Participation in this promotion constitutes acceptance of these Conditions of Entry. 2 The promoter is the Australian Grand Prix Corporation (ABN 86 947 927 465), 220 Albert Road, South Melbourne, Victoria 3205 (Promoter). 3 Entry is only open to Australian residents. The Promoter, Ticketek Pty Ltd (Ticketek), licensees, on-sellers and their employees (and their immediate families), and their agencies associated with this promotion are ineligible to enter. Persons under 18 years of age must obtain the consent of their parent or legal guardian 4 The promotion period begins at 1 July 2010 and ends 4.59pm (AEST) on Friday 31 December 2010 (Promotion Period). 5 To enter, you must purchase a 4 day Grandstand ticket to the 2011 FORMULA 1 Australian Grand Prix (Event): • on-line at www.ticketek.com.au; • by phoning Ticketek on 131 931; • by visiting a Ticketek agency; or • as part of a package including a 4 day Grandstand ticket, accommodation and airfares in connection with the Event (Event Package), during the Promotion Period, and register your full contact details with Ticketek or the authorised seller of the Event Package for this promotion upon making your purchase. Incomplete or incomprehensible entries will be ineligible to win. Entries are deemed to be received at the time of receipt by the Promoter and not at the time of transmission by the entrant. Entrants must note that the time of their entry into this promotion will determine the prize available as set out in Condition 9. 6 Each 4 day Grandstand ticket purchased qualifies for one entry into the promotion. Multiple entries are accepted provided that each entry is submitted in accordance with Condition 5. The Promoter reserves the right to restrict entries in its absolute discretion. 7 In respect of each of the dates specified in Condition 9 (Date Slots), a winner will be drawn for the corresponding prize (or prizes) for that Date Slot. The winners will be randomly selected from all valid entries received during each relevant Date Slot. In respect of each Date Slot, the draws will take place at Australian Grand Prix Corporation (ABN 86 947 927 465), 220 Albert Road, South Melbourne, Victoria 3205. 8 The winners will be notified by phone and mail, and their names will be published in The Australian and at www.grandprix.com.au in respect of each of the relevant Date Slots on the dates below which correspond for those Date Slots. 9(a) Each winner drawn during the following Date Slots in accordance with Condition 7 will receive one F1 two-seater Hot Lap consisting of 1 x ‘out’ lap, 1 x ‘flying’ lap and 1 x ‘in’ lap per passenger, or as otherwise determined by the Promoter in its discretion and having regard to race control requirements (Hot Lap) at, or during the week of, the 2011 FORMULA 1 AUSTRALIAN GRAND PRIX March 2011 (date subject to FIA approval in late November 2010) and a photograph taken during the activity by an official photographer of the Promoter. A total of 4 draws will be conducted for the Hot Laps, based on which Date Slot the winners entered this Promotion, as set out below. • For entries received between 9am AEST Sunday 1 AUGUST 2010 and 4:59pm AEST on Thursday 30 September 2010, draw date 11am AEST Thursday 7 October 2010 (to be published on Wednesday 13 October 2010). Total prize value $15,000.00 • For entries received between 9am AEST Sunday 1 AUGUST 2010 and 4:59pm AEST on Sunday 31 October 2010, draw date 10am AEST Thursday 11 November 2010 (to be published on Wednesday 17 November 2010). Total prize value $15,000.00 • For entries received between 9am AEST Sunday 1 AUGUST 2010 and 4:59pm AEST on Tuesday 30 November 2010, draw date 11am AEST Thursday 9 December 2010 (to be published on Wednesday 15 December 2010). Total prize value $15,000.00 • For entries received between 9am AEST Sunday 1 AUGUST 2010 and 4:59pm AEST on Friday 31 December 2010, draw date 11am AEST Thursday 13 January 2011 (to be published on Wednesday 19 January 2011). Total prize value $15,000.00. AEST Tuesday 31 August 2010 there will be one additional draw at 11am AEST Friday 3 September 2010 for a prize consisting of: (i) two return economy airfares from the winner’s nearest capital city in Australia to Singapore; (ii) 5 nights’ twin share accommodation in Singapore [minimum 3 star accommodation]; and (iii) two x weekend grandstand tickets (in a grandstand to be determined by the Promoter in its discretion) to the 2010 Formula 1 Singtel Singapore Grand Prix from 24th September, 2010 until 26th September, 2010 (the Singapore Event). Total value is up to $8,000. Draw date 11am AEST Friday 3 September 2010 (to be published in The Australian and at www.grandprix.com.au on Wednesday 11 August 2010). TOTAL prize value is up to $68,000. (c) The Promoter may conduct such further draws at the same place as the original draw(s) as are necessary to distribute any prizes unclaimed by the date of the relevant re-draw: 11am AEDST 20 January 2011 (prizes referred to in Condition 9(a)), or 11am AEST 19 August 2010 (prizes referred to in Condition 9(b)), subject however to any written directions from a relevant regulatory authority. The winners of any re-draws will be published in The Australian and at www.grandprix.com.au on Wednesday 26 January 2011 (Condition 9(a) re-draws) and/or Wednesday 25 August 2010 (Condition 9(b) re-draws). 10. Spending money, meals and all other ancillary costs incurred as a result of taking the prize (including, without limitation, transport to and from the events, airline and/or airport taxes and transfers, where applicable) are not included and remain the responsibility of the winner. 11. No element of the prize is exchangeable and the prize cannot be taken as cash. The prize may be transferred to another event patron as designated by the prize winner in writing to the Promoter (the Nominated Participant), subject to such Nominated Participant meeting the requirements for participation, including without limitation medical clearance requirements (where relevant), and agreeing that their participation will be deemed acceptance of these Conditions as if all references to the “winner” were references to the Nominated Participant except where the context otherwise requires). In respect of the prize contained in Condition 9(a), the prize may not be transferred after 11 February 2011, and in respect of the prize contained in Condition 9(b), the prize is not transferrable 12. The value of the prize in Condition 9(a) has been calculated based on an estimated market value of the activity. The Promoter accepts no responsibility for any variation in the value of the prize. All elements of the prize in Condition 9(a) must be taken to coincide with the Event to be held in March 2011 (date subject to FIA approval in late November 2010), and any element not taken at the time(s) stipulated will be taken to be forfeited. All elements of the prize in Condition 9(b) must be taken to coincide with the Singapore Event to be held from 24th September, 2010 until 26th September, 2010, and any element not taken at the time(s) stipulated will be taken to be forfeited. 13. The Promoter will not be responsible in circumstances where the Singapore Event is cancelled or the Singapore Event dates are re-scheduled for any reason, or where the Event is cancelled or the Event dates are re-scheduled for any reason, other than as set out in the Conditions of Sale of tickets to the Event (available at www.grandprix.com.au). If the prize or any part of the prize becomes unavailable for reasons beyond the Promoters’ reasonable control, the Promoter will endeavour but is not obliged to provide a substitute prize of equivalent value. 14. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the promotion. The Promoter does not accept any responsibility for late, lost or misdirected entries for this promotion. 15. As a condition of accepting the prize, the winner must sign a waiver of liability and indemnity form as required by the Promoter. 16. In regards to the prize in condition 9(a) the winner must comply with all directions of the Promoter, race officials, and the nominated driver at all times and wear all safety and passenger equipment required. Winners will not be permitted to obtain driver’s signatures and acknowledge that there will be no formal introduction to the driver of the car participating in the prize. The winner agrees to take part in a briefing prior to the “Hot Lap”, and the winner must undergo and pass all required medical tests and other requirements (including blood alcohol and drug testing) as determined by the Promoter and/or the operators of the prize in their absolute discretion. The winner must not be under the influence of any drugs or have a blood alcohol reading above .00 whilst taking part in the Hotlap. The winner must not have any heart condition, history of heart disease, or other medical conditions that would make it dangerous to participate in the Hotlap. The winner must declare to the Promoter any health-related issues that may affect his/her safe participation in the Hotlap and obtain a written clearance from their doctor in this respect. The Promoter reserves the right (but has no obligation) to refuse to allow a winner to take part in any or all aspects of the prize if the Promoter determines, in its absolute discretion, that the winner is not in the mental or physical condition necessary to safely participate in that aspect of the prize. Notwithstanding any other conditions set out herein, the Promoter at all times reserves the right to prevent any individual from participating in the prize for any reason whatsoever. The winner also agrees to comply with these Conditions, the Conditions of Sale and Conditions of Entry to the Event (collectively, the Conditions) (copies of which are available at www.grandprix.com.au or from the Promoter, and the Conditions of Entry displayed at entrances to the Event). 17. In regards to the prize in Condition 9(a) the winner must, at their own cost, organise and undertake a compulsory medical examination (which may include an ECG test) to obtain medical clearance by the date specified by the Promoter. The winner consents to the test results being made available to CAMS for the purpose of assessing fitness to participate in the Hot Lap. In order to participate in the Hot Lap, the winner must also be within the following height, weight and body dimension restrictions: Maximum height: 1.8 m (6ft) Minimum height: 1.58 m (5 ft 2 in) Maximum weight: 88 kg (14 stone) Maximum girth (including upper arms): 139.7cm (55 in) 18. ENTRANTS ARE REMINDED AND AGREE, ACCEPT AND ACKNOWLEDGE THAT MOTOR RACING, THE EVENT AND CERTAIN ACTIVITIES ASSOCIATED THEREWITH (INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE PRIZE) ARE DANGEROUS AND ACCIDENTS CAN HAPPEN. Entrants are warned that there is a possibility of an accident causing injury, death or property damage or loss and attendance at the Event and participation in the prize is at entrants’ own risk. Entrants acknowledge that the risks associated with attending the Event and participating in the prize include but are not limited to the risk of suffering harm as a result of cars (or parts of them) colliding with other cars, persons or property. Entrants acknowledge that entry to and remaining at the Event and participating in the prize has a degree of danger and, to the extent permitted by law (in particular section 32N of the Fair Trading Act 1999 (Vic) and section 68B of the Trade Practices Act 1974 (Cth)), hereby exclude, release and forever discharge the Promoter, the Crown in right of the State of Victoria, the Minister administering the Australian Grands Prix Act 1994 (Vic), the Minister administerig the Crown Land (Reserves) Act 1978 (Vic), Fédération Internationale de l'Automobile, Formula One Administration Limited, Formula One Management Limited, Confederation of Australian Motor Sport Limited (CAMS), Parks Victoria, the State Sports Centres Trust, APP Corporation Pty Limited (ACN 003 764 770), Event sponsors and all other persons involved in the organisation, conduct and promotion of the Event or the prize (Associated Entities) from all liability for present or future claims, loss, damage, costs or expenses arising from any personal injury or death (whether arising from negligence (but excluding gross negligence) or otherwise), arising from or connected with participation in Recreational Services (as defined below) at the Event, including the prize. To the extent permitted by law (in particular section 32N of the Fair Trading Act 1999 (Vic) and section 68B of the Trade Practices Act 1974 (Cth)), entrants acknowledge that, to the extent to which they participate at the Event in: • a sporting activity or similar leisure time pursuit; or • an activity that: a. involves a significant degree of physical exertion or physical risk; and b. is undertaken for the purposes of recreation, enjoyment or leisure, (Recreational Services), including, without limitation, participation in the prize, the Associated Entities do not make any warranty that the Recreational Services at the Event, including the prize, will be provided with due care and skill or that any materials provided in connection with the Recreational Services, including the prize, will be fit for the purposes for which they are supplied. Entrants acknowledge that, to the extent that any warranty is implied it is excluded to the full extent permitted by law. WARNING: If you participate in these activities your rights to sue the supplier under the Fair Trading Act 1999 (Vic) if you are killed or injured because the activities were not supplied with due care and skill or were not reasonably fit for their purpose, are excluded, restricted or modified in the way set out in this notice. NOTE: The change to your rights as set out in this notice, does not apply if your death or injury is due to gross negligence on the supplier’s part. “Gross negligence” is defined in the Fair Trading (Recreational Services) Regulations 2004. For the purpose of this Condition 18 “the supplier” shall mean and include the Associated Entities. Without limiting any other release or limitation of liability contained in the Conditions, the Associated Entities will not be liable for any indirect or consequential loss suffered by any Entrant caused by any acts or omissions of the Associated Entities, their directors, employees, agents and contractors arising out of or in relation to the Event or the prize. Nothing in this Condition 18 or these Conditions generally affects your rights under the Trade Practices Act 1974 (Cth), Fair Trading Act 1999 (Vic) or similar legislation regarding implied conditions and warranties to the extent that such implied conditions and warranties cannot be excluded by law. 19. The Promoter reserves the right to request the winner provide proof of age, identity and residency prior to awarding any element of the prize. Identification considered suitable for verification is at the discretion of the Promoter. 20. If a winning entry is deemed not to comply with the Conditions of Entry of this promotion, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry. The Promoter’s decision is final and no correspondence will be entered into. 21. If a winner is under the age of 18 years, the prize will be awarded to that winner’s parent or legal guardian on the winners behalf, who will be awarded the prize for the purposes of these Conditions of Entry, and who must agree to these Conditions (including executing any necessary documentation required by the Promoter to reflect such agreement) or will be deemed to have forfeited the prize. 22. Neither the Promoter, nor any of their associated agencies and companies and the agencies and companies associated with this promotion will be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) by any person in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law). 23. The Promoter collects entrants’ personal information in order to conduct the promotion, as well as winners’ personal information in order to award the prize. If the information requested is not provided, the entrant may not participate in the promotion. 24. By entering the promotion, unless otherwise advised, each entrant also agrees that the Promoter may use this information, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to the entrant, including sending the entrant electronic messages, and telephoning the entrant for an indefinite period. Such personal information will be dealt with by the Promoter in accordance with the Information Privacy Act 2000 (Vic) and the Promoter’s privacy policy. Entrants’ personal information may be disclosed to State and Territory lottery departments and winners’ names published as required under the relevant lottery legislation.
