"FOX SPORTS Biggest Cricket Fan" Game of Skill Competition CONDITIONS OF ENTRY


1. Competition and Promoter

1.1. By entering the "FOX SPORTS Biggest Cricket Fan" Game of Skill Competition (Competition) and in consideration for the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry. Information on how to enter and prize details form part of these Conditions of Entry.

1.2 The promoter of the Competition is Premier Media Group Pty Limited ABN 16 065 445 418 of 55 Pyrmont Bridge Road, Pyrmont NSW 2009 (Promoter).

2. Who may enter

2.1. Entry into the Competition is open to all permanent residents of Australia.

2.2 Each participant may enter as many times as they wish provided that each entry is unique and is in accordance with these Conditions of Entry.

2.3 The officers, management and employees (and immediate family members of officers, management and employees) of the Promoter, its related corporations and associated agencies are not eligible to enter the Competition.

2.4 Any participant aged under 18 years must obtain consent from their parent/guardian prior to entering the Competition.

3. Competition Period

3.1 The Competition commences at 12:00pm Australian Eastern Daylight Time (AEDT) on 9 December 2010 and closes at 9:00am AEDT on 17 January 2011 (Competition Period).

3.2 Entries not received during the Competition Period or not completed in accordance with these Conditions of Entry will not be eligible to win.

4. How to enter

4.1 Eligible participants must, during the Competition Period:

(a) go to the FOX SPORTS website (www.foxsports.com.au/biggestfan);

(b) enter the details requested; and

(c) submit a video, image or text entry to prove why they are FOX SPORTS" biggest cricket fan (Entry).


4.2 It is a condition of entry into the Competition that participants agree to receive announcements and special offers from the Promoter.

4.3 Video Entries and image Entries must be posted on a website which provides a public URL (e.g. Facebook, YouTube, Vimeo, Flickr or Picasa) and submitted in the Competition via a link to the Entry on that website. Each participant must ensure that their Entry complies with all terms of use for the website on which their Entry is posted.

4.3 Text Entries must be submitted via the text field on the Competition entry page on the FOX SPORTS website and must not be longer than 100 words.

5. Judging and public voting

5.1. Judging of all entries will be conducted by the Promoter at 55 Pyrmont Bridge Road, Pyrmont NSW 2009 on 18 January 2011.

5.2. The 11 most creative and unique Entries (as judged by the Promoter in its sole discretion) will be displayed on the FOX SPORTS website for public viewing and voting.

5.3. Members of the public will be permitted to vote for the Entry they judge to be the most creative (from the 11 Entries selected by the Promoter) from 12:00pm AEDT on 18 January 2011 until 8:59am AEDT on 25 January 2011 (Voting Period).

5.4. Members of the public will be permitted to submit one vote per person.

6. Prize and notification

6.1. The participant who submitted the Entry which received the highest number of public votes during the Voting Period will be the Prize Winner. The Prize Winner will win:

(a) a Samsung 3D TV with 2 pairs of 3D Active Shutter glasses, valued at $4,499;

(b) 6 pairs of rechargeable 3D Active Shutter glasses, valued at $894;

(c) one residential FOXTEL Platinum HD subscription for 12 months, including one single standard metro installation (valued at $1,560) and one FOXTEL iQHD upgrade (valued at $200) (FOXTEL Subscription);

(d) a subscription to Alpha Magazine for one year, valued at $35.40; and

(e) a $200 KFC food voucher.

6.2. The maximum total prize value is A$7,388.40 (including GST).

6.3. The Prize Winner will be notified by telephone on 27 January 2011.

6.4. The Promoter accepts no responsibility for any variation in the value of a prize. The prizes are not transferable or exchangeable. The prizes are not redeemable for cash and must be taken as offered. Subject to clause 6.7, in the event that any element of the prize is not available, the Promoter reserves the right to substitute a prize of equal or greater value.

6.5 The Prize Winner is responsible for all expenses not specified in these Conditions of Entry.

6.6 The Prize Winner acknowledges that the prize may be subject to additional terms and conditions imposed by third party prize suppliers. The Prize Winner must become acquainted with any such additional terms and conditions prior to taking the prize. The Promoter does not accept responsibility and is not liable for any additional conditions imposed on the taking of the prize or the breach of those conditions by any person.

6.7 If for any reason the Prize Winner does not take an element of the prize during the stated period and on the conditions stipulated by the Promoter or any third party prize suppliers, that element of the prize will be forfeited. Cash will not be awarded in lieu of that element of the prize.

6.8 The Prize Winner acknowledges that the FOXTEL Subscription is subject to the FOXTEL Residential Subscription Agreement. FOXTEL and some FOXTEL services are not available to all homes. In the event that the Prize Winner"s home is not in a FOXTEL serviceable area, the Prize Winner will forfeit the FOXTEL Subscription element of the prize and the Promoter will substitute that element of the prize with $1,760 cash. Installation is a single standard metro installation only. The Prize Winner is responsible for any additional installation costs that may be incurred. A credit will be applied to the Prize Winner"s FOXTEL account in the amount of $1,560. The FOXTEL Subscription is non-refundable and not redeemable for cash. If the Prize Winner is an existing FOXTEL subscriber, they will forfeit the installation component of the FOXTEL Subscription and no substitute will be offered. If the Prize Winner is an existing FOXTEL iQHD subscriber, they will forfeit the FOXTEL iQHD upgrade and no substitute will be offered. FOXTEL Box Office charges, Main Event charges and other incidental charges are not included in the FOXTEL Subscription and are charged in addition to subscription fees. Any such charges will be subtracted from the $1,560 subscription credit. Once the $1,560 subscription credit is insufficient to cover fees and charges, the Prize Winner will be responsible for all additional fees and charges. The Prize Winner is responsible for checking the amount of credit on their account. The Prize Winner must set up Easypay (direct debit) on their FOXTEL account. If for any reason the Prize Winner cancels their FOXTEL Subscription, any remaining subscription credit will be forfeited. The Prize Winner must provide FOXTEL with at least 31 days notice before the end of the subscription period (or earlier if the subscription credit is insufficient to cover the charges) if the Prize Winner wishes to terminate or change their subscription package, otherwise the Prize Winner will incur ongoing subscription fees for the FOXTEL Subscription.

7. Unclaimed prizes

If the prize is unclaimed by 5:00pm AEDT on 27 February 2011, it will be awarded to the participant who submitted the Entry which received the next highest number of public votes during the Voting Period. This process will be repeated every 24 hours until a prize winner is contacted and the prize is claimed.

8. Information for Prize Winner

All entrants agree to provide the Promoter with identification and/or proof of age if selected as the Prize Winner. If the Prize Winner is under the age of 18 years, the prize will be awarded to the Prize Winner"s parent/guardian on their behalf. In accepting the prize, the Prize Winner and their parent/guardian (if applicable) agree to the release set out below. The form of identification and/or proof of age are at the discretion of the Promoter.

9. Limitation of Liability

9.1 To the full extent permitted by law, the Promoter and its associated companies and agencies and any of their personnel exclude all liability for any loss (including any damage, claim, injury, cost or expense) which is suffered or incurred by any entrant in connection with the Competition or prizes, including, without limitation: (i) any indirect, economic or consequential loss; (ii) any loss arising from the negligence of the Promoter and their associated companies and agencies and any of their personnel; (iii) any liability for personal injury or death.

9.2 The Promoter makes no representation or warranties as to the quality, suitability or merchantability of any of the goods or services offered as the prize. If the Promoter is liable for any claim by the Prize Winner or a travel companion, including a claim arising from the Promoter"s negligence, the Promoter"s liability for any such claim will not exceed the value of the prize won as set out in these Conditions of Entry.

10. Privacy

By entering the Competition, the entrant understands and agrees that the Promoter may use and disclose the entrant"s personal information to assist in conducting the Competition and to communicate with the entrant regarding special offers from the Promoter. Entrants in the Competition acknowledge that the Promoter may share an entrant"s personal information with the Promoter"s Australian related entities which may contact the entrant with special offers. If an entrant elects to receive information from third parties, the Promoter may also disclose the entrant"s personal information for that purpose. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth). The Promoter"s Privacy Policy is available at http://www.foxsports.com.au/privacy. Entrants can access the personal information the Promoter holds about them, notify the Promoter that they do not wish the information to be disclosed or notify the Promoter that they do no wish to receive further promotional material by writing to the Promoter at 55 Pyrmont Bridge Road, Pyrmont 2009.

11. General

11.1 Each participant agrees to provide a written assignment of all rights in their Entry to the Promoter if requested.

11.2 Entries must not contain any copyrighted works (other than works owned by the participant). All elements of a participant"s Entry (including, without limitation, music, images, text, graphics, audio, video, recordings and performances) must be entirely original and created and/or performed by the participant or a third party who has agreed:

(a) to appear in the Entry and/or have their material featured in the Entry; and

(b) that the Entry may be used in accordance with these Conditions of Entry.

11.3 By submitting an Entry to the Promoter, each participant:

(a) grants to the Promoter a perpetual, royalty-free, non-exclusive, irrevocable, worldwide, transferable licence to use, reproduce, display, modify, adapt, transmit, publish, broadcast, exhibit, sell, distribute, communicate to the public and otherwise exploit the Entry or any part of it in all media for any purpose, including the right to license, authorise or otherwise transfer the rights in the Entry to others to do the same without any further consideration to the participant;

(b) represents and warrants that:

(i) the Entry is original to the participant and fully cleared for use as contemplated in these Conditions of Entry;

(ii) the participant owns or has obtained all necessary clearances in relation to all underlying rights in the Entry, including, without limitation, in relation to any music, images, text, graphics, audio, video, recordings, performances contained in the Entry;

(iii) the participant has obtained permission from any person who appears in the Entry (and the parent/guardian of any person aged under 18 years who appears in the Entry) to submit the Entry in the Competition and for the use of the Entry as contemplated in these Conditions of Entry;

(iv) the Entry does not and will not violate or breach any of the terms of any other agreement the participant may be a party to;

(v) the participant has not assigned their rights in the Entry to any other person;

(vi) the Entry does not contain defamatory, tortious or otherwise unlawful, untrue or inaccurate information;

(vii) the Entry is not obscene, cruel, abusive or likely to cause offence;

(viii) the Entry does not breach any applicable laws and does not infringe or violate any copyright or other right of any person; and

(ix) the Promoter will not be required to pay or incur any sums to any person or entity as a result of Promoter"s use or exploitation of the Entry as contemplated in these Conditions of Entry; and

(c) unconditionally and irrevocably consents to any act or omission which would otherwise infringe any of their moral rights in the Entry and waives all moral rights in the entry that arise outside Australia.

11.4 This Competition is a game of skill.

11.5 Acceptance of the prize constitutes consent on the Prize Winner"s part to allow the use of the Prize Winner"s name, image, voice and/or likeness by Promoter for editorial, advertising, promotional, marketing and/or other purposes without further compensation except where prohibited by law.

11.6 The Promoter"s decision is final and binding. No correspondence will be entered into.

11.7 The prize remains the property of the Promoter until it is collected by the selected Prize Winner or unclaimed prize winner as the case may be.

11.8 If for any reason the Competition is not capable of running as planned, including due to any causes beyond the Promoter"s control, including infection by computer virus or bugs, tampering, technical failure, emergency or disaster,, the Promoter reserves the right in its sole discretion to cancel, modify, terminate or suspend the Competition.

11.9 The Promoter reserves the right to disqualify any individual who conspires with others to gain an unfair advantage or who is otherwise involved in manipulating, interfering or tampering with the entry process or any other element of the Competition. The use of any automated entry software or any mechanical, electronic or other means which allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

11.10 Neither the Promoter nor its authorised agents will take any responsibility for lost, ineligible, misdirected or late entries due to technical reasons, telecommunications issues or any other reason. Entries that are not genuine, are incomplete or late or are in any way fraudulent will be declared void.

11.9 The Prize Winners is responsible for all taxes (excluding GST) which may be payable as a consequence of receiving a prize.

12 Contact details

12.1 It is the entrant"s responsibility to inform the Promoter of any change to the entrant"s contact details, including their email address.
