resides, the gift and entries will be awarded to the Business and not to the Entrant, despite what may be recorded on the Turn In Order form. If the Entrant submits their invoices without a Turn In Order form the entries and gift cards will be awarded to the Business (i.e. the Business will automatically be the Nominated Recipient).

7. An Entrant can submit a Turn In Order form or invoice on a number of occasions, by following the process in Clause 4, however each Turn In Order form or invoice must be submitted separately and accordance with the entry requirements. Limit of one (1) gift card and entry awarded per 6 units of Participating Regular Knorr or Hellmann’s Products purchased in one transaction. For the removal of doubt this means if an Entrant purchases .18 units of Participating Regular Knorr or Hellmann’s Products in one transaction a total of three (3) gift cards and three (3) entries will be awarded. Limit of one (1) gift card and entry awarded per 1 of Participating Bulk Regular Knorr or Hellmann’s Products purchased in one transaction. For the removal of doubt this means if an Entrant purchases 3 units of Participating Bulk Regular Knorr or Hellmann’s Products in one transaction a total of three (3) gift cards and three (3) entries will be awarded.

8. After the conclusion of the Promotional Period, the Promoter will determine:
(a) the number of gift cards to be awarded to each Nominated Recipient in accordance with Clause 9;
(b) the number of entries that will be awarded to each Nominated Recipient in the draw in accordance with Clause 10;
based on the number of Qualifying Purchases entered during the Promotional Period.

9. The gift card is a $10.00 Woolworths Essentials Gift Card for Australian residents and a $10.00 BP Fuel Card for New Zealand residents. The gift cardswill be provided to the successful Nominated Recipient directly by a Unilever Foodsolutions representative or via mail. Any ancillary costs associated with redeeming the Gift Cards are not included. Any unused balance of the Gift Cards will not be awarded as cash. Redemption of the Gift Cards is subject to any terms and conditions of the issuer including those specified on the Gift Cards. The $10.00 Woolworth Essentials Gift Card can only be used at participating Woolworths, Woolworths Caltex and Big W outlets where EFTPOS facilities are available and operational for purchase of any goods or services available at these outlets, up to the value of $10.00. The BP Fuel Card can only be used at BP outlets where EFTPOS facilities are available and operational for purchase of any goods or services available at these outlets, up to the value of $10.00. No cash out facilities are available. The $10.00 Gift Cards are valid until the date specified on the Card.

10. For each Qualifying Purchase that has been entered, the relevant Nominated Recipient will receive one (1) entry in the draw.

11. The draw will take place at the Promoter’s office at Unilever Australia Limited ABN 66 004 050 828 of 20 Cambridge Street, Epping NSW 2121 on 11.02.11 at 12pm. The Promoter reserves the right to draw reserves in the case of ineligibility or the entry is deemed invalid. The winners of the draw will be notified by mail and phone. The Australian winners of the draw will have their name and postcode published in The Australian on 21.02.11. The Promoter’s decision is final and no correspondence will be entered into.

12. The first valid entry drawn will the (“Major Prize “) of their choice of either:
a) a Harley Davidson Motorcycle 2010 VRSC Night Rod Special;
b) a Harley Davidson Motorcycle 2010 Fat Boy Lo; or
c) $30,000 cash awarded in the form of a cheque.
The Harley Davidson Motorcycle is valued at up to AUD$31,633 (depending on model chosen) and includes registration, compulsory third party insurance, stamp duty and dealer delivery charges (which may vary depending upon the location of the winner). Each Harley Davidson Motorcycle includes the delivery of the chosen motorcycle to the winner’s nearest Harley Davidson dealer location. Additional taxes, insurance, transport to and from dealer location to collect the Harley Davidson Motorcycle and all other ancillary costs are not included.

13. The next eighteen (18) valid entries drawn will each win an LG 42” 106cm Full High Definition LCD TV (model 42LD460), valued at AUD $1,000 each (“Minor Prize”).

14. Entrants are required to keep the original or copies of all invoice(s) for all entries/claims to be valid. Failure to provide these to the Promoter upon request may, at the Promoter's discretion, result in an invalid entry/claim (and, at the Promoter's discretion, in all of the Entrant’s or Nominated Recipient’s entries/claims being invalidated). Entries/claims are deemed accepted at the time of receipt and not at the time of transmission. The Promoter reserves the right to request proof of purchase for each entry/claim made to verify all entries/claims before awarding the prize or gift. Where a copy of the invoice(s) is not provided on request, or the invoice(s) record a Qualifying Purchase outside of the Promotional Period, the entry/claim will be deemed invalid.

15. Any contact details entered incorrectly may invalidate the entry/claim. The Promoter is not responsible for receipt of incomplete or incomprehensible entries/claims. All such inaccurate entries/claims will be deemed invalid. No responsibility is accepted for late, lost or misdirected entries/claims.

16. Total potential prize pool is valued at up to AUD$49,633. Total potential prize pool for ACT resident including the value of gifts that may be claimed by ACT residents as reasonably calculated by the Promoter is up to AUD$82,383  .

17. The Promoter reserves the right to verify the validity of entries/claims, at any time during or after the promotion, and reserves the right to disqualify any Entrant or Business (and ALL entries/claim submitted by the Entrant) for tampering with the entry/claim process for submitting an entry/claim which is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

18. The Promoter accepts no responsibility for any tax implications that may arise from the awarding or acceptance of any benefits provided to anyone under this promotion, including gifts, prizes, transport or accommodation. Independent financial and tax advice should be sought.

19. A prize or gift, or any unused portion of a prize or gift, is not transferable or exchangeable and cannot be taken as cash unless specified otherwise.

20. In the event that a prize or gift is not available despite the Promoter’s reasonable endeavours to procure the prize or gift, the Promoter reserves the right to substitute a prize or gift with something of equivalent standard and value, subject to any written directions from a relevant Regulatory Authority.

21. The Promoter will conduct an unclaimed prize draw, using all entries received in the original draw, in order to award any unclaimed Major or Minor Prize. The draw for any unclaimed Major or Minor Prize may take place on 11.05.2011 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified in writing and the winners’ name and postcode will be published in The Australian on 25.05.2011.

22. The Promoter accepts no responsibility for any variation in the prize or gift value.

23. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize or gift.

24. It is a condition of accepting any prize that the relevant Nominated Recipient sign a participation agreement in a form determined by the Promoter.

25. In the event of war, terrorism, state of emergency or disaster the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, subject to any written directions from a relevant Regulatory Authority.

26. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the telephone or internet user or for any of the equipment or programming associated with or utilised in this promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this promotion including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, technical problems or traffic congestion on the internet or website, software failure, theft or destruction or unauthorised access to or alteration of entries/claims and any injury or damage to participants or any other person’s computer related to or resulting from participating in or downloading any materials in the promotion.

27. If for any reason this promotion is not capable of running as planned, including but not limited to technical failures, unauthorised intervention, fraud or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry/claim process, and, subject to any written directions given by a relevant Regulatory Authority, to cancel, terminate, modify or suspend the promotion.

28. All entries/claim become the property of the Promoter. The Promoter collects Entrants and other individuals’ personal information in order to conduct the promotion. If the information requested is not provided, the Entrant and the Business may not participate in the promotion. By entering this promotion, unless otherwise advised, each Entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the Entrant, including sending the Entrant electronic messages. Entrants’ and other individuals’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation. 29. Nominated Recipients consent to the Promoter using the Nominated Recipients’ name, likeness, image and/or voice in the event they are a winner of any prize (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

30. The Promoter reserves the right to request individuals to provide proof of age, identity and residency. Identification considered suitable for verification is at the discretion of the Promoter.
