Information on how to enter and prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry.
Entry is only open to Australian residents who are FlyBuys members (the 'Eligible Entrant'). Employees and their immediate families of the Promoter, participating businesses and agencies associated with this promotion are ineligible to enter.
The promotion commences 12.01 am (AEDT) on 15 November 2010 and entries close 11.59 pm (AEDT) on 13 February 2011 ('Promotion Period').
To automatically receive an entry into the draw an Eligible Entrant must redeem FlyBuys points for any of the rewards advertised on page 6 of the 'December 2010 FlyBuys Member Rewards' during the Promotion Period. Eligible Entrants will receive an automatic entry into the draw for every valid redemption. The Promoter will not be liable for any delays in the processing of information or for late, lost or misallocated entries.
The prize draw will take place at RDA Research, Level 4, 11 Rangers Road, Neutral Bay NSW 2089 at 12 pm (AEST) on 23 February 2011. The first 5 entries randomly drawn will each win a Jamie Oliver 5-Piece Cookware Set. Each prize is valued at $799.95. Winners will be notified by mail and the winners' names and localities will be published in 'The Australian' on Saturday, 5 March 2011.
The Promoter may conduct such further draws at the same time and place as the original draws as are necessary on 25 May 2011 in order to distribute any prizes unclaimed by that date, subject however to any written directions given under any applicable State or Territory legislation. In the event of any winners in an unclaimed prize draw, winners will be notified by telephone and mail and their name and locality will be published in the public notices section of The Australian on Saturday, 4 June 2011. Judges' decision is final and no correspondence will be entered into.
Prize values correct as at date of publication and Promoter accepts no responsibility for any variation in any prize value. Prizes are not transferable or exchangeable and cannot be taken as cash. Total prize pool is valued up to $3999.75.
The Promoter's decision in relation to any aspects of the competition is final and binding on every person who enters and no correspondence will be entered into.
The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, for any of the equipment or programming associated with or utilised in this competition, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
The Promoter reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
If for any reason this promotion is not capable of running as planned, whether caused by infection by computer virus, mobile phone failure, line drop out, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupt or affect the administration, security, fairness or integrity of the promotion, the Promoter reserves the right in its sole discretion, (subject to State and Territory Regulations), to cancel, terminate, modify or suspend the promotion.
In the case of the intervention of any outside agent or event which naturally changes the result or prevents or hinders it's determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, and war, the Promoter may in its absolute discretion cancel the event and recommence it from the start on the same conditions subject to State and Territory Regulations.
Any tax liability arising as a result of accepting the prize is the responsibility of the winner.
The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If any information requested is not provided, the entrant may not participate in the promotion. By entering the promotion, each entrant agrees that the Promoter may disclose entrants' personal information to State and Territory lottery departments, and that the winner's name and locality will be published as required under the relevant lottery legislation. A request to access, update or correct any personal information should be directed to the Promoter at the address stated below.
