The best cover shots capture a moment or an emotion that evokes the spirit of our cities. We seldom, if ever, use professional photographers for our covers. Some of our favourite shots are taken on disposable cameras and phones. We believe that it’s not the technology, but what you do with it, that counts. Enter We are putting out a call for your covers. Entering is easier than taking an arty shot on a Lomo – just follow the steps below. 1. Carefully select your cover shot 2. Send it to covercomp@rightanglestudio.com.au with your city in the subject line. Please also include your name, and a URL or Twitter address if you have one 3. We’ll select and upload a bunch of our favourite shots to the Gallery every day. Please note that we might have to crop your image slightly to fit The Thousands specs (590x340px) WIN On December 13, The Thousands City Guide Editors will select five Cover Competition City Winners. Copyright of all images submitted remains with the photographer. “THE THOUSANDS COVER COMPETITION” TERMS AND CONDITIONS 1) Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2) Entry is only open to Australian residents aged 18 years or over. Employees (and their immediate families) of the Promoter, the Sponsor and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 3) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 4) Promotion commences 11:00am (AEST) December 2, 2010, and ends at 11:00am (AEST) December 13, 2010 (Promotion Period). Any entries received after this time will not be considered and are not eligible for the prize. 5) To participate in the Promotion, entrants must, during the Promotional Period: i. Submit a photograph that they have captured in the required format (.jpeg and must not exceed two (2) MB file size) ii. Send it to covershotcomp@rightanglestudio.com.au with the name of their city in the subject line of the email; and iii. Include within the body of the email their name, residential address in Australia and a URL or Twitter address if they have one. All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions. 6) All valid entries will be displayed at the following website: www.thethousands.com.au/covercompetition. The Promoter reserves the rights to remove any entry which it deems inappropriate, offensive or invalid at anytime. The Promoter also reserves the right to crop images if needed to meet www.thethousands.com.au/ website image specifications. 7) Incomplete, indecipherable or illegible entries will be deemed invalid. 8) Multiple entries permitted, subject to the following: (a) each entry must be submitted separately and in accordance with entry requirements (b) entrants can enter multiple times by submitting a substantially unique and new Photo Submission. 9) Any entries that contain content that the Promoter, in its sole discretion, considers to be offensive or inappropriate in any way or that the Promoter considers, in its sole discretion, to infringe any Intellectual Property Rights or other rights of any person, corporation or entity, will not be considered eligible entries into the promotion. Without limiting any of the provisions of these Conditions of Entry, the Promoter requires that any entry not include or make reference to any visible logos, drawings, cartoons, phrases, trade marks or other third party materials (including but not limited to any copyrighted material, trade mark, logo or mark that identifies a brand) as it could result in a third party subjecting the entrant and/or the Promoter to legal liability. The decision to accept or reject an entry as an eligible entry is in the Promoter’s sole discretion and no correspondence will be entered into. 10) Entries that contain content that the Promoter, in its sole discretion, considered to be one or more of the following content types will not be considered eligible Entries into the promotion: a) content that depicts, alludes to or promotes offensive or illegal behaviour; b) Content that does not depict the personages that have been declared as appearing in it; c) harm of any kind against any group or individual; d) content that harasses or advocates harassment of another person; e) content that exploits people in a sexual or violent manner; f) content that contains nudity, violence, or offensive subject matter or contains a link to an adult website; g) content that solicits personal information from anyone under 18; h) content that provides any telephone numbers, street addresses, last names, URLs or email addresses; i) content that promotes information that entrants know is false or misleading or promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous; j) content that promotes an illegal or unauthorised copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copyprotect devices, or providing pirated music or links to pirated music files; k) content that involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing, instant messaging, "spamming"; l) content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to making or buying illegal weapons, violating someone's privacy, or providing or creating computer viruses; m) content that solicits passwords or personal identifying information for commercial or unlawful purposes from other users; 3 n) content that involves commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, or pyramid schemes; o) content that contains any viruses, Trojan horses, worms, time bombs, cancelbots, easter eggs or other computer programming routines that may damage, modify, delete, detrimentally interfere with, surreptitiously intercept, access without authority or expropriate any system, data or personal information; p) content that has been used in previous marketing materials or promotions for any third party or where any third party has been granted use of that content for any purpose whatsoever, including commercial purposes; q) content that includes an image or reference to another person that you have submitted without that person's consent; or r) content that uses sexually suggestive imagery or any other unfair, misleading or deceptive content. 11) There will be five (5) provisional winners for this competition (“Provisional Winners”). All entries completed and submitted in accordance with these Terms and Conditions will be judged at by a panel of judges, appointed by the Promoter at its sole discretion, to select the best five (5) entries. Judging will take place at 04:00pm (AEST) Dec 13, 2010, Suite 29, 94 Oxford St, Darlinghurst, Sydney, and all Provisional Winners will be notified in writing (via email) and will have their photos and names posted on www.thethousands.com.au/covercompetition. The Promoter’s decision is final and no correspondence will be entered into. 12) The winning entries will be selected based on criteria which includes but is not limited to: i) originality of photo ii) displays the spirit of the city in which it was taken in and in line with The Thousands Cover shot aesthetic and iv) overall appearance of photograph – not overly composed or stage, and is colourful and vibrant. This is a game of skill. There is no element of chance in the judging and determination of the Provisional Winners. All entries must be the original independent creation of the entrant and free of any claims that they infringe any third party rights. Entries must not have been published previously and/or have been used to win prizes in any other competitions. Entrants agree to indemnify and hold harmless the Promoter and its competition sponsor from any copyright, trademark, or other intellectual property infringement claim or liability with regard to their blog submissions. 13) Each Provisional Winner will receive: a. AUD$250; b. One (1) new Nokia N8 mobile phone. (RRP AU$749);and c. Have their winning entry photograph used as the cover shot in one issue of the The Thousands weekly e-newsletter in their city Each Provisional Winner is required to supply seven blog posts on www.thethousands.com.au, to document a week in their city’s life by uploading video and images taken on their Nokia N8 to the blog session of 4 www.thethousands.com.au/covercompetiton, within the time period stipulated by the Promoter. Upon successful completion of the seven days blog, the Winner will be entitled to keep the cash prize of AUD$250 and the Nokia N8 mobile phone which he/she had received earlier. If a Provisional Winner fails to complete the seven days blog, he/she would be deemed to have forfeited the cash prize of AU$250 and the Nokia N8 mobile phone and he/she will be required to return both prizes to the Promoter within [fourteen (14)] days from the date of a notice to be sent by the Promoter to his/her email address or residential address provided. In such event, another Provisional Winner will be chosen in accordance with the criteria listed above, and he/she will similarly be required to successfully run the seven days blog in order to keep the prizes. Mobile phone prize is a handset only. Winner will be responsible for making all arrangements for connection with a service provider and payment of all associated connection, access and call charges. 14) Prizes are non-transferable and cannot be assigned, redeemed for cash, and no substitutions are permitted, except by Sponsor who reserves the right, in its sole discretion, to substitute a prize of equal or greater value if advertised prize is unavailable. 15) Any taxes (including income and withholding taxes) on a prize awarded directly to a winner are the responsibility of each winner. 16) Total prize pool value is AUD$4,995.00. The Promoter accepts no responsibility for any variation in the prize values. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash. 17) If the Promoter is unable to contact the winner by December 15, 2010, to claim fulfilment of the prize, that winner will forfeit the prize in its entirety. The prize shall then be awarded to another entrant whose answer is judged based on the same criteria stated above. The Promoter will not be liable for a Winner who cannot be contacted and therefore forfeits their prize and following this no further correspondence will be entered to. 18) Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. 19) All Winners consent to the Promoter using the Winner’s video and photography content posted to the blog on www.thethousands.com.au/covercompetition in any media for an unlimited period without remuneration for the purpose of promoting this competition and promoting any products manufactured, distributed and/or supplied by the Promoter. 5 20) If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 21) Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used. 22) Except for any liability that cannot be excluded by law, the Promoter and the Sponsor (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) use of a prize. 23) Any questions, comments or complaints regarding the promotion must be directed to the Promoter.
