Conditions of entry for the NextMedia Toyota Corolla Group Christmas Subscriptions Promotion
1. Information on how to enter and the prizes form part of these conditions of entry. Entry into the competition is deemed acceptance of the terms and conditions.
2. Entry is open only to all residents of Australia and New Zealand over the age of 18 years, holding a valid unrestricted drivers licence.
3. The Promoter is nextmedia. Employees of nextmedia and their advertising agencies, newsagents, subagents, respective employees and their immediate families are ineligible to enter.
4. Promotion commences 12:01am, Wednesday 17th November 2010 and closes 11.59pm, Wednesday 16th February 2011 (the promotional period) and the winner will be drawn at 11:00am Tuesday 22nd February 2011 at NextMedia, Level 6, 207 Pacific Highway, St Leonards NSW 2065.
Winner will be notified by writing and phone within 7 days of the draw. The prize winner will be published in the Public Notices section of The Australian Thursday 3rd March 2011.
Judges’ decision is final and no correspondence will be entered into.

If a prize is unclaimed, a second draw will be held on Thursday 26th May 2011 at 11:00am the office of NextMedia, Level 6, 207 Pacific Highway, St Leonards NSW 2065 subject to any written directions given under Reg. 37 of the Lottery and Gaming Regulations, 1993 (SA), The winner will be notified in writing and their name will be published in the public notices section of The Australian on Wednesday 1st June 2011.

The major prize value at 13 October 2010 is AU$31,564, NZ$36,039 and includes in Australia a Toyota Corolla Levin ZR Hatch car RRP AU$27,990*, and if the prize winner is in New Zealand, a Toyota Corolla GLX 1.8 litre auto hatch - ZRPHS, RRP NZ$34,490. *Recommended retail price excluding dealer delivery charges which may vary from dealer to dealer, stamp duty which varies from state to state, registration and compulsory third party insurance costs. Prize also includes petrol/ 12 months registration/ on road costs (fuel, registration, dealer delivery fee, warrant of fitness, groom). Prize to be delivered or collected from nearest Toyota dealer within 28 days of the notification of the winner (as per VIC permit requirement). Additional insurance, additional options or modifications, additional petrol and all other ancillary costs are the responsibility of the winner. Selection of colour of prize awarded is at the complete discretion of the Promoter and is subject to availability. The Promoter takes no responsibility for any mechanical, body or paint repairs from the date and time of collection of the prize. Winner must have a current valid Australian or New Zealand driver’s licence. If the winner is, through any legal incapacity or otherwise, unable to register the car in their own name, then such winner may assign the motor vehicle prize to another person (who consents to such assignment) with legal capacity for the purpose of registration. The Promoter takes no responsibility for any such arrangements between the winner and the assignee. The winner must provide the Promoter with certified copies of all required documentation as required by the Promoter before the car is awarded. The winner will be responsible for any expenses incurred in getting to and from their nearest authorised Toyota dealership to collect the prize. If the winner fails to return the required documentation within 3 months of the closing date they will forfeit their prize and the prize will be entered into the unclaimed prize draw.
10. There is one major prize and the total prize pool is valued at AU$31,564 (NZ$36,039) at the time of printing.
11. The Promoter accepts no responsibility for any variation in the value of the prizes. All prize values are in Australian dollars.
12. Prizes are not transferable or redeemable for cash or kind. 13. Winners must take the prizes as offered.
14. The Promoter reserves the right to substitute the prize with a prize of equal or great value if the prize is for some reason unavailable subject to gaming authority approval.
15. Unless otherwise specified, all ancillary costs are the winner’s responsibility.
16. Any change in the value of the prize between the publishing date and the date prizes are claimed is not the responsibility of the promoter/s.
17. We are not responsible for any incorrect or inaccurate information, either caused by you or for any of the equipment or programming associated with or utilised in the competition, or for any technical error, or any combination thereof that may occur in the course of the administration of the competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
18. We are not responsible for lost, late, incomprehensible or incorrect entries in the competition. We also accept no responsibility for any tax implications that may arise from prize winnings in the competition. You should seek Independent financial advice about such matters.
19. In the event of war, terrorism, state of emergency, disaster or (without limitation) any other event outside our reasonable control, we are entitled to cancel, terminate, modify or suspend the competition - subject to any written directions from the various regulatory bodies responsible for supervising the conduct of the competition (the Lotteries Departments).
20. If for any reason the competition is not capable of running as planned (including but not limited to) technical failures, unauthorised intervention, fraud or any other causes beyond our control which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, we are entitled in our sole discretion to disqualify any individual who tampers with the entry process, and (subject to any written directions given by the various Lotteries Departments), to cancel, terminate, modify or suspend the competition.
21. The winners release the Promoter from any and all causes of action, losses, liability, damage, expense (including legal expenses) cost or charge suffered, sustained or in any way incurred by the winner as a result of any loss or damage to any physical property of the winner, or any injury to or death of any person arising out of, or related to, or in any way connected with the Promoters or the prize.
22. In the event of a promoter other than nextmedia cancelling any event related to this prize, nextmedia cannot be held responsible.
23. All entries become the property of the Promoters. All entries will be entered into a database and the Promoter may use the entrants’ names and addresses for future promotional, marketing and publicity purposes.
24. The winner agrees to participate in any news media activities surrounding the promotion.
