Entry into the promotion is deemed acceptance of these Conditions of Entry. Entry is via Internet only. Entry is only open to residents of Australia aged 18 years or older who are able to travel to Melbourne, Australia for the period 14/1/2011 - 16/1/2011 (inclusive) (Entrants). The directors, management and employees (and their immediate families) of the Promoter, its related entities, printers, suppliers, providers and agencies whom are directly associated with the conduct of this promotion are ineligible to enter the promotion. Promotion commences at 12:01 am (AEDT) on 15/11/2010 and closes at 11:59 pm (AEDT) on 15/12/2010 (Promotional Period). The draw will take place at midday (AEDT) on 17/12/2010 at Contact Management Associates (VIC) Pty Ltd, 92-94 Tope St, South Melbourne VIC 3205. The winner will be notified by telephone and in writing. The winner’s name and locality will be published in The Australian on 21/12/2010. The Promoter’s decision is final and no correspondence will be entered into. To enter the promotion Entrants must, during the Promotional Period, log on to www.luckyaami.com.au/kooyong (Promotional Website) to fully and correctly complete and successfully submit the online entry form, including providing the Entrant’s full name, postcode and current and valid email address. Entrants may invite friends or relatives to enter the promotion. To invite friends or relatives, Entrants must submit their friends’ or relatives’ names and email addresses (and any other required information) in the manner required and where indicated when submitting the online entry form. Entrants who invite friends or relatives to enter the promotion will gain one (1) additional entry into the promotion for each friend/relative they invite in the required manner up to a maximum of five (5) additional entries. The operation of the referral mechanic referred to above is subject to the Spam Act 2003. An Entrant may refer a particular friend or relative only once during the Promotional Period and Entrants who have already entered the promotion cannot be referred as friends or relatives by a subsequent Entrant. Each Entrant’s relative or friend nominated must be an Australian resident and be aged 18 years or older. Each Entrant warrants that any and each friend or relative that they nominate is known to them personally and that they have permission to send email communications to such persons. Entrants are limited to up to a maximum of six (6) entries into the promotion: a maximum of one (1) entry via the mechanic stated in Condition 4 and up to a maximum of five (5) additional entries via the online referral mechanic stated in Condition 5. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved. The first eligible entry drawn from all entries received will receive one (1) travel prize to Melbourne, Australia for the winner and one (1) travel companion (aged 18 years or older) for the period 14/1/2011 - 16/1/2011 (inclusive), valued at up to $12,000.00 (Travel Prize). The Travel Prize includes: two (2) adult return economy airfares to Melbourne, Australia from the Australian capital city airport closest to the ordinary residential address of the winner (inclusive of airfare related taxes and charges). If the winner’s residential address is in Melbourne, Australia or the metropolitan/regional area of Melbourne, Australia, this component of the Travel Prize is forfeited; two (2) nights (Club Suite or similar) at The Langham Hotel, 1 Southgate Avenue Southbank, Melbourne VIC 2006, including daily breakfast and welcome pack on arrival (Accommodation); one (1) Eureka Skydeck + Edge viewing experience for two (2) people; one (1) Melbourne Lanes & Arcades Shopping Tour for two (2) people with a shopping spree for the winner only, up to a maximum value of $3,000.00; two (2) seats in the 2011 AAMI Kooyong Classic Corporate dining marquee for one (1) day only, including a two (2) hour (maximum) two (2) course lunch; two (2) premium reserved seats at the 2011 AAMI Kooyong Classic for one (1) day of tennis matches; the opportunity to ‘meet and greet’ a renowned tennis player at the 2011 AAMI Kooyong Classic (Tennis Player), including the opportunity to take photographs with the Tennis Player and having merchandise signed by the Tennis Player; one (1) theatre package for two (2) people, including dinner at a five (5) star restaurant and two (2) tickets to the theatre production of ‘Mary Poppins’ at Her Majesty’s Theatre, Melbourne; and return transfers by corporate car to and from the destination airport and the Accommodation, and the Accommodation and the 2011 AAMI Kooyong Classic. The Travel Prize must be taken for the period 14/1/2011 - 16/1/2011 (inclusive) to coincide with the 2011 AAMI Kooyong Classic, or the Travel Prize is forfeited. All components of the Travel Prize must be taken together and when offered or are forfeited. The winner and companion must travel together and depart from and return to the same departure point. The winner and companion may not accrue frequent flyer points. No extension or variation of the travel dates nominated by the Promoter permitted. Use of the Travel Prize and any passes or vouchers issued as part of the Travel Prize may be subject to prevailing prize supplier terms and conditions of use. The Travel Prize cannot be used in conjunction with travel discounts or special offers. Travel and accommodation are to be arranged by a licensed travel agent nominated by the Promoter. All additional costs not expressly stated, but which may be incurred in acceptance and use of the Travel Prize, are the responsibility of the winner and companion. Such additional costs include, but are not limited to, additional meals, beverages, room service, telephone calls, laundry services, spending money, transport to and from airport departure point, other transfers, taxes including arrival and departure taxes (if applicable), insurance, travel insurance, passports and visas (if applicable). Winner may be required to present a credit card at time of accommodation check-in. Acceptance of the Travel Prize is subject to any prevailing terms and conditions of the 2011 AAMI Kooyong Classic organisers (including but not limited to ground security and ticketing) as well as accommodation/transport/services/transfers or tour providers, and in particular, health, behaviour, age and safety requirements. No compensation will be payable if a winner, or their travel companion, are unable to use any element of the Travel Prize as stated for whatever reason, including refusal of entry or ejection from the 2011 AAMI Kooyong Classic or participation in certain activities for health, age, behaviour or safety reasons. Any part of the Travel Prize that is not taken for any reason is forfeited. Total maximum Travel Prize value is up to $12,000.00. The Travel Prize is not transferable or exchangeable and cannot be taken as cash (unless otherwise indicated). The Promoter accepts no responsibility for any tax implications that may arise from the Travel Prize winnings. Independent financial advice should be sought. The Promoter accepts no responsibility for any variation in Travel Prize value. All Travel Prize values are the recommended retail price including GST, depending on point of departure. The Promoter may draw ten (10) additional reserve entries in the draw and record them (in order) in case an invalid entry or ineligible Entrant is drawn, the Entrant is unable to accept the Travel Prize, or if the Entrant does not confirm their eligibility to be awarded the Travel Prize in the required time as per Condition 15. The person whose entry was drawn must confirm their eligibility to be awarded the Travel Prize, and ability to take the Travel Prize, within two (2) days of being successfully notified by the Promoter that they have been drawn, otherwise their entry will be deemed invalid. If their entry is deemed invalid or if the Entrant does not confirm their eligibility to be awarded the Travel Prize, and ability to take the Travel Prize within the two (2) days of being successfully notified by the Promoter that they have been drawn, their entry will be deemed invalid, and the Travel Prize will be awarded to the first reserve entry drawn in accordance with Condition 14.The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures. If the Travel Prize cannot be awarded to the person drawn, the Promoter will continue the process set out in Conditions 14 and 15 with the reserve entries (in turn) until the Travel Prize is awarded. If after this process the Travel Prize has still not been awarded, the Promoter will hold an unclaimed prize draw in accordance with Condition 17. The Promoter may conduct a further draw at the same time and place as the original draw as is necessary on 4/1/2011 in order to award the Travel Prize if unclaimed by that date, subject to any written directions given under applicable State or Territory legislation. In the event of any winner in the unclaimed prize draw, the winner will be notified by telephone and in writing and the name and locality of the winner will be published in The Australian on 7/1/2011. The Promoter encourages consumers to enjoy alcohol in moderation. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid. The Promoter reserves the right to request the winner’s travel companion produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the travel companion’s identity and age before issuing the Travel Prize. It is a condition of accepting the Travel Prize that the winner and their travel companion may be required to sign a legal release/s or release/s in a form determined by the Promoter in its absolute discretion. The Travel Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion. Contact details entered incorrectly on the Promotional Website by an Entrant will deem an entry invalid. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. Entrants acknowledge that the ‘meet and greet’ with the Tennis Player element of the Travel Prize cannot be guaranteed as it is dependent upon the factors on the day which cannot be determined ahead of time, such as weather, mechanical issues and other unforseen factors. The Promoter will not offer any alternative prize element in the event this element of the Travel Prize cannot be offered. The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to the Entrant's or any other person's mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
