Moonlight Cinemas online draw promotion

   1. Information on how to enter and prizes form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry.
   2. Entry is open to Australian residents. Individuals under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the entrant must read and consent to all terms and conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to this Promotion. Employees and immediate families of the Promoter and any suppliers, providers and agencies associated with this promotion are ineligible to enter.
   3. Promotion commences on 1st December 2010 and ends at 11.59pm AEDST on 20th March 2011. The draw will take place at Intrepid Travel Pty Ltd, 11 Spring Street, Fitzroy, 3065, Victoria, Australia on 31st March 2011 at 12 noon.
   4. To enter the promotion, individuals must either: (a) visit www.intrepidtravel.com.au, follow the prompts to the promotion entry page, input all of the requested details and submit the fully completed online entry form by 11:59pm AEDST on 20th March 2011; or (b) fully complete the entry form (provided at a participating Moonlight Cinema event) and place it in the entry box provided at the participating Moonlight Cinema event by 11:59pm (local time) on the night of the participating Moonlight Cinema event.
      Participating Moonlight Cinema events will be held on:
          * 6th January 2011, 13th January 2011, 11th February 2011 or 12th February 2011 at the Central Lawn at Royal Botanical Gardens in Melbourne;
          * 63rd February 2011, 10th February 2011, 11th February 2011 or 12th February 2011 at the New Farm Park at Brisbane Power House in Brisbane;
          * 63rd February 2011, 11th February 2011, 12th February 2011 or 19th February 2011 at the Synergy Parklands at Kingspark Botanic Gardens in Perth; and
          * 615th January 2011, 29th January 2011, 11th February 2011 or 13th February 2011 at the Belvedere Amphitheatre at Centennial Park in Sydney.
   5. Multiple entries permitted, however, each entry must be submitted separately and in accordance with entry requirements.
   6. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant. The Promoter also reserves the right, at any time, to request identification for verification purposes (to the Promoter's satisfaction, in its discretion) in order to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) before issuing a prize.
   7. The Promoter's decision on all matters is final and no correspondence will be entered into.
   8. The first five (5) valid entries drawn in the prize draw will each win a $2,000 Intrepid Travel Voucher.
   9. There will be a total of five (5) winners in this promotion. Each winner will be notified in writing and their name will be published in The Australian on 14th April 2011.
  10. Any ancillary costs associated with redeeming the Intrepid Travel voucher are not included. Any unused balance of a voucher will not be awarded as cash. Redemption of a voucher is subject to any terms and conditions of the issuer including those specified on the voucher. Vouchers are valid until 31st October 2011. All travel must be booked and confirmed at least sixty (60) days prior to departure. The vouchers can only be used for Intrepid Travel land only small group adventures, excluding Intrepid Urban adventures, Travel Lab, Special groups and the following trip codes: BAB, TAS, TABC, GXB, GXBA, GSJ, GSA, All Australia trips (P Codes) and Antarctica trips. The entire value of the voucher must be redeemed on one trip. The voucher, or any unused portion of the voucher, is not transferable or exchangeable and cannot be taken as cash. The voucher is only valid for new bookings and cannot be used on existing bookings or in conjunction with any other discounts or special offer. The voucher cannot be redeemed for international airfares, airline taxes, domestic airfares if required, any meals not included with the trip package selected, any sightseeing or activities not included with the trip package selected, any accommodation not included with the trip package selected, personal spending money, passports, travel visas required, transport to and from departure points, travel insurance or any other ancillary costs. Some trips must meet minimum number requirements prior to confirmation. If a prize trip does not reach its minimum number requirement (if applicable), the winner will be informed and will have the opportunity to choose another Intrepid Travel trip, subject to availability.   11. If for any reason a winner does not take their prize (or an element of the prize) by the time stipulated by the Promoter (and specified on the voucher), then the prize (or that element of the prize) will be forfeited. In the event that a winner wishes to forfeit their prize, then the winner must sign any and all documentation, as requested by the Promoter.
  12. The Promoter accepts no responsibility for any variation in prize values. Prizes are not transferable or exchangeable for cash or other goods/services. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any directions from a regularity authority.
  13. Total prize pool value is $10,000.
  14. The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with a prize except for any liability, which cannot be excluded by law. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of or in connection with this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including without limitation technical malfunctions or failures. Tax implications may arise from the receipt or taking of a prize. Independent financial advice should be sought.
  15. If for any reason this promotion is not capable of running as planned because of tampering, unauthorised intervention or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any directions from a regularity authority. The Promoter also reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these Conditions of Entry, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  16. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (b) any tax liability incurred by a winner or entrant; or (c) taking of a prize.
  17. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  18. The Promoter collects contact information about entrants in order to: (a) contact the entrant about the promotion; (b) award prizes; (c) use the information to assist the Promoter in improving goods and services; and (d) to contact entrants in the future with special offers via any medium including mail and commercial electronic messages, for an indefinite period unless otherwise advised by the entrant. If entrants do not provide the information, they cannot participate. If an entrant prefers that this does not occur, please write to the Promoter's Marketing Coordinator at the Promoter's address below.
