Terms and Conditions "Lets Save Energy" Campaign –

 residential customer online competition

Enter your energy saving tip!

1.Synergy's (ABN 71 743 446 839) decision is final.
2.Information on how to enter and other details contained within promotional advertisements, form part of these conditions and participants accept these terms and conditions by entering.
3.Employees and agents of Synergy and its related bodies are not eligible to enter.
4.To be eligible for entry you must be at least 18 years of age and either be a Synergy residential account holder in the South West Interconnected System, or have the consent from the account holder.
5.The new 'Let's Save Energy' competition commences on the 7/10/10 and closes on the 30/06/11. This new competition replaces the old ‘Let’s Save Energy’ competition, which ended on 23/09/10.
6.Synergy will also link your survey responses to your Synergy electricity account, or if you are not the account holder, the account of the account holder. This information will be used by Synergy to understand your needs and if appropriate send you marketing offers. While you can opt out of receiving marketing offers, the survey responses will remain associated with your account.
7.The information you provide will also be used to enable Synergy to conduct the competition.
8.Entry into the competition is by visiting Synergy's website at letssaveenergy.com.au. To be eligible to win you must create a profile including your Synergy account number , complete the survey and submit an energy efficiency tip. Entry into the 'Lets Save Energy' competition is automatic when you agree to the terms and conditions and then complete the survey online including your bill account number. You are entitled to enter as many tips as you wish. Upon completion of the initial survey on the micro site and to be eligible to win you must either initially register their bill account number or return to complete the bill account field in order to have the opportunity to win the one monthly prize of $100 dollars worth of electricity. You must enter a new energy efficient tip to be eligible for the monthly prize, tips submitted during the previous competition (25/05/10-26/09/10) are not eligible to win the prize.
9.The monthly winner will be judged by the public via the voting system within the micro site. The customer profile with the most votes will be deemed the winner. In the event of a draw Synergy will reserve the right to select the winner based on random selection at Market United Head Office 1/113 Hay Street West Perth.
10.The monthly prize winner of the $100 off your Synergy bill will be applied to the Synergy account holder. Synergy will use the supplied bill account number as entered on the customer profile.
a.Prize must be taken "as offered" and cannot be varied or extended or exchanged, or transferred.
b.Only one prize is available per customer. The votes counting towards the monthly prize winner are cumulative for the period of one calendar month and are not carried forward to the following month. The votes for the following calendat month start on the first day of that month.
c.If the stated prize is unavailable for any reason, Synergy reserves the right to offer a substitute prize of equivalent value.
d.Any additional products or services not included in the prize will need to be arranged and paid by the winner.
e.If you are a winner of the prize for $100 off your electricity bill, that prize is also not redeemable for cash, even if you close or transfer the account. You are also not able to transfer the prize to another Synergy account.
f.Competition winners consent to Synergy using their name, suburb and photograph for publicity purposes.
g.Synergy is not liable for any loss, damage or injury arising out of, or in any way connected with this promotion and/or the prize.
11.Synergy accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted, delayed or ineligible applications, claims or correspondence whether due to error, omission, alteration, tampering, theft, deletion, destruction, transmission, interruption, communications failure or otherwise. Synergy has no control over the internet, networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise.
12.Any submissions deemed to be gaming the voting system by deliberately generating anonymous votes or through other deceptive methods, will be disqualified from the competition.
13.One vote per IP address per hour will be accepted towards each individual tip.
14.If for any reason any aspect of this competition is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs tampering, unauthorised intervention, fraud, technical failures, or any cause beyond the control of Synergy which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, Synergy in its sole discretion may cancel, terminate, modify or suspend the competition, or invalidate any affected entries, subject to the approval of gaming authorities.
15.Synergy and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) in connection with this competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
16.Synergy may disclose entrants' personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery departments and winners' names may be published as required under the relevant legislation. Synergy's marketing activities are subject to the national Privacy Principles in the Privacy Act 1988.
17.Synergy reserves the right to change the duration of the promotion at any time.



Terms and Conditions "Lets Save Energy" Microsite
1.Submissions may not infringe any third-party rights, including, but not limited to, copyright, trademark, publicity, or privacy rights. When entrants make a submission, they acknowledge that they have all necessary rights, including copyright in the material contained in their submission.
2.Submissions must not be false, misleading, deceptive, fraudulent, libellous, defamatory, obscene, pornographic, harassing, abusive, threatening, racially offensive, offensively directed towards people based on their gender, sexual orientation or otherwise discriminatory or be otherwise objectionable. If there is any question as to what constitutes objectionable material under these Terms of Use, Synergy is the final arbiter of what does or does not constitute objectionable material.
3.Submissions must not and must not be intended to exploit any material for commercial purposes or advertise or solicit funds.
4.Submissions must not use the Lets Save Energy website to advocate or offer instructions as to illegal activities or to violate any applicable laws.
5.Submissions must not be in violation of the guidelines set forth in these Terms of Use. Any such actions shall be a material breach of these Terms of Use. Synergy will remove any submissions that violate any provision of these Terms of Use and will cooperate fully with any law enforcement officials and/or agencies in the investigation of any violator or violators. In addition, Synergy may terminate the right to access the Lets Save Energy website by any user who violates these Terms of Use immediately and without prior notice.
6.Incomplete, inaudible, incomprehensible and illegible entries will be deemed invalid as determined by Synergy. This decision will be final and no correspondence entered into.
