Conditions of Entry

1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each entrant.

2. Entry is open to Australian residents 13 years of age and over and who hold an active & valid Facebook account ("Eligible Entrants"). Entrants who are under 18 years of age must have approval from their parent or guardian to enter the promotion.

3. Employees of the Promoter (and their immediate families) and its agencies associated with this promotion, are not eligible to enter.

4. Promotion commences at 09:00 AEDT on 3 December 2010. Entries close and must be received by the date the piñata is broken and no later than 21:00 AEDT on 17 December 2010 (Promotional Period). There are two ways in which the piñata may be broken; by an entrant using the Application during the Promotion Period or, if the piñata is not broken during the Promotion Period, a representative of the Promoter will break the piñata at 21:30 AEDT on 17 December 2010, at Machinery Automation & Robotics, 1/101 Derby Street, Silverwater NSW 2128. The winners will be notified in writing by email, and the names, suburbs and postcodes of winners of Prizes over the value of A$250 will be published in The Australian newspaper on 23 December 2010. An entry is deemed to be received at the time of its receipt by the Promoter, and not at the time of transmission by the entrant.

5. To enter, Eligible Entrants must, during the Promotional Period and before the pinata is broken:

a. 'Like' the Vodafone Australia Fan Page on Facebook (located at http://www.facebook.com/vodafoneau (http://www.facebook.com/vodafoneau));

b. install the 'Power Piñata' application on Facebook (located at http://apps.facebook.com/vodafone_pinata (http://apps.facebook.com/vodafone_pinata)) (the 'Application');

c. when requested upon installation of the Application, 'Allow' the Application's 'Request for permission'; and

d. upon the installation of the Application, click the Application's on-screen 'Enter' button ("Entry").

6. To be eligible for a Prize, Eligible Entrants must enter in accordance with clause 5 and, after the piñata is broken, access the Application and click the Application's on-screen 'Stake your claim' button.

7. Eligible Entrants will receive notification that the piñata has broken:

a. Through visual notification from the Application. In order to receive this notification, Eligible Entrants must access the Application between 09:00 AEDT and 21:00 AEDT on any weekday during the Promotional Period; or

b. Through a message posted by the Promoter on the Vodafone Australia Facebook page (http://www.facebook.com/vodafoneau (http://www.facebook.com/vodafoneau)).

8. The first 500 Eligible Entrants to click the Application's on-screen 'Stake your claim' button after the piñata has broken will each win 1 x Prize. The allocation of Prizes will based upon the order in which Eligible Entrants click the 'Stake your claim' button, as set out in clause 9.

9. The Prizes will be awarded in the following order with the first person to click the 'Stake your Claim' button receiving Prize # 1, the second person receiving Prize # 2 and so on until all of the Prizes have been allocated:

11. If the winner of a Prize is under 18 years of age, the Prize will be awarded to the winner's nominated parent or guardian.

12. Subject to the unclaimed prize draw clause, if for any reason whatsoever the Prize winner does not redeem their Prize or an element of their Prize by the time stipulated by the Promoter, then the Prize or that element of the Prize will be forfeited by the Prize winner and neither cash nor any other prize will be awarded in lieu.

13. If a Prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or that part of the Prize) with an alternative prize to the equal value and/or specification, unless to do so would be prohibited by law and subject to any written directions from a regulatory authority.

14. If for any reason whatsoever beyond the reasonable control of the Promoter, the promotion is not capable of being conducted as reasonably anticipated, the Promoter reserves the right, in tis sole discretion, unless to do so would be prohibited by law, to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to cancel, suspend, modify, terminate or cancel the promotion.

15. Total Prize pool value is up to $26,060 inclusive of GST.

16. Any costs associated with accessing or downloading the application are the entrant's responsibility and may depend on the entrant's usage plan.

17. The Promoter reserves the right to verify the validity of entries and entrants (including an entrant's identity, age and address) and reserves the right to disqualify any entrant for tampering with the entry process (including but not limited to tampering by way of use of automatic entry software) or for submitting an entry that is not in accordance with these Conditions of Entry, of if the entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of these rights.

18. Only one entry permitted per Eligible entrant.

19. Entrants must retain email confirmation of entry. Failure to produce this confirmation for all invalid entries when requested may, in the absolute discretion of the Promoter, result in the invalidation of all of an entrant's entries and forfeiture of any right to a prize.

20. The Promoter's decision is final and no correspondence will be entered into.

21. If there is a dispute as to the identity of an entrant, the entrant will be deemed to be the person in whose name the corresponding Facebook account is held.

22. Unless otherwise stipulated, no Prize, is transferable, exchangeable or redeemable for cash.

23. If required, an unclaimed prize draw may take place from all non-winning entries received at 14:00 AEDT on 8 April 2011 at the 15 Grosvenor Street, Neutral Bay, NSW 2089, subject to any directions from a regulatory authority. Winners will be notified in writing via email and winners of prizes valued over $250 will have their name and postcode published at http://www.facebook.com/vodafoneau (http://www.facebook.com/vodafoneau) and in the Australian newspaper on 15 April 2011.

24. Except for any implied condition or warranty the exclusion of which from these conditions of entry would contravene any statute or cause any part of these conditions of entry to be void ("Non Excludable Condition"), the Promoter excludes from these conditions of entry all conditions, warranties and terms, implied by statute, general law or custom. Except for any liability in relation to a Non Excludable Condition, the Promoter (including its officer, employees and agents) excludes all liability whether raising in tort (including, without limitation, negligence), contract or otherwise for any personal injury or any other loss or damage (including without limitation loss of opportunity or loss or profits) whether direct, indirect, special or consequential, arising in any way out of the promotion, including, without limitation, the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that sated in these conditions of entry;
(e) any tax implications;
(f) the cancellation or postponement of any Event; and/or
(g) a prize or use of a prize.

25. Each entrant consents, if the entrant becomes a winner, to the Promoter using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in a media for an unlimited period o time without remuneration for the purpose of promoting this promotion (including any outcome), the Promoter and/or products/services supplied by the Promoter.

26. Each entrant consents, by entering this Promotion, to the Promoter using the entrant's name to identify the entrant in the Application and to using the email address that the entrant has specified in his/her Facebook settings to contact the entrant by email. These emails may be sent from 'Power Piñata' or from the Promoter, at the complete discretion of the Promoter.

27. Each entrant consents, if the entrant becomes a winner, to provide to the Promoter with his/her mailing address in order to be sent his/her respective Prize. Entrants acknowledge that failure to provide a mailing address will result in their Prize being forfeited.

28. The Promoter collects personal information in order to conduct the promotion and provide any goods/services requested and may, for that purpose, disclose such information to third parties, including, but not limited to, prize suppliers or a regulatory authority and for any purpose to which the entrant has previously consented, including but not limited to, future promotional, marketing and publicity purposes. Entrants should direct any request to access, update or correct information to the Promoter. All entries become the property of the Promoter.

FAQ's

Is this for real?
Sure is. The robot is programmed to respond to the selections you make, then a live camera films what it does. There are a lot of moving parts in this thing, and there's a chance at some stage something may go wrong! If it does, please bear with us.

When will it break open?
We actually don't know. That's one of the cool things about piñatas, you never know when they'll bust! We can promise that Carlos the robot will keep beating it til it breaks open though – and he's got a few tricks up his sleeve for getting the job done.

How do I win prizes?
Like a real piñata, it's a case of first in, first served. But first you have to have a hit. And to do that you need to be part of the Vodafone Facebook Community. You will be alerted via email when the piñata has burst open.

What's inside the piñata?
Lollies! Lots of them. More importantly however there is one large lolly - about the size of a rugby ball. When this hits the ground this means the piñata is officially broken. That's when the 500 prizes are up for grabs in a 'virtual scramble'. First in, first served.
