Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. 2. Entry is open to all residents of Australia aged 18 years or over who complete a valid entry form between 8am AEDST on 1/10/2010 and 11:59pm AEDST on 31/12/2010 (inclusive). 3. To enter, entrants must then either: Visit an MBF, HBA or Mutual Community retail centre or online via mbf.com.au/newyork or hba.com.au/newyork or mutualcommunity.com.au/newyork during the promotional period and complete and submit an entry form at the retail centre or electronically (as applicable). 4. One entry per person. Multiple entries are not permitted. 5. Employees of the Promoter and their immediate families and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin. 6. The promotion commences 8am AEDST on 1/10/2010 and closes 11:59pm AEDST on 31/12/2010. The draw will take place at AMP Centre, Level 2, 50 Bridge St, SYDNEY NSW 2000 at 11:00am AEDST on 24/1/2011. The Promoter’s decision is final and no correspondence will be entered into. 7. There will be one (1) prize on offer to one (1) individual winner. The first valid entry drawn will win a trip for the winner and one (1) adult guest to enjoy 6 nights of twin-share accommodation at Hotel Beacon. The prize is for two (2) adults. The winner’s companion is to be selected at the discretion of the winner (provided that the winner’s companion is 18 years or over). The prize includes:Return economy class airfares for the winner and his/her guest from Sydney International Airport to JFK International Airport. Both persons must travel together on the same dates & routing. If the winner and his/her guest is not a resident of New South Wales, the domestic airfares will not be included in the prize and will be the responsibility of the winner. If the winner is an MBF, HBA or Mutual Community Health Member at the time of the draw the prize will also include bonus AU$1,000 spending money (Including GST). 9. Total prize is valued up to AU$7,500 (Including GST) depending on the travel dates selected and whether the winner is eligible for bonus AU$1,000 spending money. 10. If the winner wishes to stay longer than six (6) nights in New York or at an accommodation not nominated by the Promoter, all additional costs incurred will be the winner’s responsibility. 11. All components of the prize must be taken together. Accommodation and flights are subject to availability. The prize is as stated above and is not redeemable for cash and is non transferable or exchangeable. 12. The Promoter is not responsible for travel insurance for the winner, and this can be purchased through MBF, HBA or Mutual Community. 13. All travel must be completed by 30 June 2011. Validity cannot be extended beyond this date. 14. Once issued, tickets cannot be extended, re-routed or reissued. 15. Date changes are permitted once booked, subject to the following: (a) the prize must still be taken by 30 June 2011. 16. All other costs including meals, tips, additional transfer fees, excess baggage, spending money, beverages, transport to and from departure/arrival points, taxes (unless otherwise specified), airport charges, insurances (other than Travel Insurance), passports, visas, gratuities, excess baggage costs, room service costs, optional excursions whilst on tour and all other ancillary costs are the responsibility of the winner and his/her guest. 17. No extension on the validity date of this prize will be permitted. Once booked, any changes made to the booking may incur a cancellation fee or amendment fee at the cost of the winner. 18. Package is valid between February 2011 and June 2011. The hotel reserves the right to restrict bookings at any time. 19. The winner and his/her guest must be in possession of valid picture ID and proof of citizenship satisfactory to customs and immigration officials. Winner should be reminded that this trip is only open to adults, 18 years of ages and older. 20. Prices quoted are recommended retail and are correct at 1 October 2010 and can be changed at any time subject to market fluctuation. The Promoter and publishers take no responsibility for market price fluctuations. 21. All food, beverages, taxes, and other incidental costs incurred by the guest are to be settled prior to departure from, and direct with, the individual hotel. The Promoter will arrange for delivery of the prize to the prize-winner. 22. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law to (a) disqualify any entrant; and/or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate. 23. Incomplete, indecipherable, or illegible entries will be deemed invalid. 24. The winner and his/her companion is responsible for ensuring that they have valid passports, and any requisite visas, vaccinations required and travel documentation. The winner (and his/her companion) must depart from and return to the same point of departure and travel together. Frequent flyer points will not form part of the prize. Standard conditions for tickets and accommodation apply. The winner may be required to present credit card at time of check in at accommodation. Prize is subject to the standard terms and conditions of individual prize and service providers. 25. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; and/or (f) taking of the prize. 26. In the event that a portion of the prize is awarded to the winner in the form of a voucher / ticket / pass, redemption of that portion of the prize will be subject to the terms and conditions stipulated on the voucher / ticket / pass. The Promoter will not be liable for any voucher / ticket / pass that has been lost, stolen, forged, damaged or tampered with in any way. 27. In the event of unforeseen circumstances, the Promoter reserves the right to offer an alternative prize of equal or greater value, subject to any written directions from the various lottery authorities. In the event of war, terrorism, state of emergency or disaster (including natural disaster), the Promoter reserves the right to either provide an alternative travel prize (including an alternative destination as specified by the Promoter) to the same value as the original prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. 28. Subject to the unclaimed prize draw clause, if for any reason a winner does not take the prize or an element of the prize by the time stipulated by the Promoter, then the prize or that element of the prize will be forfeited. 29. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority. 30. The Promoter may conduct a further draw at the same time and place as the original draw as necessary on 25 April 2011. in order to distribute any prize which remains valid and unclaimed by that date subject to reference to all relevant state and territory regulations and any written directions. Publication of unclaimed prize draw winner will be in the Public Notices section of the Australian on 29 April 2011. 31. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the phone user or for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries. 32. The Promoter reserves the right to verify the validity of all entries and entrants (including an entrants name, age and place of residence) and to disqualify any entrant who tampers with the entry process, or who submits an entry that is not in accordance with these Terms and Conditions. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. 33. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers, to publish the winner's name and locality as required under the relevant lottery legislation and, as required, to provide winner’s information to Australian regulatory authorities without any further reference or payment or other compensation to the entrant. Entry is conditional on providing this information.
